GOVERNMENT PLEADER for\nRespondent(s) : 3, \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 07\/05\/2010 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>1.\tThe<br \/>\npetitioner has prayed to direct the respondents that the petitioner<br \/>\nis higher secondary section employee and the jurisdiction to decide<br \/>\nthe case of the petitioner  is vest with Gujarat  Higher Secondary<br \/>\nSchool  Services Tribunal  and to quash and set aside the order dated<br \/>\n1st April 2010.\n<\/p>\n<p>2.\tThe<br \/>\npetitioner was appointed in Saurabh High School in vocational stream<br \/>\nas Typing Instructor. The vocational stream was closed down and the<br \/>\npetitioner was declared as surplus.\n<\/p>\n<p>3.\tThereafter<br \/>\n the petitioner was posted in Uttar Buniyad Vidhyalaya and was<br \/>\npermitted to join on duty from 24th June 2002.\n<\/p>\n<p>4.\tThereafter<br \/>\nshe went on maternity leave and when she came back to resume duty on<br \/>\ncompletion of  maternity  leave, she was not permitted to resume  her<br \/>\nduties and the respondent No. 1 initiated proceedings against the<br \/>\npetitioner  on the ground that her initial appointment was not in<br \/>\naccordance with law.\n<\/p>\n<p>5.\tThereafter<br \/>\nher salary was stopped  and she approached the Hon&#8217;ble  Gujarat<br \/>\nSecondary Education Tribunal  by way of application  No. 284 of 2004<br \/>\nfor getting  salary and ultimately she was paid salary by the<br \/>\nrespondent No. 1.\n<\/p>\n<p>6.\tThereafter<br \/>\nthe petitioner was declared surplus  and was posted at Rachna High<br \/>\nSchool. The respondent No. 1 terminated  the services of the<br \/>\npetitioner against which  the petitioner complained  to District<br \/>\nEducation  Officer  who directed the school management to reinstate<br \/>\nthe petitioner in service.\n<\/p>\n<p>7.<br \/>\nThe respondent  No. 1 filed  application  No. 230 of 2005 before the<br \/>\nGujarat Secondary Education Tribunal  against  the decision of the<br \/>\nDistrict Education Officer and obtained stay against the petitioner.<br \/>\nThe  petitioner raised preliminary issue regarding  the jurisdiction<br \/>\nvested with the Gujarat Secondary Education Tribunal since the<br \/>\nappointment of the petitioner  is in Higher Secondary Section and the<br \/>\nproposal ought to have sent  to the Commissioner  of Higher Education<br \/>\nand not to  District Education Officer. The  petitioner  has been<br \/>\nposted at Rachna High School  on the post  of head clerk  to<br \/>\ndischarge  duty of Junior Clerk.  The petitioner  is higher secondary<br \/>\nsection employee for all purposes and therefore  the proposal for<br \/>\ndismissal is required to be sent  to the Commissioner of Higher<br \/>\nEducation. Hence this petition.\n<\/p>\n<p>8.\tLearned<br \/>\nadvocate for the petitioner has averred that the Tribunal has not<br \/>\nproperly appreciated the facts of the petitioner&#8217;s case  and<br \/>\ntherefore  the order is required  to be quashed  and set aside.\n<\/p>\n<p>9.\tLearned<br \/>\nadvocate for the respondent has contended that it transpires that<br \/>\napprehending  termination of her services  without following the<br \/>\nprocedure  she approached this Secondary Tribunal through Application<br \/>\nNo. 289\/2004. The said application came to be disposed  of vide order<br \/>\ndated 15th June 2005 and the operative  portion is<br \/>\nextracted hereunder :\n<\/p>\n<p>\tThis<br \/>\napplication is disposed of with a direction that the applicant  shall<br \/>\nmake a representation to the D.E.O through  school for her salaries<br \/>\nfrom November 2004 to March 2005. The school shall forward  the<br \/>\nrepresentation to the D.E.O. The D.E.O shall thereafter render a<br \/>\ndecision about the salaries of the applicant  after hearing the<br \/>\napplicant and management within one month. This application  is<br \/>\naccordingly disposed of. No order as to costs.\n<\/p>\n<p>10.\tAs<br \/>\na result of hearing and perusal of the record it is borne out that<br \/>\npost of Clerk in the general school falls within the set up of a<br \/>\nsecondary section. Not only that but the applicant  also appears  to<br \/>\nbe knowing this position and therefore  she herself  had approached<br \/>\nthe  Tribunal and obtained favourable orders and therefore she is<br \/>\nestopped from raising  this objection.
