APP (SJ) No.950 of 2010\n                               SRI RAM SINGH\n                                    Versus\n                            THE STATE OF BIHAR\n                                   -----------\n<\/pre>\n<p>03.   14.12. 2010             Heard the bail prayer of the appellant after receipt<\/p>\n<p>                    of the L.C.R.\n<\/p>\n<p>                              The appellant stands convicted under Section 366A<\/p>\n<p>                    of the I.P.C.\n<\/p>\n<p>                              The allegation and evidence is that the appellant and<\/p>\n<p>                    one another came to informant&#8217;s house and took away his<\/p>\n<p>                    sister Babli Kumari with him stating that his (informant&#8217;s)<\/p>\n<p>                    mother was ill but in the way when some other accused also<\/p>\n<p>                    joined, the victim was taken to other place and that the<\/p>\n<p>                    appellant threatened the victim to kill her if she did not agree<\/p>\n<p>                    to marry him and that she (victim) was also taken to Court at<\/p>\n<p>                    Lakhisarai and her signature was obtained on some papers for<\/p>\n<p>                    the purpose of marriage and that police recovered the victim<\/p>\n<p>                    from the custody of the appellant.\n<\/p>\n<p>                              Learned counsel for the appellant submitted that the<\/p>\n<p>                    F.I.R. was lodged after seven days of the occurrence. It was<\/p>\n<p>                    also submitted that the girl was a major, her age was<\/p>\n<p>                    medically assessed 18-20 years and that at the relevant time<\/p>\n<p>                    the appellant was also a boy of 25 years only.         Learned<\/p>\n<p>                    counsel further submitted that even the victim has stated in<\/p>\n<p>                    her evidence that during the period she remained with the<\/p>\n<p>                    appellant he tried to establish sexual relationship with her<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>       but there is no evidence that he did establish such relation.<\/p>\n<p>       Learned counsel submits that a consented affair was there and<\/p>\n<p>       it was given shape of a case under allegations.         Learned<\/p>\n<p>       Addl.P.P. submits that the victim had stated that she has been<\/p>\n<p>       forcibly taken away. Learned counsel submits that the victim<\/p>\n<p>       is said to have been sent with the appellant as per the<\/p>\n<p>       prosecution story itself. It is also submitted that the appellant<\/p>\n<p>       was on bail during trial.\n<\/p>\n<p>                 In the facts and circumstances, during the pendency<\/p>\n<p>       of the appeal, appellant Sri Ram Singh is admitted to bail on<\/p>\n<p>       furnishing bail bond of Rs.10,000\/- (Ten thousand) with two<\/p>\n<p>       sureties of the like amount each to the satisfaction of 4th Addl.<\/p>\n<p>       Sessions Judge-III, Begusarai in connection with Sessions<\/p>\n<p>       Trial No. 5 of 2006.\n<\/p>\n<\/p>\n<p>                                          (C.M.
