But,<br \/>\nif &#8211;\n<\/p>\n<p>(a)\tThe<br \/>\nCourt from whose decree the appeal is preferred has refused to admit<br \/>\nevidence which ought to have been admitted, or <\/p>\n<p>[(aa)\tThe<br \/>\nparty seeking to produce additional evidence, establishes that<br \/>\nnotwithstanding the exercise of due diligence, such evidence was not<br \/>\nwithin his knowledge or could not, after the exercise of due<br \/>\ndiligence, be produced by him at the time when the decree appealed<br \/>\nagainst was passed, or]<\/p>\n<p>(b)\tThe<br \/>\nappellate Court requires any document to be produced or any witness<br \/>\nto be examined to enable it to pronounce judgment, or for any other<br \/>\nsubstantial cause,<\/p>\n<p>\tThe<br \/>\nappellate Court may allow such evidence or documents to be produced,<br \/>\nor witness to be examined.\n<\/p>\n<p>(2)\tWhether<br \/>\nadditional evidence is allowed to be produced by an appellate Court,<br \/>\nthe Court shall refer the reasoning for its admission.&#8221;\n<\/p>\n<p>2.\tConsidering<br \/>\nthe facts of the case, learned counsel Mr. Surti requests for time to<br \/>\ncomply with the above provision.
