Learned advocate Mr.Bhatia waives service<br \/>\nof notice of rule on behalf of respondents Nos. 2 to 5.  By way of<br \/>\nad-interim relief, stay of the operation, implementation and<br \/>\nexecution of the Award in question till then, on condition that the<br \/>\napplicants shall deposit the awarded amount with cost and interest<br \/>\nwith the Tribunal, on or before the returnable date.&#8221;\n<\/p>\n<p>3.\tToday,<br \/>\nit has been stated by Mr. Bhatia appearing for the original claimants\n<\/p>\n<p>&#8211; respondents herein that 70% of the awarded amount which was<br \/>\nthe liability of the insurance company &#8211; appellant herein has<br \/>\nbeen deposited. Hence, as the condition has been complied with, the<br \/>\nad interim relief granted earlier shall stand confirmed.\n<\/p>\n<p>4.\tWe<br \/>\nhave heard the learned counsel appearing for the applicant and for<br \/>\nthe respondents &#8211; original claimants on the aspect of<br \/>\nwithdrawal.\n<\/p>\n<p>5.\tConsidering<br \/>\nthe facts and circumstances, out of the amount which has been<br \/>\ndeposited, as a normal course, 30% of the amount can be permitted to<br \/>\nbe withdrawn to the original claimants in one set and 70% of the<br \/>\namount shall be permitted to be invested. But, it appears that<br \/>\nrespondent nos. 8 and 9 are minor and therefore their share, even of<br \/>\ndisbursement, will have to be invested until they attain the age of<br \/>\nmajority and upon attaining the majority, with interest they can be<br \/>\npermitted  disbursement of the said amount. So far as the other<br \/>\noriginal claimants viz. respondent nos.5, 6, 7 and 10 are concerned,<br \/>\neach of them would be entitled to their share being 5% of the total<br \/>\namount which is already deposited.\n<\/p>\n<p>6.\tHence,<br \/>\nit is observed and directed that out of the amount which has been<br \/>\ndeposited by the applicant &#8211; appellant, 5% of the amount shall<br \/>\nbe permitted to be withdrawn by way of disbursement to each of the<br \/>\noriginal claimant viz. respondent Nos. 5, 6, 7 and 10 herein,<br \/>\nwhereas, the share, being 5% each of respondent Nos. 8 and 9, who are<br \/>\nminor, shall be invested with the Nationalised Bank initially for a<br \/>\nperiod of three years and such investment shall be renewed from time<br \/>\nto time until the concerned claimants attain the age of majority. It<br \/>\nis also observed that upon attaining the age of majority of<br \/>\nrespondent nos.8 or 9, as the case may be, they shall be permitted to<br \/>\nencash the F.D.R. and the amount shall be paid to them by A\/c. Payee<br \/>\nCheque, without any further order of this Court.\n<\/p>\n<p>7.\tThe<br \/>\nremaining amount of 70% shall be invested by the Tribunal initially<br \/>\nfor a period of three years and such investment shall be continued<br \/>\nfrom time to time until the First Appeal is finally disposed of. The<br \/>\noriginal claimants shall be entitled to periodical interest from time<br \/>\nto time.\n<\/p>\n<p>8.\tIn<br \/>\nview of the aforesaid order, the presence of the other parties to the<br \/>\nproceedings viz. the owner and the driver of the vehicle, respondent<br \/>\nnos. 2 to 4, would not be required at this stage.\n<\/p>\n<p>9.\tApplication<br \/>\nallowed to the aforesaid extent.
