Justice R.BASANT\n\n Dated :18\/12\/2006\n\n O R D E R\n                                R.BASANT, J.\n\n                       ------------------------------------\n\n                        W.P.C.NO.33648 OF 2006\n\n                       ------------------------------------\n\n              Dated this the 18th day of December, 2006.\n\n\n                                  JUDGMENT\n<\/pre>\n<p>      The   petitioner   faces   indictment   in   a   prosecution   under<\/p>\n<p>Section   138   of   the   N.I   Act.     The   complainant   has   filed   a   proof<\/p>\n<p>affidavit.  When the matter came up for hearing, the accused was<\/p>\n<p>present   and   on   behalf   of   the   accused,   the   junior   counsel   has<\/p>\n<p>done   the   cross   examination.     It   is   said   that   the   senior   counsel<\/p>\n<p>had only wanted the junior counsel to get the matter adjourned<\/p>\n<p>for   one   day   or   to   take   up   the   matter   after   lunch   for   cross<\/p>\n<p>examination.   But since that prayer was not granted, the junior<\/p>\n<p>counsel   was   constrained   to   put   some   questions.     The   senior<\/p>\n<p>counsel   obviously   feels   that   the   necessary   questions   have   not<\/p>\n<p>been   put   to   the   complainant.     The   petitioner   then   filed   an<\/p>\n<p>application to recall  the  complainant under Section  311 Cr.P.C.<\/p>\n<p>That petition was dismissed by the learned Magistrate.  A copy of<\/p>\n<p>the order is not produced.  But however, the order is extracted in<\/p>\n<p>the Writ Petition.\n<\/p>\n<\/p>\n<p>      2.     The   short   request   of   the   learned   counsel   for   the<\/p>\n<p>petitioner is that the accused may be given one more opportunity<\/p>\n<p>to cross examine the complainant.   The matter is at the stage of<\/p>\n<p>defence evidence.\n<\/p>\n<p>\n<span class=\"hidden_text\">W.P.C.NO.33648 OF 2006                  2<\/span><\/p>\n<p>        3.    I am satisfied, that this Writ Petition can be disposed<\/p>\n<p>of   without   waiting   for   issue   and   return   of   notice   to   the<\/p>\n<p>respondent\/complainant.     The   petitioner   is   obviously   asking   for<\/p>\n<p>the   luxury   of   a   further   opportunity   to   cross   examine   the<\/p>\n<p>complainant   and   I   am   satisfied   that   on   appropriate     terms,   the<\/p>\n<p>said request can be allowed and quietus can be achieved.<\/p>\n<p>        4.    This Writ Petition is, in these circumstances, allowed.<\/p>\n<p>It   is   directed   that  at   the   defence   stage,   the   learned   Magistrate<\/p>\n<p>shall grant the petitioner\/accused an opportunity to further cross<\/p>\n<p>examine the complainant on condition that the petitioner pays an<\/p>\n<p>amount   of   Rs.250\/-   (Rupees   Two   hundred   fifty   only)   as   cost   to<\/p>\n<p>the complainant.  The complainant shall be examined on the next<\/p>\n<p>date of posting if he is available, and if not, on the next date of<\/p>\n<p>posting.     The   petitioner   shall   not   be   entitled   to   ask   for   any<\/p>\n<p>further adjournment for such cross examination.<\/p>\n<p>        5.
