    Plaintiff in O.S.No.2024\/2001 on the file of<\/p>\n
Munsiff  Court,   Ernakulam   is   the   appellant.<\/p>\n
Defendants are the respondents.  The suit was filed<\/p>\n
for a permanent prohibitory injunction restraining<\/p>\n
respondents from trespassing into the plaint A<\/p>\n
schedule  property   or  destroying   the   western<\/p>\n
boundary of the property and also bringing or<\/p>\n
parking any vehicle into the plaint A schedule<\/p>\n
property and also to allow  appellant to construct<\/p>\n
the boundary wall separating    plaint A schedule<\/p>\n
property from plaint B and C schedule properties<\/p>\n
after  fixing  the  boundary.    The  case  of  the<\/p>\n
appellant was that under Ext.A1 sale deed, plaint A<\/p>\n
schedule property was purchased by the appellant on<\/p>\n
24.1.1980 and under the sale deed  she obtained 23<\/p>\n
cents in survey No.938\/2 and 939\/2 inclusive of the<\/p>\n
excess land in the possession of assignors Radha<\/p>\n
R.S.A.284\/2008               2<\/span><\/p>\n
Bai and Gopala Krishna Mallan           and plaint B<\/p>\n
schedule property belongs to respondents 1 and 2<\/p>\n
and plaint C schedule property to third respondent<\/p>\n
and plaint D schedule property to fourth respondent<\/p>\n
and respondents have no right to trespass into the<\/p>\n
plaint A schedule property or to encroach upon any<\/p>\n
portion      of   the property  and  they  are  to  be<\/p>\n
restrained by a permanent prohibitory injunction.<\/p>\n
It was also contended that as there is dispute with<\/p>\n
regard to the boundaries separating          plaint A<\/p>\n
schedule property from the remaining plaint B        C<\/p>\n
and     D    schedule     properties  of  respondents,<\/p>\n
boundaries are to be fixed.       Respondents resisted<\/p>\n
the suit contending that appellant does not have<\/p>\n
right     over   23  cents  of the  property  and  she<\/p>\n
obtained       only  20  cents  of  the  property  and<\/p>\n
appellant is not entitled to a decree in respect of<\/p>\n
the additional 3 cents of the property and is also<\/p>\n
not entitled to fix the boundary inclusive of the<\/p>\n
additional 3 cents.\n<\/p>\n
      2.      Learned Munsiff on the evidence of Pw1,<\/p>\n
Dws.1 to 6, Exts.A1 to A6, B1, C1 and C1(a)<\/p>\n
dismissed the suit holding that          though under<\/p>\n
R.S.A.284\/2008               3<\/span><\/p>\n
Ext.A1 appellant obtained 23 cents of the property<\/p>\n
under Ext.A2, the assignors of appellant obtained<\/p>\n
only 20 cents       and Ext.A2 does not show that any<\/p>\n
excess land that what was covered under Ext.A2 was<\/p>\n
obtained      by  the   assignors  of   appellant   and<\/p>\n
appellant is not entitled to claim 23 cents as<\/p>\n
shown in plaint A schedule property and she is also<\/p>\n
not entitled to get the boundary fixed in respect<\/p>\n
of 23 cents.       The suit was dismissed.    Appellant<\/p>\n
challenged the judgment before District Court in<\/p>\n
A.S.362\/2005.          Learned   District   Judge    on<\/p>\n
reappreciation of evidence confirmed the findings<\/p>\n
of learned Munsiff and dismissed the suit.       It is<\/p>\n
challenged in the second appeal.\n<\/p>\n
      3.    Learned counsel appearing for appellant was<\/p>\n
heard.\n<\/p>\n
      4.    The argument of learned counsel is that as<\/p>\n
the     suit is one for fixation of the boundary when<\/p>\n
it is found that        Commissioner has not properly<\/p>\n
fixed the boundaries in Ext.C1 plan, after proper<\/p>\n
measurement,      the  suit   should  not   have   been<\/p>\n
dismissed and instead        Commissioner should have<\/p>\n
been directed to identify the property correctly<\/p>\n
R.S.A.284\/2008               4<\/span><\/p>\n
and demarcate the same      and therefore  judgment of<\/p>\n
the courts below is not sustainable.<\/p>\n
      5. on hearing the learned counsel, I do not<\/p>\n
find     that   any  substantial  question  of law  is<\/p>\n
involved in the appeal.\n<\/p>\n
      6.     The right and possession of the appellant<\/p>\n
to the property covered under Ext.A1, to the extent<\/p>\n
of    the    property covered   under  Ext.A2, is  not<\/p>\n
disputed. What is contended by appellant was that<\/p>\n
though under Ext.A2, her assignors Radha Bai and<\/p>\n
Gopala Krishna Mallan obtained only 20 cents       they<\/p>\n
were in possession of 3 cents of excess land which<\/p>\n
was transferred in favour of       the appellant under<\/p>\n
Ext.A1 and appellant is entitled to get a decree in<\/p>\n
respect of the       additional 3 cents.    As rightly<\/p>\n
found by courts below appellant is only entitled to<\/p>\n
get the boundary fixed in respect of the property<\/p>\n
belonging to her.     If appellant has no title to the<\/p>\n
additional extent of the property, she is not<\/p>\n
entitled to get the boundaries      fixed including the<\/p>\n
excess land and to include that portion of the<\/p>\n
property within her property.      Though Ext.A1 shows<\/p>\n
that     property transferred thereunder   is 23 cents<\/p>\n
R.S.A.284\/2008             5<\/span><\/p>\n
inclusive of 20 cents covered under Ext.A2 and<\/p>\n
excess land, Ext.A2 the assignment deed whereunder<\/p>\n
the    assignors  obtained  title  to  the   property<\/p>\n
transferred under Ext.A1 shows that they obtained<\/p>\n
title to only    20 cents.   There is no evidence to<\/p>\n
prove the assignors of the appellant obtained title<\/p>\n
to any additional extent than the property covered<\/p>\n
under Ext.A2,    Therefore eventhough Ext.A1 shows a<\/p>\n
larger extent than what is covered under Ext.A2<\/p>\n
appellant cannot claim title to the excess land.<\/p>\n
As rightly found by courts below appellant cannot<\/p>\n
get the boundary fixed in respect of the additional<\/p>\n
3 cents of the property or a decree for injunction.<\/p>\n
      Appeal is dismissed in limine.\n<\/p>\n<\/p>\n
