NO. 882 OF 2006\n            = = = = = = = = = = = = = = =\n      Dated this the 19th day of December, 2008.\n\n                      J U D G M E N T\n<\/pre>\n<p>     This appeal is preferred against the award of the Motor<\/p>\n<p>Accidents Claims Tribunal, Kasaragod in O.P.(MV)17\/02. The<\/p>\n<p>claimant sustained injuries in a road accident and the<\/p>\n<p>Tribunal has awarded a compensation of Rs.23,400\/- and<\/p>\n<p>made the insurance company liable to pay the compensation.<\/p>\n<p>The insurance company has come up in appeal challenging<\/p>\n<p>the finding of the Tribunal on the question of its liability.<\/p>\n<p>Unfortunately, the Tribunal has not considered the pleadings<\/p>\n<p>raised in the written statement.     In paragraph 4 of the<\/p>\n<p>written statement there is a specific contention that the first<\/p>\n<p>respondent was not having any valid driving licence to drive<\/p>\n<p>the motorcycle and thereby had committed violation of the<\/p>\n<p>policy conditions. It is submitted that an interim application<\/p>\n<p>was also filed calling upon the owner cum driver to produce<\/p>\n<p>the driving licence as I.A.1633\/03. The Tribunal did not<\/p>\n<p>consider that application even. So it is matter where the<\/p>\n<p>M.A.C.A. 882 OF 2006<br \/>\n<span class=\"hidden_text\">                                  -:2:-<\/span><\/p>\n<p>Tribunal has to adjudicate whether there has been any<\/p>\n<p>breach of policy conditions. Therefore the matter requires<\/p>\n<p>reconsideration on that point. So the award under challenge<\/p>\n<p>is set aside so far as it relates to the interse dispute between<\/p>\n<p>the insurance company and the insured is concerned and the<\/p>\n<p>Tribunal is directed to frame appropriate issue and answer<\/p>\n<p>the question whether the insurance company is entitled to<\/p>\n<p>right of recovery if there is no driving licence as there is<\/p>\n<p>breach of policy conditions. But the insurance company has<\/p>\n<p>to pay the amount to the claimant and the junction of the<\/p>\n<p>claimant need not be insisted in the proceedings before the<\/p>\n<p>Tribunal.   Further the insurance company is permitted to<\/p>\n<p>produce both documentary as well as oral evidence in<\/p>\n<p>support of their respective contentions and it is also directed<\/p>\n<p>to take out notice to the owner of the vehicle after it enters<\/p>\n<p>appearance before the Tribunal for proper adjudication.<\/p>\n<p>Parties are directed to appear before the Tribunal on 22.1.09<\/p>\n<p>and the amount deposited shall be disbursed to the claimant.<\/p>\n<p>      The MACA is disposed of accordingly.\n<\/p>\n<\/p>\n<p>                             M.N.
