Heard learned counsel for the petitioner<\/p>\n<p>                     and the State.\n<\/p>\n<p>                              2. Petitioner is the grantee of purcha<\/p>\n<p>                     under    Bihar   Privileged   Persons   Homestead<\/p>\n<p>                     Tenancy Act with respect to 0.045 decimals of<\/p>\n<p>                     land bearing Plot No. 1263 appertaining to Khata<\/p>\n<p>                     No. 775 in Village- Sagi, P.O. Daulatpur, P.S.<\/p>\n<p>                     Khodavandpur, district- Begusarai. This writ<\/p>\n<p>                     petition has been filed by him praying inter alia,<\/p>\n<p>                     to direct the Collector under the Act who has<\/p>\n<p>                     issued purcha for the aforesaid land, photo copy<\/p>\n<p>                     whereof is contained in Annexure-1 to visit the<\/p>\n<p>                     site and ensure removal of encroachment of the<\/p>\n<p>                     school building from the part of the land settled<\/p>\n<p>                     with the petitioner under the said purcha.<br \/>\n<span class=\"hidden_text\">                            2<\/span><\/p>\n<p>         Respondents have not filed counter affidavit<\/p>\n<p>         disputing the submissions.\n<\/p>\n<p>                  3. Having heard counsel for the parties, I<\/p>\n<p>         direct the petitioner to appear before the Circle<\/p>\n<p>         Officer, Khodavandpur with the original purcha,<\/p>\n<p>         copy whereof is contained in Annexure-1 to this<\/p>\n<p>         application and the Circle Officer having satisfied<\/p>\n<p>         himself about the genuineness of the purcha shall<\/p>\n<p>         proceed to the lands-in-question and ensure that<\/p>\n<p>         the land allotted to the petitioner under the said<\/p>\n<p>         purcha is made encroachment free, even by<\/p>\n<p>         removing the structure raised by the school, if<\/p>\n<p>         any, as early as possible, in any case within one<\/p>\n<p>         month from the date of receipt\/production of a<\/p>\n<p>         copy of this order and the purcha before the<\/p>\n<p>         Circle Officer.\n<\/p>\n<p>                  4.
