Viswanathan,\n \t\t\t\tGovernment Advocate.\t\n\n\t\t\t\t\n:ORDER\n<\/pre>\n<p>\tMr.J.Viswanathan, Government Advocate is directed to take notice on behalf<br \/>\nof the respondents.\n<\/p>\n<p>\t2. Heard the learned counsel appearing for the petitioner and the learned<br \/>\nGovernment Advocate appearing for the respondents.\n<\/p>\n<p>\t3. This writ petition has been filed seeking for a direction against the<br \/>\nfirst respondent to release the lorry bearing Regn.No.TN-27-C-2795 seized by the<br \/>\nsecond respondent on 23.1.2006.\n<\/p>\n<p>\t4.  According to the petitioner, he is the owner of the seized vehicle and<br \/>\nthe same is being used as a common carrier.\n<\/p>\n<p>\t5.  Taking into consideration of the relief prayed for, the first<br \/>\nrespondent is directed to release the Lorry bearing Registration Regn.No.TN-27-<br \/>\nC-2795 on 23.1.2006 to the petitioner fulfilling the following conditions.\n<\/p>\n<p>\t  (i) The petitioner shall establish the<\/p>\n<p>ownership of the vehicle by producing necessary<\/p>\n<p>certificate before the first respondent.\n<\/p>\n<p>\t(ii) The petitioner shall not alienate the vehicle in any manner till<br \/>\nadjudication is over.\n<\/p>\n<p>\t(iii) The petitioner shall deposit a sum of Rs.10,000\/-(Rupees ten<br \/>\nthousand only)which is agreed to by the petitioner by way of cash and\n<\/p>\n<p>\t(iv) The petitioner shall give an undertaking that he will not use the<br \/>\nvehicle for any illegal activities  in future and also to produce the vehicle as<br \/>\nand when required by the first respondent.\n<\/p>\n<p>\tAccordingly the Writ Petition is disposed of.
