These two Writ petitions by the employer–Bank and
\nthe workman are directed against the award dated 29-\n<\/p>\n
11\u00bb~2004 passed by the Central Government Industrial<\/p>\n
Tribunal–Cum–Labour Court, Bangalore in
\nCR.No.7\/ 2002. By the impugned award, the Industrial
\nTribunal has modified the punishment of dismissal to
\none of removal from service with superannuation benefits
\nsuch as Pension, Provident Fund, Gratuity, etc.<\/p>\n
2. I have heard the learned counsel appearing for the<\/p>\n
parties, perused the impugned award and the LCR.\n<\/p>\n

3. Facts in brief are that the petitioner while working
\nas a clerk in the employer —- Dena Bank was subjected to
\na disciplinary enquiry on the allegation that he had
\nstolen and fraudulently encashed four cheques
\naggregating Rs.l4,565\/-. The enquiry resulted in his
\ndismissal from service by order dated 22-07 -1998 which
\nalso came to be confirmed by the Appellate Authority.
\nBefore the Industrial Tribunal, the workman conceded
\nthe fairness of the domestic enquiry. The Industrial
\nTribunal has upheld the \ufb01nding of misconduct on the
\nground it was based on a proper consideration of the
\nevidence. However, the Industrial Tribunal by the
\nimpugned award has modified the punishment as stated
\nabove. ‘<\/p>\n
4. Learned counsel appearing for the employer — Bank
\nsubmits that on the facts of the case, the Labour Court
\nhad erred in modifying the punishment of dismissal to
\nthat of removal from service. Further, according to the<\/p>\n
counsel, it had proceeded on an erroneous assumption<\/p>\n

\nthat the workman had an unblemished service record.
\nHe referred to the previous disciplinary cases, the record
\nof which is at Page 51 of the LCR. Learned counsel
\nappearing for the workman could not dispute this fact.
\nHence, 1 find force in the contention of the learned
\ncounsel for the employer — Bank, that the Industrial
\nTribunal examined the aspect of ‘punishment’ on an
\nerroneous assumption relating to the previous service
\nrecord of the Workman. Accordingly, the impugned award
\ninsofar as it relates to modification of the punishment
\nrequires to be set–aside and the matter requires to be
\nreconsidered by the Industrial Tribunal insofar as it<\/p>\n
relates to modification of the punishment.\n<\/p>\n
5. So far as the writ petition of the Workman in
\nW.P.2l414\/ 2005 is concerned, the finding of misconduct
\nis based on a proper consideration of the evidence and
\nhence is not liable to be interfered with by this Court as
\nheld by the I-Ion’b1e Supreme Court in MGMT.,<\/p>\n

\nVISWANATIIAN (AIR 2005 SC 1954). So far as the<\/p>\n
punishment is concerned, learned counsel appearing for
\nthe workman rightly submits that if the impugned award
\ninsofar as it relates to modi\ufb01cation of the punishment is
\nset aside, the Writ petition \ufb01led by the workman does not<\/p>\n
survive for consideration.\n<\/p>\n
6. In View of the above, I make the following order:\n<\/p>\n
[1] the impugned award. insofar as it relates to<\/p>\n
modification of the punishment is set–aside; –\n<\/p>\n
the matter insofar as it relates to punishment<\/p>\n
is remitted to the Industrial Tribunal for
\nreconsideration in accordance with law;
\ncontentions of both the parties relating to the
\npunishment are kept open.\n<\/p>\n
[ii] Registry to return the LCR forthwith.\n<\/p>\n
