In the sick unit a huge<br \/>\n\tamount of money was invested by petitioner. Therefore, his unit<br \/>\n\tshould be considered to be a new unit because he was operating it as<br \/>\n\tnew owner. He led to us the Circular of the Government dated 18th<br \/>\n\tApril, 1961, which provides for exemption. In this circular, it has<br \/>\n\tbeen clearly stated under what circumstances the units would be<br \/>\n\tconsidered as New Industries. In para-5 of the Circular reads as<br \/>\n\tunder:\n<\/p>\n<p>\t?SPara-5 : The expansion :\n<\/p>\n<p>\tAny expansion shall for the purpose of exemption of Octroi be deemed<br \/>\n\tto be new Industry to the extent of expansion only. No exemption<br \/>\n\tshall be given for the replacement of machinery, overhaulting extent<br \/>\n\tof the existing industry.??\n<\/p>\n<p>The<br \/>\n\tcase of the petitioner is that he has purchased the said sick unit,<br \/>\n\tthen did expansion.\n<\/p>\n<p>The<br \/>\n\tsaid unit does not come within the ambit of definition of new unit<br \/>\n\tof the circular dated 18th April, 1961. This circular<br \/>\n\tdated 18th April, 1961 provides that  the exemption is to<br \/>\n\tbe granted to the new industries only and not to the old industries<br \/>\n\tor industries already established. In clause 5, it also provides<br \/>\n\texemption for expansion.\n<\/p>\n<p>No<br \/>\n\tcase was made out by the appellant-petitioner for any expansion. The<br \/>\n\tprinciple case set out by counsel for the petitioner was for New<br \/>\n\tIndustry, it was negatived by the learned Single Judge. That being<br \/>\n\tthe position, we do not consider any interference is called for as<br \/>\n\tthe case of the petitioner would not fall under the circular of the<br \/>\n\tGovernment dated 18th April, 1961. It was not a New<br \/>\n\tIndustry at all. It was an unit, where expansion took place, was not<br \/>\n\tpleaded before the authorities and even in the writ petition. Thus<br \/>\n\tit is evident, this case of expansion was not initially set up, only<br \/>\n\tprayer was in the shape of new unit.\n<\/p>\n<p>We<br \/>\n\tdo not think any relief can be granted. Accordingly, the appeal<br \/>\n\tdeserves no merit. No interference is warranted in the order of the<br \/>\n\tlearned Single Judge. Letters Patent Appeal is accordingly<br \/>\n\tdismissed.
