Ltd.\n<\/p>\n<p>In<br \/>\n\tthe present appeal, appellant has challenged interim order passed by<br \/>\n\tMotor Accident claims Tribunal, Kheda at Nadiad in MACP no.<br \/>\n\t1297\/2006 vide exh 6 dated 27\/4\/2007.  The claims Tribunal has<br \/>\n\tpassed an award u\/s 140 of the Motor Vehicle Act and awarded Rs.<br \/>\n\t25,000\/- with 7.5% interest.\n<\/p>\n<p>Learned<br \/>\n\tadvocate Ms. Bhaya raised contention before this Court that<br \/>\n\tInsurance company has raised objection before claims Tribunal but<br \/>\n\tthat objection is not decided by Tribunal and came to the conclusion<br \/>\n\tthat such objection can be considered at final stage as law laid<br \/>\n\tdown by the Honourable High Court in one decision reported in 1994<br \/>\n\t(2) GLH 58.\n<\/p>\n<p>She<br \/>\n\tsubmitted that recently the apex Court in case of Smt. Yallawwa<br \/>\n\treported in 2007 (5) ST 144 has held that even at the<br \/>\n\tstage of 140 application, if any contention raised by Insurance<br \/>\n\tcompany covered by Section 149 subsection 2 of Motor Vehicle Act,<br \/>\n\tthen Tribunal must have to be examined it and to pass appropriate<br \/>\n\torder u\/s 140 of the Motor Vehicle Act.\n<\/p>\n<p>I<br \/>\n\thave considered this submissions made by learned advocate Ms. Bhaya.<br \/>\n\t It is necessary to note that claimant has filed main application<br \/>\n\tu\/s 166 of the Motor Vehicle Act, which is pending before claims<br \/>\n\tTribunal. Therefore, if this Court will admit appeal at this legal<br \/>\n\tground then such appeal must have to be remained pending before this<br \/>\n\tCourt so long main application is not decided by Claims Tribunal.\n<\/p>\n<p>Therefore,<br \/>\n\taccording to my opinion, if this appeal is disposed of by this Court<br \/>\n\twithout expressing any opinion on merits with a direction to<br \/>\n\tinsurance company to deposit entire awarded amount together with<br \/>\n\tcost and interest before claims Tribunal, and out of that, 30%<br \/>\n\tamount is to be paid to respondent claimant and rest of the amount<br \/>\n\tis to be invested in any nationalized bank with cumulative interest<br \/>\n\tthat will meet the end of justice between parties.\n<\/p>\n<p>Learned<br \/>\n\tadvocate Mr. MK Patel appearing for respondent claimants also<br \/>\n\tsubmitted that respondent claimant will not withdraw main claim<br \/>\n\tpetition from Tribunal or they may not abandoned proceeding, which<br \/>\n\tis pending before claims Tribunal.\n<\/p>\n<p>Therefore,<br \/>\n\tin light of this back ground, present appeal is disposed of by this<br \/>\n\tCourt without expressing any opinion on merits and claims Tribunal<br \/>\n\tshall have to examine all the contentions, which will be raise by<br \/>\n\tInsurance company while deciding main application and claims<br \/>\n\tTribunal will not influence by this interim award, but Tribunal<br \/>\n\tshall have to be examined matter independently.\n<\/p>\n<p>It<br \/>\n\tis directed to appellant Insurance company to deposit entire amount<br \/>\n\tas awarded by Tribunal together with cost and interest. After<br \/>\n\trealizing the amount from Insurance company, it is directed to<br \/>\n\tclaims Tribunal to pay 30% amount in the name of Kaliben Rajubhai<br \/>\n\tVaghri by A\/c payee cheque and rest of the amount is to be invested<br \/>\n\tin any Nationalized Bank for a period of three years with cumulative<br \/>\n\tinterest with periodical renewal till main application is decided by<br \/>\n\tclaims Tribunal. The respondent claimants are not entitled any<br \/>\n\tamount of interest from said FDR.  The FDR is in the name of<br \/>\n\trespondent claimants to be remained with Nazir department of<br \/>\n\tTribunal.
