SIRI JAGAN, J.\n                ------------------------------------\n                     O.P.No. 4789 OF 2001\n              ----------------------------------------\n                Dated this the 5th day of March, 2009\n\n\n\n                            JUDGMENT\n<\/pre>\n<p>      The petitioners are father, mother and minor son. They<\/p>\n<p>together own 29.72 acres of land being part of a larger extent of<\/p>\n<p>about 190 acres, which originally belonged to M\/s. Malayalam<\/p>\n<p>Plantations Ltd, out of which 29.72 acres were purchased by the<\/p>\n<p>petitioners.  Forest authorities initiated proceedings under the<\/p>\n<p>Private Forest (Vesting and Assignment) Act for vesting of the<\/p>\n<p>land in the Government as provided forest. O.A. filed before the<\/p>\n<p>Forest Tribunal by the petitioners was allowed and the said area<\/p>\n<p>was exempted from vesting as a cardamom plantation.<\/p>\n<p>Subsequently, the petitioners converted a portion of the said land<\/p>\n<p>namely, 9.97 acres, as a coffee estate. When they applied for<\/p>\n<p>registration as a coffee estate, by Ext.P4 series, registration was<\/p>\n<p>reused on the ground that the land has been notified under the<\/p>\n<p>Kerala Preservation of Trees Act.          It is under the above<\/p>\n<p>circumstances, the petitioners have filed this original petition<\/p>\n<p><span class=\"hidden_text\">O.P.No.4789\/01                     2<\/span><\/p>\n<p>seeking the following reliefs:\n<\/p>\n<blockquote><p>              a)   call for the records relating to<br \/>\n        Exts.P3 and P4 series.\n<\/p><\/blockquote>\n<blockquote><p>              b)   issue a writ of certiorari quashing<br \/>\n        Ext.P4 series;\n<\/p><\/blockquote>\n<blockquote><p>              c)   issue a writ of mandamus directing<br \/>\n        the respondents to issue the coffee registration<br \/>\n        certificates in respect of the portions of the<br \/>\n        petitioners&#8217; estate mentioned in Ext.P3 series;\n<\/p><\/blockquote>\n<blockquote><p>              d)   issue a writ in the form of a<br \/>\n        declaration  that   Section   5  of   the   Kerala<br \/>\n        Preservation of Trees Act will not attract the<br \/>\n        coffee estate of the petitioners comprised in<br \/>\n        R.S.No.1186 of Vellarimala village, Vythiri Taluk&#8221;.<\/p><\/blockquote>\n<p>     2.     A counter affidavit has been filed producing copy of<\/p>\n<p>the notification issued under the Kerala Preservation of Trees<\/p>\n<p>Act. Having notified the same under the Act, cutting of trees is<\/p>\n<p>prohibited and therefore, the land could not have been<\/p>\n<p>converted into coffee estate, is the contention raised by the<\/p>\n<p>State.\n<\/p>\n<p>     3.     The learned counsel for the petitioner submits that<\/p>\n<p>as per that notification, only 14.1640 hectors have been<\/p>\n<p>declared notified under the Act and there is no indication in<\/p>\n<p>that notification that the same includes the petitioners&#8217;<\/p>\n<p>property.     It is further contended that since the Kerala<\/p>\n<p>Preservation of Trees Act prohibits only cutting of trees in<\/p>\n<p><span class=\"hidden_text\">O.P.No.4789\/01                    3<\/span><\/p>\n<p>cardamom plantations, cardamom hill reserve etc and since<\/p>\n<p>the property in question now is a coffee estate to which the<\/p>\n<p>prohibition under the Preservation of Trees Act cannot apply.<\/p>\n<p>      4.    The contention of the respondents is that 14.1640<\/p>\n<p>hectares notified under the Kerala Preservation of Tees Act<\/p>\n<p>includes the petitioners&#8217; property.    The petitioners have not<\/p>\n<p>been able to controvert that contention.     Therefore, I am not<\/p>\n<p>inclined to countenance that contention of the petitioners.<\/p>\n<p>      Regarding the second contention, if such a contention is<\/p>\n<p>accepted, then any person can defeat the Kerala Preservation<\/p>\n<p>of Trees Act with impunity. The owner of a cardamom estate<\/p>\n<p>cannot convert into a coffee plantation and then claim that<\/p>\n<p>now that it is only a coffee plantation, the Act would not apply.<\/p>\n<p>Admittedly, the property in question was exempted from the<\/p>\n<p>purview of the Kerala Private Forest Vesting and Assignment<\/p>\n<p>Act only as a cardamom estate. Once that land is notified<\/p>\n<p>under the Kerala Preservation of Trees Act, cutting of trees is<\/p>\n<p>prohibited.    The petitioners have converted the same by<\/p>\n<p>cutting trees. In any case since the land was exempted from<\/p>\n<p>vesting under the Kerala Private Forests (Vesting and<\/p>\n<p>Assignment) Act, it could not have been converted into any<\/p>\n<p><span class=\"hidden_text\">O.P.No.4789\/01                    4<\/span><\/p>\n<p>other land. In the above circumstances, the second contention<\/p>\n<p>also fails. Accordingly, the original petition is dismissed.<\/p>\n<p>                                      S.
