Justice V.GIRI\n\n Dated :13\/11\/2008\n\n O R D E R\n                        V.GIRI, J\n                      -------------------\n                  W.P.(C).31405\/2008\n                      --------------------\n      Dated this the 13th day of November, 2008\n\n                      JUDGMENT\n<\/pre>\n<p>      Petitioner is the partner of an establishment<\/p>\n<p>which functions in the         Industrial Estate at Aroor,<\/p>\n<p>Alappuzha.     Petitioner&#8217;s firm handles hundreds of<\/p>\n<p>barrels of chemicals every week and the loading and<\/p>\n<p>unloading of the consignment is being done by the<\/p>\n<p>head load workers registered with respondents 3 to 5.<\/p>\n<p>Petitioner&#8217;s complaint is regarding the excessive<\/p>\n<p>charges being collected by the Unions over and above<\/p>\n<p>the rates which are approved by the Head load<\/p>\n<p>Workers Welfare Fund Board. Reference is made in<\/p>\n<p>the writ petition to Ext.P1 list of wages prevailing from<\/p>\n<p>7.11.2006.\n<\/p>\n<\/p>\n<p>2.    On instructions,     learned Standing Counsel for<\/p>\n<p>the Board submits that the rates have been revised<\/p>\n<p>with effect from 11.7.2008. Counsel for the petitioner<\/p>\n<p>is justified in submitting that the Unions shall not be<\/p>\n<p>permitted to collect any rate in excess of        what is<\/p>\n<p>W.P.(C).31405\/2008<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>permitted by the Board and this would apply both in<\/p>\n<p>relation to the rates prescribed under Ext.P1 and the<\/p>\n<p>revised rates as such.\n<\/p>\n<\/p>\n<p>3.    Accordingly, writ petition is disposed of directing<\/p>\n<p>respondents 1 and 2 to see that the rates which are<\/p>\n<p>prescribed by the Board, for loading and unloading of<\/p>\n<p>materials is strictly enforced and no Union is permitted<\/p>\n<p>to collect any charges in excess thereof.
