Petitioner was dismissed from service on<br \/>\n7.4.1999. He has filed this petition for setting aside<br \/>\nof the dismissal order and for his reinstatement in<br \/>\nservice with back wages.\n<\/p>\n<p> 2. Petitioner was enrolled in BSF on 23.5.1988.<br \/>\nAt one stage, he was sent to undergo D &amp; M Course and<br \/>\nwas granted casual leave and reward leave. After expiry<br \/>\nof his  leave, he was to report for duty in his unit on<br \/>\n26.5.1998 but he failed. Notices were sent to him by<br \/>\nregistered post asking him to resume his duty to which<br \/>\nhe failed to respond. Later apprehension rolls were<br \/>\nalso issued against him which also went abegging. He<br \/>\nwas then proceeded under Section 62 of BSF Act leading<br \/>\nto the holding of court of inquiry against him to<br \/>\ninvestigate into his unauthorised absence of 316 days.<br \/>\nThe court of inquiry report along  with show cause notice<br \/>\ndated 5.3.1999 was also sent to him which was, however,<br \/>\nreceived back unserved. He was then finally dismissed<br \/>\nby under dated 7.4.1999 passed by the Commandant under<br \/>\nSection 11(2) of the Act read with Rule 177 of BSF Rules<br \/>\nwithout any pensionary and financial benefits. He<br \/>\nrepresented against this but his representation was<br \/>\nrejected. He thereafter filed a statutory appeal also<br \/>\nwhich met with the same fate.\n<\/p>\n<p> 3. Petitioner complains of violation of principles<br \/>\nof natural justice. He alleges that he neither received<br \/>\nany show cause notice from R-4 nor any copy of the<br \/>\nreport of court of inquiry and other documents. He also<br \/>\nclaims that he had addresses a letter to 25 BSF dated<br \/>\n28.8.1999 requesting for some documents related to<br \/>\ntermination of his services but even this was not<br \/>\nacknowledged. He lastly submits that his dismissal<br \/>\norder was illegal because it was ordered in exercise of<br \/>\nadministrative power without following the other<br \/>\nalternatives provided in Sections 19, 62 and Rules 20,<br \/>\n21 and 22 as Commandant had not recorded any certificate<br \/>\nthat the trial of petitioner was inexpedient or was not<br \/>\nreasonably practicable.\n<\/p>\n<p> 4. Respondents have filed their counter through<br \/>\nS.K. Dewan, DIG (HQ) taking the stand that petitioner was<br \/>\nrepeatedly asked to resume his duties through registered<br \/>\nletters. Even apprehension rolls were issued against<br \/>\nhim. But he failed to respond to all this and could not<br \/>\nbe located till he surfaced to make a representation<br \/>\nagainst his dismissal and filed the statutory<br \/>\nrepresentation. It is also claimed that the requisite<br \/>\nshow cause notice along with court of inquiry<br \/>\nproceedings was sent to him by registered letter dated<br \/>\n5.3.1999 proposing termination of his services without<br \/>\nany financial benefits but even this was received back<br \/>\nas unserved. Thereafter Commandant, after considering<br \/>\nhis entire case, ordered his dismissal on 7.4.1999 under<br \/>\nSection 11(2) of the Act read with Rule 177 without any<br \/>\npensioner\/financial benefits and treated his period of<br \/>\nunauthorised absence of 316 days as dies-non. He was<br \/>\nlater struck off the strength on 7.4.1999. It is also<br \/>\nsubmitted that the show cause notice issued to<br \/>\npetitioner on 5.3.1999 recorded the opinion of the<br \/>\nCommandant that his retention in service was undesirable<br \/>\nand that his trial by security force court was<br \/>\ninexpedient and impracticable.\n<\/p>\n<p> 5. All that remains to be seen is whether<br \/>\npetitioner could be dismissed from service in exercise<br \/>\nof power under Section 11(2) of the Act read with Rule<br \/>\n177 or whether respondents were obliged to take recourse<br \/>\nto trial by security force court and also whether<br \/>\nnon-receipt of the show cause notice and the court of<br \/>\ninquiry proceedings would vitiated the action taken<br \/>\nagainst him in the facts and circumstances of the case.\n<\/p>\n<p> 6. Section 11(2) of the Act read with Rule 177<br \/>\nempowers the Commandant to dismiss or remove from<br \/>\nempowers the Commandant to dismiss or remove from<br \/>\nservices any person under his command other than an<br \/>\nofficer or a subordinate officer. It has obviously<br \/>\nnothing to do with the power of security force court for<br \/>\ntrying such person and dealing with the offences with<br \/>\nwhich he is charged and to award him the requisite<br \/>\npunishment. This power enjoyed by the Commandant is an<br \/>\nindependent power and it has been held to be so by<br \/>\nseveral judgments of the Supreme Court. It was first<br \/>\nlaid down in  Gouranda Chakraboprty v. State of Tripura<br \/>\n and then followed in  <a href=\"\/doc\/902635\/\">Union v. Ram Pal<\/a><br \/>\n1996 (2) SLR 297 holding that the power exercised by a<br \/>\nCommandant under Section 11(2) read with Rule 177 was an<br \/>\nindependent power which had nothing to do with the power<br \/>\nexercisable by a security force court and once show<br \/>\ncause notice was issued in terms thereof, no further<br \/>\ninquiry was required to be held if the delinquent person<br \/>\nfailed to reply to the notice and to deny the<br \/>\nallegations in the process.\n<\/p>\n<p> 7. In this view of the matter, we find nothing<br \/>\nwrong in the course adopted by R-4 in ordering<br \/>\npetitioner&#8217;s dismissal in exercise of power under<br \/>\nSection 11(2) of the Act read with Rule 177 subject, of<br \/>\ncourse, to the fulfillment of other requirements.\n<\/p>\n<p> 8. It goes without saying that petitioner was<br \/>\nentitled to show cause notice proposing his termination<br \/>\nfrom service recording the Commandant&#8217;s satisfaction on<br \/>\nthe report of the court of inquiry and that it was<br \/>\ninexpedient to go ahead with the security force court in<br \/>\nterms of Rule 22. But this requirement was also<br \/>\nsatisfied in the present case because show cause notice<br \/>\ndated 5.3.1999 along with the court of inquiry<br \/>\nproceedings was sent to petitioner through registered<br \/>\nletter No. Estt\/25 Bn\/D530\/RK\/99\/5769 which was received<br \/>\nback undelivered with the report that addressed was not<br \/>\nfound residing at the given address.\n<\/p>\n<p> 9. Given regard to this and that all notices and<br \/>\napprehension rolls sent to petitioner had gone abegging<br \/>\nin the past also, though petitioner had at a later stage<br \/>\nchosen to represent against his dismissal, it can&#8217;t be<br \/>\nsaid or held that R-4 had failed to give show cause<br \/>\nnotice to petitioner and to satisfy the prescribed<br \/>\nrequirements under Rule 22. If a person can&#8217;t be<br \/>\nreached to receive the notice proposing punishment to<br \/>\nhim or if it is found that he had deliberately avoided<br \/>\nto receive the notice, the authority issuing the notice<br \/>\ncan&#8217;t be blamed for this or charged of failure to<br \/>\nsatisfy the requirement. In such a case, presumption of<br \/>\nservice of notice goes against the person to whom the<br \/>\nnotice was addressed. It accordingly becomes difficult<br \/>\nfor us to uphold petitioner&#8217;s contention and to hold<br \/>\nthat R-4 (Commandant) had failed to issue him show cause<br \/>\nnotice impinging upon the action taken against him.\n<\/p>\n<p> 10. That leaves us with the only surviving issue<br \/>\nwhether petitioner could be dismissed from service<br \/>\nwithout pensionary and financial benefits. We are<br \/>\ninformed that CCS (Pension) Rules were applicable to<br \/>\nBSF. Rule 24 of the Rules provides that a dismissal or<br \/>\nremoval of a Government servant from service will entail<br \/>\nforfeiture of his past service. That being so,<br \/>\npetitioner&#8217;s dismissal without pensionary\/fianancial<br \/>\nbenefits could not be faulted as such. But considering<br \/>\nthe overall circumstances of his case, he could be at<br \/>\nleast considered for payment of compassionate allowance<br \/>\nunder Rule 41 of the CCS (Pention) rules which provides<br \/>\nfor grant of allowance in deserving cases and in cases<br \/>\nof special consideration. He may make a representation<br \/>\nfor this which shall be considered by the concerned<br \/>\nauthority and appropriate orders passed thereon within<br \/>\nfour months from receipt of representation.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Delhi High Court Ex.
