Justice ANTONY DOMINIC\n\n Dated :17\/06\/2010\n\n O R D E R\n                       ANTONY DOMINIC, J.\n              --------------------------------------------------\n                 W.P.(C) NO.18919 OF 2010 (L)\n              --------------------------------------------------\n             Dated this the 17th day of June, 2010\n\n                           J U D G M E N T\n<\/pre>\n<p>      Petitioner is occupying quarter No. F-10 in the police family<\/p>\n<p>quarters, Thiruvananthapuram. Ext.P1 order was passed by the 3rd<\/p>\n<p>respondent ordering his eviction. Implementing Ext.P1, the 4th<\/p>\n<p>respondent issued Ext.P2 notice. Thereupon, the petitioner<\/p>\n<p>submitted Exts.P3 and P4 representations before the 4th respondent<\/p>\n<p>and 2nd respondent respectively. By Ext.P5, the 2nd respondent called<\/p>\n<p>him for a hearing and according to the petitioner a hearing was<\/p>\n<p>granted. When urged his contentions in the matter. According to the<\/p>\n<p>counsel, final orders have not been passed on Ext.P5 so far and in<\/p>\n<p>the meanwhile Ext.P6 notice has been issued requiring his<\/p>\n<p>immediate eviction. It is in this circumstances the writ petition is<\/p>\n<p>filed.\n<\/p>\n<p>      2. From the facts stated above it is seen that, according to<\/p>\n<p>the petitioner, the appeal filed by him before the 2nd respondent<\/p>\n<p>evidenced by Ext.P4 is pending and orders have not been passed so<\/p>\n<p>far. It is at this stage that he is sought to be evicted from the<\/p>\n<p>WPC.No. 18919\/2010<br \/>\n<span class=\"hidden_text\">                                   :2 :<\/span><\/p>\n<p>quarters.\n<\/p>\n<p>      3. In my view in the circumstances as noticed above, what is<\/p>\n<p>required to be done is that the 2nd respondent should consider<\/p>\n<p>Ext.P4 and pass final orders, deferring coercive action against the<\/p>\n<p>petitioner.\n<\/p>\n<p>       Therefore, I dispose of this writ petition directing the 2nd<\/p>\n<p>respondent to pass orders on Ext.P4. This shall be done as<\/p>\n<p>expeditiously as possible and at any rate within 4 weeks from the<\/p>\n<p>date of production of a copy of the judgment.
