As per the case<br \/>\n\tof the respondent before the Courts below, she is entitled to be<br \/>\n\tpromoted to the post of Head Constable since the year 1977. Hence,<br \/>\n\tshe submitted an application dated 01st January 1985 to<br \/>\n\tthe appellant No.3 and subsequently also made applications. However,<br \/>\n\tall in vain and, therefore, she filed Regular Civil Suit No.616 of<br \/>\n\t1987 before the Civil Judge (Senior Division), Bhavnagar. The trial<br \/>\n\tCourt after hearing the parties has decreed the suit vide impugned<br \/>\n\tjudgment and decree dated 29th September 1995.\n<\/p>\n<p>2.1\tBeing<br \/>\naggrieved by the said judgment and decree, the appellants herein<br \/>\npreferred Regular Civil Appeal No.171 of 1995, which ultimately came<br \/>\nto be dismissed vide impugned judgment and order dated 23rd<br \/>\nApril 1997 passed by the Assistant Judge, Bhavnagar, confirming the<br \/>\njudgment and decree passed by the trial Court. Hence, present appeal.\n<\/p>\n<p>Present<br \/>\n\tappeal has been admitted for hearing the parties on the following<br \/>\n\tsubstantial question of law :\n<\/p>\n<p>&#8220;Whether<br \/>\nthe suit filed by the respondent in 1987 claiming her promotion is<br \/>\nstood barred by law of limitation, delay and latches especially in<br \/>\nview of the fact that juniors to her were promoted ?&#8221;\n<\/p>\n<p>Having<br \/>\n\tconsidered the rival contentions raised by the learned advocates for<br \/>\n\tthe respective parties, the documentary evidence produced on record<br \/>\n\tand the impugned judgments and decrees as well as the substantial<br \/>\n\tquestion of law, it transpires that the Courts below have after<br \/>\n\tgoing through the relevant aspects of the matter rightly came to the<br \/>\n\timpugned conclusion, which is just and proper. So far as the<br \/>\n\taforesaid issue is concerned, Mrs.Sangeeta Pahwa, learned advocate<br \/>\n\tfor the respondent, has relied upon a decision of the Apex Court in<br \/>\n\tthe case of <a href=\"\/doc\/7053\/\">Banarsi Das v. Kanshi Ram and others<\/a>, reported in<br \/>\n\tAIR 1963 SC 1165, whereby<br \/>\n\tit is held that the question of limitation was not one purely of law<br \/>\n\tbut was a mixed question of fact and law. Here it<br \/>\n\twould be beneficial to reproduce the relevant paragraph of the said<br \/>\n\tdecision as under :\n<\/p>\n<p>&#8220;15.\n<\/p>\n<p>\t\tThe  High Court has overlooked the fact that even  upon\tthe<br \/>\nargument  addressed before it on behalf of Kanshi Rain, the question<br \/>\nof limitation was not one purely of law but was  a mixed question of<br \/>\nfact and law and, therefore, it  was not proper for it to allow it to<br \/>\nbe raised for the first time in argument. We are satisfied that what<br \/>\nthe High  Court has done has caused prejudice to some of the parties<br \/>\nto the suit and  on that ground alone, we would be justified in<br \/>\nsetting aside  its decision.  If the High Court felt overwhelmed by<br \/>\nthe  provisions of s. 3 of the limitation Act, it should  at least<br \/>\nhave given an opportunity to the parties  which supported the decree<br \/>\nof the trial court to meet the plea of limitation  by amending  their<br \/>\npleadings.  After allowing the pleadings  to be  amended, the High<br \/>\nCourt should have framed an issue and remitted  it for a finding to<br \/>\nthe trial Court.\t Instead  of doing so, it has chosen to treat the<br \/>\npleading of one of the defendants  as conclusive not only on the<br \/>\nquestion  of\tfact but also on the question of law and dismissed the<br \/>\nsuit. It is quite possible that had an opportunity been given to the<br \/>\ndefendants,  they could have established, in addition to proving the<br \/>\ndates on which the summonses were served, that the suit was not<br \/>\nbarred by time because of acknowledgment in the  course of the<br \/>\ndiscussion, the High Court had said\tthat it was not suggested before<br \/>\nit by anyone that the claim was not  barred  by reason of<br \/>\nacknowledgments.  Apparently,  no such  argument\twas  advance before<br \/>\nit on  behalf  of\t the plaintiff  and the defendant Banarsidas<br \/>\nbecause the counsel were apparently taken by surprise and had no<br \/>\nopportunity  to obtain instructions  on this aspect of the  case.  We<br \/>\nare clearly of  opinion  that the High Court was  in  error  in<br \/>\nallowing  the  plea  of limitation to be  raised  before  it<br \/>\nparticularly by defendants who had not even filed a  written<br \/>\nstatement in the case.\t We do not think that this was a fit case for<br \/>\npermitting an entirely new point to be raised by  a non-contesting<br \/>\nparty to the suit.&#8221;\n<\/p>\n<p>In<br \/>\n\tview of aforesaid and applying the aforesaid ratio of the above<br \/>\n\tcited decision in the present case, I am of the opinion that the<br \/>\n\tCourts below have assigned cogent and convincing reasons for<br \/>\n\tarriving at the conclusion. Over and above the aforesaid reasons, I<br \/>\n\tadopt the reasons assigned by the Courts below and do not find any<br \/>\n\tillegality much less any perversity in the findings recorded. I am<br \/>\n\tin complete agreement with<br \/>\n\tthe findings recorded by the Courts below. No case is made out to<br \/>\n\tinterfere with the findings recorded by the Courts below. Hence,<br \/>\n\tpresent appeal deserves to be dismissed.\n<\/p>\n<p>For<br \/>\n\tthe foregoing reasons, present appeal fails and is, accordingly,<br \/>\n\tdismissed. No order as to costs.
