B. Tiwari\nRespondent           -      Dy. Commissioner of Police (Traffic)\n\n\nFacts<\/pre>\n<p>:\n<\/p>\n<p>     By an application of 19.7.07, Shri N. B. Tiwari of Asaf Ali Road, New Delhi<br \/>\napplied to the PIO Delhi Traffic Police, Central Zone, seeking the following<br \/>\ninformation:\n<\/p>\n<blockquote><p>            1. &#8220;Whether the corridor premises of 3\/13-B, Asaf Ali Road is<br \/>\n               no parking zone as per Traffic Rules.\n<\/p><\/blockquote>\n<blockquote><p>            2. If yes, please provide Minutes of Meeting on which date the<br \/>\n               corridor premises declared that No Parking Zone by Delhi<br \/>\n               Traffic Police Authority, because towing team forcibly picked<br \/>\n               my vehicle No. DL 3S AT 8663 on dt. 29.6.07 (RC Copy<br \/>\n               enclosed).\n<\/p><\/blockquote>\n<blockquote><p>            3. In your opinion the violation of the Motor Vehicle Act in<br \/>\n               corridor area are in main road area.\n<\/p><\/blockquote>\n<blockquote><p>            4. Why the Towing Team forcibly picked up the Vehicle instead<br \/>\n               of my objection.&#8221;<\/p><\/blockquote>\n<p>     To this he received a response dated 17.8.07 from PIO Shri D. P. Verma,<br \/>\nDCP (Traffic) HQ, Delhi, as below:\n<\/p>\n<blockquote><p>         &#8220;Q.1. Whether the corridor premises of 3\/13-B, Asaf Ali Road is no<br \/>\n               parking zone as per Traffic Rules.\n<\/p><\/blockquote>\n<blockquote><p>         Ans: No. Asaf Ali Road Corridor has not been declared No<br \/>\n               Parking officially but no one is allowed to park vehicle on the<br \/>\n               main road obstructing smooth flow of traffic \/ improper<br \/>\n               parking.\n<\/p><\/blockquote>\n<blockquote><p>         Q.2  If yes, please provide Minutes of Meeting on which date the<br \/>\n              corridor premises declared that No Parking Zone by Delhi<br \/>\n              Traffic Police Authority, because towing team forcibly picked<br \/>\n              my vehicle No. DL 3S AT 8663 on dt. 29.6.07 (RC Copy<br \/>\n              enclosed).\n<\/p><\/blockquote>\n<blockquote><p>         Ans: The vehicle was towed away and prosecuted because it was<br \/>\n              parked improperly \/ obstructively.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">                                                1<\/span><\/p>\n<blockquote><p>        Q.3  In your opinion the violation of the Motor Vehicle Act in<br \/>\n            corridor area are in main road area.\n<\/p><\/blockquote>\n<blockquote><p>       Ans: Yes, improper \/ obstructive parking is not allowed at any<br \/>\n            place. Hence to be prosecuted under M.V.Act.\n<\/p><\/blockquote>\n<blockquote><p>       Q.4  Why the Towing Team forcibly picked up the Vehicle instead<br \/>\n            of my objection.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>       Ans: The traffic staff had made the public announcement by PA<br \/>\n            System that obstructively parked vehicles be removed at<br \/>\n            once by their owners but despite of announcement the<br \/>\n            vehicles were not removed. Hence the traffic staff towed<br \/>\n            away the vehicles and prosecuted.&#8221;<\/p><\/blockquote>\n<p>      Shri Tiwari then moved an appeal before Addl. Commissioner of Police<br \/>\n(Traffic) on 24.8.07 complaining against the action taken in towing his vehicle<br \/>\nand raising fresh questions. Upon this Shri M. S. Upadhye, Addl. Commissioner<br \/>\nof Police (Traffic) ordered as follows:\n<\/p>\n<blockquote><p>       &#8220;It is noted that information supplied to the appellant by PIO\/Traffic<br \/>\n       vide letter number referred above is correct and complete in all<br \/>\n       respects. Hence there is no ground to issue any fresh direction to<br \/>\n       the PIO\/Traffic in this regard and the appeal filed by the appellant is<br \/>\n       dismissed.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>      In his second appeal before us appellant Sh. Tiwari&#8217;s prayer is as below:<br \/>\n       &#8220;1.    As per RTI Act 2005, the Traffic Authority declared that<br \/>\n              3\/13\/-B, Asaf Ali corridor premises is No Parking Zone.\n<\/p><\/blockquote>\n<blockquote><p>       2.     Then, why the Towing Team forcibly picked my Vehicle<br \/>\n              No. DL 3S AT 8663 and charged Rs. 700\/- as per Hon&#8217;ble<br \/>\n              High Court&#8217;s Rule.\n<\/p><\/blockquote>\n<blockquote><p>       3.     If the Duty Officer, Mr. Mohinder Singh, ASI knowing that<br \/>\n              the premises is no parking zone why he has illegally<br \/>\n              charged Rs. 700\/-\n<\/p><\/blockquote>\n<blockquote><p>       4.     What are the Rules about illegal charges to refund the<br \/>\n              vehicle holder are can approach any other Authority like<br \/>\n              Judiciary to recover illegal amount.&#8221;\n<\/p><\/blockquote>\n<p>The appeal was heard on 18.6.09. The following are present:\n<\/p>\n<blockquote><p>       Appellant<br \/>\n             Sh. N. B. Tiwari (who appeared after the hearing)<br \/>\n       Respondents<br \/>\n             Shri Prabhakar, PIO \/ DCP Traffic<br \/>\n             Shri Amrik Singh, Insp. RTI<\/p>\n<p><span class=\"hidden_text\">                                          2<\/span><br \/>\n       PIO Shri Prabhakar, DCP (Traffic) submitted that he has in his possession<br \/>\nthe concerned rules about levy of charges and refund.<\/p><\/blockquote>\n<p>                                   DECISION NOTICE<\/p>\n<p>      We find that all the information sought by appellant Shri N. B. Tiwari in his<br \/>\nwritten application has been provided by the CPIO.          Shri Tiwari&#8217;s complaint<br \/>\nthereafter seems more to be of his perception that he has been treated unjustly,<br \/>\nleading to his raising questions not even referred to in his initial application. But<br \/>\nin this regard while he himself admits to having been told &#8220;that 3\/13\/-B, Asaf Ali<br \/>\ncorridor premises is No Parking Zone&#8221; he has gone on to ask why penalty has<br \/>\nbeen imposed, when the answer is self evident. As correctly held by Addl.<br \/>\nCommissioner of Police Sh. Upadhye, the task of an Appellate Authority is to<br \/>\nexamine the manner in which the information has been provided in response to<br \/>\nthe questions asked in the original application.       Neither the First Appellate<br \/>\nAuthority nor the Second Appellate Authority under the Act or indeed any other<br \/>\nlaw require to replace the initial adjudicating authority with regard to the issues<br \/>\nadjudicated upon.    This appeal is, therefore, without merit and is hereby<br \/>\ndismissed.\n<\/p>\n<p>      However, as submitted by Shri Prabhakar in the hearing, he may at his<br \/>\ndiscretion provide to appellant Sh. N. B. Tiwari, a copy of the rules sought by him<br \/>\nin his prayer in the second appeal.\n<\/p>\n<p>      Announced in the hearing.
