SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 08\/02\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tThe<br \/>\npresent application under Section 5 of the Limitation Act has been<br \/>\npreferred by the applicants to condone the delay of 76 days in<br \/>\npreferring the First Appeal challenging the judgment and award dated<br \/>\n22\/09\/2009 passed by the learned Motor Accident Claims Tribunal<br \/>\n(Auxiliary), Bhavnagar in M.A.C.P. No. 971\/1999 so far as not<br \/>\nawarding full claim as prayed for.\n<\/p>\n<p>2.\tShri<br \/>\nH.N. Acharya, learned advocate has stated at the bar that he has<br \/>\ninstructions to appear on behalf of opponent no. 2.\n<\/p>\n<p>3.\tHaving<br \/>\nheard Shri Gaurav Chudasma, learned advocate appearing on behalf of<br \/>\nthe applicants and Shri H.N. Acharya, learned advocate appearing on<br \/>\nbehalf of opponent no. 2 and though served, nobody appears on behalf<br \/>\nof opponent no. 1 and considering the averments in the application in<br \/>\nsupport of the prayer to condone the delay as sufficient cause is<br \/>\nshown to condone the delay, the delay caused in preferring the First<br \/>\nAppeal is hereby condoned.  The present application is allowed.  Rule<br \/>\nis made absolute accordingly.
