Justice M.SASIDHARAN NAMBIAR\n\n Dated :02\/11\/2009\n\n O R D E R\n             M.Sasidharan Nambiar, J.\n            --------------------------\n              Crl.M.C.No.2591 of 2009\n            --------------------------\n\n                       ORDER\n<\/pre>\n<p>    Scorpio Car KL-09\/S 4788 was found abandoned<\/p>\n<p>near Thrissur Indoor Stadium on 24.12.2008 at about<\/p>\n<p>4.10 p.m. On search, it was found that 36 plastic<\/p>\n<p>jars, each containing 32 litres of spirit, were<\/p>\n<p>kept in the Car. The vehicle and the spirit were<\/p>\n<p>seized. Subsequently, petitioner was arrested and<\/p>\n<p>his  Lancer   Car,  mobile   phone  and   cash   of<\/p>\n<p>Rs.10,88,000\/- were seized. Petitioner filed M.P.<\/p>\n<p>No.1677\/2009, under Section 451 of Code of Criminal<\/p>\n<p>Procedure, for interim custody of the cash seized<\/p>\n<p>from him. By Annexure-I order, learned Magistrate,<\/p>\n<p>accepting the objection raised by the Investigating<\/p>\n<p>Officer, dismissed the petition. This petition is<\/p>\n<p>filed  under  Section  482  of  Code  of   Criminal<\/p>\n<p>Procedure to quash Annexure-I order and to get<\/p>\n<p>interim custody of the cash.\n<\/p>\n<p><span class=\"hidden_text\">CRMC 2591\/09             2<\/span><\/p>\n<p>    2. Learned counsel appearing for the petitioner<\/p>\n<p>and learned Public Prosecutor were heard.<\/p>\n<p>    3. Learned counsel appearing for the petitioner<\/p>\n<p>argued that the power of confiscation is restricted<\/p>\n<p>to liquor or the vehicle, which was used for<\/p>\n<p>committing the offence, as provided under Section<\/p>\n<p>65 of Abkari Act and confiscation is not provided<\/p>\n<p>in respect of the cash seized from the petitioner<\/p>\n<p>and hence, learned Magistrate was not justified in<\/p>\n<p>dismissing   the  petition. Learned   counsel  also<\/p>\n<p>submitted   that petitioner  had  produced  records<\/p>\n<p>before the learned Magistrate to prove the source<\/p>\n<p>of money seized from him.\n<\/p>\n<p>    4. Learned Public Prosecutor submitted that<\/p>\n<p>confiscation proceedings are initiated and in such<\/p>\n<p>circumstances, petitioner is not entitled to get<\/p>\n<p>interim custody of the cash.\n<\/p>\n<p>    5.    As rightly pointed  out  by  the  learned<\/p>\n<p>counsel appearing for the petitioner, Section 65 of<\/p>\n<p>Abkari Act, provides for the things, which are<\/p>\n<p><span class=\"hidden_text\">CRMC 2591\/09             3<\/span><\/p>\n<p>liable for confiscation, do not enable the State to<\/p>\n<p>confiscate    the cash  in  the  possession  of an<\/p>\n<p>accused. Under Section 65 of Abkari Act, liquor,<\/p>\n<p>drug,   materials,  still,  utensil,  implement  or<\/p>\n<p>apparatus in respect of or by means of which an<\/p>\n<p>offence     has  been  committed  is   liable   for<\/p>\n<p>confiscation. So also the receptacles, packages and<\/p>\n<p>coverings in which any such liquor, intoxicating<\/p>\n<p>drug,   materials,  still,  utensil,  implement  or<\/p>\n<p>apparatus is or are found and the other contents if<\/p>\n<p>any, of the receptacles or packages in which the<\/p>\n<p>same is or are found and the animals, cart, vessels<\/p>\n<p>or other conveyance used for carrying the same are<\/p>\n<p>liable for confiscation. By invoking Section 65,<\/p>\n<p>confiscation of cash in possession of a person,<\/p>\n<p>suspected to have committed an offence, is not<\/p>\n<p>possible. Learned Magistrate was, therefore, not<\/p>\n<p>justified in dismissing the petition on the ground<\/p>\n<p>that it is liable for confiscation.\n<\/p>\n<p><span class=\"hidden_text\">CRMC 2591\/09             4<\/span><\/p>\n<p>     Petition  is  allowed.  Annexure-I  order   is<\/p>\n<p>quashed. M.P.No.1677\/2009 is remanded to Judicial<\/p>\n<p>First   Class Magistrate&#8217;s  Court-I,  Thrissur  for<\/p>\n<p>fresh disposal in accordance with law, considering<\/p>\n<p>the question whether the cash seized is that of the<\/p>\n<p>petitioner or not.
