Justice T.R.RAMACHANDRAN NAIR\n\n Dated :09\/11\/2009\n\n O R D E R\n               T.R RAMACHANDRAN NAIR,J.\n                       -------------------------\n                  W.P ( C) No.30719 of 2009\n                      --------------------------\n             Dated this the 9th November,2009\n\n                        J U D G M E N T\n<\/pre>\n<p>      The main prayer in the writ petition is for a direction<\/p>\n<p>to   the respondent to consider Ext.P6 application and<\/p>\n<p>appoint the petitioner under the compassionate scheme, as<\/p>\n<p>a teacher.\n<\/p>\n<p>      2.   Petitioner is the son of late Jubaira Beevi who<\/p>\n<p>died in harness on 12.5.2007 in a motor accident. She had<\/p>\n<p>been working as a Junior Arabic Teacher in Government<\/p>\n<p>T.T.I Manacaud in Thiruvananthapuram. As on the date of<\/p>\n<p>her death, she had put in a total service of 31 years 4<\/p>\n<p>months and 17 days.\n<\/p>\n<p>      3.   Apart from the petitioner, she had one daughter<\/p>\n<p>Shajina, another son Shameer and husband Abdul Salam<\/p>\n<p>as the legal heirs.          Petitioner had acquired the<\/p>\n<p>qualification in Islamic History from the University of<\/p>\n<p>Kerala and has also admitted to the Degree of Master of.<\/p>\n<p>Philosophy and Bachelor of Education. According to the<\/p>\n<p>petitioner, he was fully dependent of the deceased mother<\/p>\n<p>and therefore he is eligible under the scheme             for<\/p>\n<p>W.P ( C) No.30719 of 2009<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>compassionate appointment as provided in G.O (P)<\/p>\n<p>No.12\/99\/P&amp;ARD dated 24.5.1999.\n<\/p>\n<p>      4.     Ext.P6 is the application submitted by the<\/p>\n<p>petitioner. It is accompanied by various documents which<\/p>\n<p>have been prescribed in the above Government Order.<\/p>\n<p>      5.     The application submitted by the petitioner as<\/p>\n<p>per Ext.P6 is kept without passing any order so far. It is<\/p>\n<p>the case of the petitioner that respondent is keeping the<\/p>\n<p>application pending on the ground that the petitioner is<\/p>\n<p>married. It is submitted that the petitioner&#8217;s marriage is<\/p>\n<p>only after the death of his mother. Reliance is placed on<\/p>\n<p>the decisions of this Court in Rev.Mother Dephine Mary Vs.<\/p>\n<p>State of Kerala [2002 (1) KLT 137], St.Ignatius High School<\/p>\n<p>Vs. State of Kerala[2005 (3) KLT 1000] and the decision of<\/p>\n<p>the learned Single Judge in Ashkarali Vs. State of Kerala<\/p>\n<p>[2009 (1) KLT S.N 17) to contend for the position that the<\/p>\n<p>marriage will not deprive the claim for appointment under<\/p>\n<p>the compassionate scheme.\n<\/p>\n<p>      6.     It is for the respondent to take a decision in<\/p>\n<p>accordance with law and in accordance with the principles<\/p>\n<p>W.P ( C) No.30719 of 2009<br \/>\n<span class=\"hidden_text\">                               3<\/span><\/p>\n<p>laid down by this Court in the above decisions.<\/p>\n<p>      7.     Heard learned Government Pleader also. It    is<\/p>\n<p>submitted that final orders will be passed on Ext.P6, in<\/p>\n<p>accordance with law.\n<\/p>\n<p>        Hence there will be a direction to the respondent to<\/p>\n<p>take a decision on Ext.P6, in accordance with law, within a<\/p>\n<p>period of three months from the date of receipt of a copy of<\/p>\n<p>this judgment.
