L.B.DABHI, APP for Respondent(s) :\n1, \nNone for Respondent(s) :\n2, \n========================================= \n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE A.M.KAPADIA\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE BANKIM.N.MEHTA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 10\/02\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE A.M.KAPADIA)<\/p>\n<p>RULE.\n<\/p>\n<p>Mr.\n<\/p>\n<p>\tL.B.Dabhi, learned APP appears and waives service of notice of Rule<br \/>\n\ton behalf of the Respondent &#8211; State of Gujarat.\n<\/p>\n<p>Having<br \/>\n\tregard to the facts of the case, the application is taken up for<br \/>\n\thearing today.\n<\/p>\n<p>The<br \/>\n\tApplicant &#8211; convict, who vide judgment and order dated<br \/>\n\t20.5.2009 rendered in Sessions Case No. 41 of 2008 by the learned<br \/>\n\tAdditional Sessions Judge and Presiding Officer, Fast Track Court<br \/>\n\tNo.2, Chota Udepur, Vadodara, has been convicted<br \/>\n\tfor the offence punishable under Section 201 read wit Section 114 of<br \/>\n\tthe Indian Penal Code, and sentenced to suffer RI for 5 years, has<br \/>\n\tfiled this Application through jail authority, praying for<br \/>\n\tsuspension of sentence and to release him on regular bail during the<br \/>\n\tpendency and final hearing of the above numbered Criminal Appeal.<br \/>\n\tAlternatively, it is also prayed for expeditious hearing of the<br \/>\n\tabove numbered Criminal Appeal.\n<\/p>\n<p>We<br \/>\n\thave considered the submission advanced by Mr. L.B.Dabhi, learned<br \/>\n\tAPP for the Respondent &#8211; State of Gujarat and perused the<br \/>\n\taverments made in the Application so also the jail remark sheet<br \/>\n\tforwarded by the jail authority along with the Application as well<br \/>\n\tas the judgment and order of conviction and sentence recorded<br \/>\n\tagainst the Applicant for the offence under Section  201 read with<br \/>\n\tSection 114 of IPC.\n<\/p>\n<p>\tSo far as<br \/>\n\tthe prayer for suspension of sentence and to release the Applicant<br \/>\n\ton regular bail during the pendency and final hearing of the above<br \/>\n\tnumbered Criminal Appeal is concerned, according to us, no case is<br \/>\n\tmade out by the Applicant for suspension of sentence and to release<br \/>\n\thim on regular bail during the pendency and final hearing of the<br \/>\n\tabove numbered Criminal Appeal.\n<\/p>\n<p>\tSo far as<br \/>\n\tthe alternative prayer for expeditious hearing of the above numbered<br \/>\n\tCriminal Appeal is concerned, upon perusal of the record of the<br \/>\n\tcase, we have noticed that one co-accused named Chimanbhai, who has<br \/>\n\tbeen convicted for the offence punishable under Section 302 IPC and<br \/>\n\tsentenced to imprisonment for life, has also filed Criminal Appeal,<br \/>\n\twhich is pending for final disposal.
