PATTANAIK\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Leave granted.\n<\/p>\n<p>     We have heard learned counsel on both sides.<br \/>\n     This appeal  by special  leave arises from the judgment<br \/>\nof the\tlearned single\tjudge of  the High Court of Punjab &amp;<br \/>\nHaryana made on October 7, 1993 in RSA No, 896\/93.\n<\/p>\n<p>     The admitted  facts are  that the respondent had joined<br \/>\nmilitary service  after the  declaration of Indio-china War.<br \/>\nemergency was  declared on  October 26, 1962. The respondent<br \/>\njoined the  Army on  May 25,  1963. The Government of Punjab<br \/>\nexercising the\tpower under  proviso  the Article 309 of the<br \/>\nConstitution passed the Punjab Government National Emergency<br \/>\n(Concession) Rules, 1965 (for short, the &#8216;Rules&#8217;). The Rules<br \/>\nprovided for  benefit of  pay and seniority to ex-servicemen<br \/>\nre-employed in civil services. the respondent was discharged<br \/>\nfrom military service on September 24, 1973 and there after,<br \/>\nhe was appointed in January, 1979 as L.D.C. in ex-servicemen<br \/>\nquota. He  was granted\tthe benefit  of the  increments\t and<br \/>\nseniority  in\tterms  of  Rules  2  and  4  of\t the  Rules,<br \/>\nSubsequently, realising the mistake that he was not entitled<br \/>\nto two\t  increments  after  the  Indo-China  Emergency\t was<br \/>\nlifted, the  same was  recalled by  order  dated  21.4.1987.<br \/>\nAfter issuing  the notice,  they  withdraw  the\t benefit  on<br \/>\nFebruary 18,  1988. Calling in\tquestion, the said action of<br \/>\nthe appellants,\t the respondent\t filed a civil suit on April<br \/>\n27, 1988. It may be relevant, at this juncture, to note that<br \/>\nduring Indo-Bangla  War, the  Government  had  declared\t the<br \/>\nEmergency of  December 3, 1971 which was lifted on March 22,<br \/>\n1973. Consequently,  the respondent  has claimed the benefit<br \/>\nof seniority  and pay  for the\tperiod of  service  rendered<br \/>\nduring the  period of  second  Emergency.  The\ttrial  Court<br \/>\ndismissed the  suit but\t on appeal  the Additional  District<br \/>\nJudge allowed  the appeal  and decreed\tthe suit and granted<br \/>\nthe benefit of two increments. When second appeal was filed,<br \/>\nthe High  Court dismissed  the same.  Thus, this  appeal  by<br \/>\nspecial leave.\n<\/p>\n<p>     The contention  raised by\tthe learned  counsel for the<br \/>\nappellant  is  that  under  the\t Rules,\t the  personnel\t who<br \/>\nrendered the military service during Emergency of Indo-China<br \/>\nwas alone  is entitled to the benefit. Though the respondent<br \/>\ncontinued after\t the lifting  of  the  first  Emergency\t and<br \/>\nduring the  period of second Emergency, namely, Indo-Bangala<br \/>\nWar, the  period of  aid service  would not be counted under<br \/>\nthe Rules.  we find  force in the contention. This question,<br \/>\nin the\tfirst instance,\t was considered\t by  this  Court  in<br \/>\n<a href=\"\/doc\/1737293\/\">(Ex.Capt.) Randhir  Singh  Dhull  vs.  S.D.  Bhambri  &amp;\t Or.<\/a><br \/>\n[(1968) LAB.  IC  894]\twherein\t this  Court  extracted\t the<br \/>\ndefinition of the military service which reads as under:\n<\/p>\n<blockquote><p>     &#8220;Definition:  For\tthe  purpose  of<br \/>\n     these  rules,  expression\tmilitary<br \/>\n     service,\t means\t  enrolled    or<br \/>\n     commissioned service  in any of the<br \/>\n     three wings  of  the  Indian  Armed<br \/>\n     Force  (including\t services  as  a<br \/>\n     warrant  officer)\t rendered  by  a<br \/>\n     person   during   the   period   of<br \/>\n     operation of  the\tProclamation  of<br \/>\n     Emergency\tmade  by  the  President<br \/>\n     under   Article\t352    of    the<br \/>\n     Constitution on  the 26th\tOctober,<br \/>\n     1962, or  such other service as may<br \/>\n     hereafter ba  declared as\tmilitary<br \/>\n     service for  the purpose  of  these<br \/>\n     rules.  Any   period  of\tmilitary<br \/>\n     training\tfollowed   by\tmilitary<br \/>\n     service shall  also be  reckoned as<br \/>\n     military service.&#8221;<\/p><\/blockquote>\n<blockquote><p>     &#8220;4.   Increments,\t seniority   and<br \/>\n     pension, Period of military service<br \/>\n     shall   count    for    increments,<br \/>\n     seniority and pension as under:-\n<\/p><\/blockquote>\n<blockquote><p>     (i) Increment-  The period spent by<br \/>\n     a person on military service, after<br \/>\n     attaining\t  the\t  minimum    age<br \/>\n     prescribed for  appointment to  any<br \/>\n     service or\t post  to  which  he  is<br \/>\n     appointed,\t   shall    count    for<br \/>\n     increments. Where\tno such\t minimum<br \/>\n     as is  prescribed the  minimum  age<br \/>\n     shall be as laid down in rules 3.9,<br \/>\n     3.10 and  3.11 of\tthe Punjab Civil<br \/>\n     Services  Rules   Volume  II.  This<br \/>\n     concession\t  shall,   however,   be<br \/>\n     admissible\t   only\t    on\t   first<br \/>\n     appointment.&#8221;<\/p><\/blockquote>\n<p>     This Court\t had held  that the words emphasised clearly<br \/>\nshowed that  it is  only the  service  rendered\t during\t the<br \/>\nperiod of Emergency that would be taken into account and not<br \/>\nany other  period. No  doubt, there  is also  provision\t for<br \/>\nother service  being declared  as military  service, but  no<br \/>\norder of  the Government  making such  declaration has\tbeen<br \/>\nbrought to  out notice.\t Thus, it  could be  seen that\tthis<br \/>\nCourt has  settled that\t the military  service would  be the<br \/>\nservice rendered  during the first Emergency unless there is<br \/>\nany further  declaration under\tthe Rules given by the State<br \/>\ncovering the second Emergency.\tThe personnel who joined the<br \/>\nservice during the period to first Emergency is not entitled<br \/>\nto claim  the benefit  of the  period  of  service  rendered<br \/>\nduring the  second Emergency.  The learned  counsel for\t the<br \/>\nrespondent placed  reliance on\tthe Circular  Letter No. 325<br \/>\n(SII (3)  &#8211; 72 of 5866 dated February 24, 1972 and contended<br \/>\nthat the  Government of\t India in  paragraph 2\tthereof, has<br \/>\nissued\tthe   benefit  of  military  service  to  those\t who<br \/>\ncontinued under the first Emergency. The State Government is<br \/>\nparagraph 3,  have  also  extended  the\t same  benefit\tand,<br \/>\ntherefore,  the\t  respondent  is  entitled  to\tthe  benefit<br \/>\nthereof. We  find that there is not force in the contention.<br \/>\nPara 2\tthereof relates\t to the\t Central Government Servants<br \/>\nwho have joined the military service during second emergency<br \/>\nand continued  thereafter became  entitled to  the  benefit.<br \/>\nAdmittedly, the\t respondent  is\t not  a\t Central  Government<br \/>\nServant and,  therefore, para  2 thereof has no application.<br \/>\nPara 3\tin Government Service before he jointed the military<br \/>\nservice which reads as under:\n<\/p>\n<blockquote><p>     &#8221;\tThe   Punjab   Government   have<br \/>\n     decided that  the civil  Government<br \/>\n     employees who  are\/have been called<br \/>\n     for  military  service  during  the<br \/>\n     present Emergency shall be eligible<br \/>\n     to the  concessions enjoined in the<br \/>\n     Punjab\tGovernment\tNational<br \/>\n     Emergency (concessions) Rules, 1965<br \/>\n     read  with\t the  Demobilised  Armed<br \/>\n     Forces  Personnel\t(Reservation  of<br \/>\n     Vacancies\tin   the   punjab   Non-<br \/>\n     technical service) Rules, 1968.&#8221;<\/p><\/blockquote>\n<p>     A reading\tthereof clearly indicated that the candidate<br \/>\nmust be\t a government  servant having  been called  for\t the<br \/>\nmilitary  service   during  the\t  second   Emergency;\tsuch<br \/>\nGovernment servant  shall be  eligible\tto  the\t concessions<br \/>\nenjoined  in   the  Punjab   government\t National  Emergency<br \/>\n(Concessions) Rule,  1965 read\twith the  Demobilised  Armed<br \/>\nForces Personnel  (Reservation of  vacancies in\t the  Punjab<br \/>\nNon-Technical\tService)    Rules,   1968.    Under    these<br \/>\ncircumstances,\tthe   respondent  is  not  entitled  to\t two<br \/>\nincrement which were wrongly given and rightly withdrawn.\n<\/p>\n<p>     The appeal\t is accordingly\t allowed. The  orders of the<br \/>\nHigh court  and the  District Judges stand set aside and the<br \/>\nsuit of the respondent stand dismissed.
