M. SAHAI)<\/p>\n<p>We<\/a><br \/>\n\thave heard Mr. Dipen A. Desai, learned counsel for the petitioner<br \/>\n\tand Mr. N. J. Shah, learned Assistant Government Pleader appearing<br \/>\n\tfor respondent No.1.\n<\/p>\n<p>\tThe<br \/>\n\tpetitioners are residents of various villages situated near Palitana<br \/>\n\tTaluka of Bhavnagar District.  By means of this writ petition, the<br \/>\n\tpetitioners have challenged the notifications issued under Sections<br \/>\n\t3 &amp; 6 of the Gujarat Water &amp; Gas Pipelines (Acquisition of<br \/>\n\tRight of User in Land) Act, 2000 (Act No.5 of 2000) (hereinafter<br \/>\n\treferred to as &#8216;the Act&#8217;).\n<\/p>\n<p>\tUnder<br \/>\n\tthe provisions of Section 3 of the aforesaid Act, notification was<br \/>\n\tissued on 19.01.2011. Thereafter, objections were invited under<br \/>\n\tSection 4 of the Act.  The petitioners have filed their objections<br \/>\n\tand the objections have been decided by the Competent Authority on<br \/>\n\t15.04.2011 by a reasoned order.  A copy of the order has been<br \/>\n\tproduced as Annexure H to this petition. After deciding the<br \/>\n\tobjections of the petitioners, declaration under Section 6 of the<br \/>\n\tAct has been issued on 25.05.2011 and thereafter the work of laying<br \/>\n\tdown the water pipelines has been started as the water pipelines is<br \/>\n\tnecessary for Bhavnagar District as the earlier pipelines could not<br \/>\n\tsupply the water to the extent the water was required by Bhavnagar<br \/>\n\tcity.\n<\/p>\n<p>\tThe<br \/>\n\tgrievance of the learned counsel for the petitioners is that the<br \/>\n\tcrops of the petitioners are standing in their fields and if the<br \/>\n\tpipelines are laid, then their crops will be damaged and the<br \/>\n\tpetitioners would suffer loss as their standing crops would be<br \/>\n\tdestroyed to some extent.\n<\/p>\n<p>The<br \/>\n\tprovisions of the Act takes care of the loss which may be suffered<br \/>\n\tto<br \/>\n\tthe persons aggrieved while<br \/>\n\tlaying down the pipelines and provides for grant of compensation.<br \/>\n\tIf the petitioners suffer loss, they would be suitably compensated<br \/>\n\tunder the provisions of the Act.  Laying down of water pipelines is<br \/>\n\tin larger public interest and we are not inclined to interfere in<br \/>\n\tthe matter.
