By consent, Rule is fixed forthwith.\n<\/p>\n<p>The<br \/>\n\tapplicant &#8211; accused, who has been arrested in I.CR. No. 87 of<br \/>\n\t2009 registered with Waghodia Police Station for the offences<br \/>\n\tpunishable under Sections 363, 366 &amp; 376 of the Indian Penal<br \/>\n\tCode  has moved this Court under Section 439 of the Code of Criminal<br \/>\n\tProcedure for seeking bail pending trial.\n<\/p>\n<p>The<br \/>\n\taccused moved the application being Criminal Misc. Application No.<br \/>\n\t252 of 2010 before the concerned Sessions Court, which came to be<br \/>\n\trejected on 5.3.2010.\n<\/p>\n<p>This<br \/>\n\tCourt has taken into consideration the documents produced on record<br \/>\n\tand the reasoning assigned by the Sessions Court while rejecting the<br \/>\n\tbail application of the applicant. The applicant deserves to be<br \/>\n\tenlarged on bail for the following reasons:\n<\/p>\n<p>\tLooking<br \/>\n\tto the conduct of victim and role of the  applicant accused as well<br \/>\n\tas age of the victim  girl, who is said to have been aged about 16\u00bd<br \/>\n\tof years i.e. having the age of using her discretion, has persuaded<br \/>\n\tthis Court to exercise discretion in favour of the accused applicant<br \/>\n\thereinabove for enlarging him on bail on appropriate terms and<br \/>\n\tconditions.\n<\/p>\n<p>Looking<br \/>\n\tto the averments and nature of evidence and role of the applicant,<br \/>\n\the deserves to be enlarged on bail pending trial.\n<\/p>\n<p>The<br \/>\n\tchargesheet is filed and investigation is over and therefore, there<br \/>\n\tis remote possibility of applicant being influenced the witnesses or<br \/>\n\ttampered with the evidences.\n<\/p>\n<p>The<br \/>\n\tapplicant has his wherewithal at his ordinary place of residence and<br \/>\n\ttherefore, his presence could be procured by imposing appropriate<br \/>\n\tconditions during trial.\n<\/p>\n<p>The<br \/>\n\tprosecution has not voiced any grievance or expressed any<br \/>\n\tapprehension that he is likely to flee from justice, if he is<br \/>\n\treleased on bail.\n<\/p>\n<p>The<br \/>\n\tprosecution has also not expressed any grievance or apprehension<br \/>\n\tthat he is capable of tempering with evidences or influencing the<br \/>\n\twitnesses, if he is released on bail.\n<\/p>\n<p>The<br \/>\n\tSessions Court has not appreciated these aspect and therefore, the<br \/>\n\tsaid order deserves to be quashed and set aside and accordingly, it<br \/>\n\tis quashed and set aside.\n<\/p>\n<p>The<br \/>\n\taforesaid observations are made only for the purpose of examining<br \/>\n\tthe prayer for bail pending trial. These observations are<br \/>\n\tprima-facie and shall have no bearing whatsoever upon the trial and<br \/>\n\tthe trial Court shall not be influenced by it in any way and come to<br \/>\n\tits own conclusion after analyzing the evidence that may be led<br \/>\n\tduring the trial.\n<\/p>\n<p>Considering<br \/>\n\tthe submissions made on behalf of the parties and having regard to<br \/>\n\tthe circumstances and facts of the case, the application is allowed<br \/>\n\tand the applicant is ordered to be released on bail in connection<br \/>\n\twith Crime Register No.I-87 of 2009 registered with Waghodia Police<br \/>\n\tStation on his executing a bond of Rs.5,000=00\/- (Rupees Five<br \/>\n\tThousand only) with one surety of the like amount to the<br \/>\n\tsatisfaction of the lower Court and subject to the conditions that<br \/>\n\the shall :\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of his liberty or misuse his liberty:\n<\/p>\n<p>(b)\tnot<br \/>\nact in a manner injurious to the interest of the prosecution:\n<\/p>\n<p>(c)\tmaintain<br \/>\nlaw and order;\n<\/p>\n<p>(d)\tnot<br \/>\nleave the State of Gujarat without the prior permission of the<br \/>\nSessions Court concerned;\n<\/p>\n<p>(e)\tfurnish<br \/>\nthe address of his residence at the time of execution of the bond and<br \/>\nshall not change the residence without prior permission of this<br \/>\nCourt;\n<\/p>\n<p>(f)<br \/>\nmark his presence before concerned Police Station on every 15th<br \/>\nday of each  English Calendar month initially for a period of 6<br \/>\nmonths between 9.00 a.m. to 2.00 p.m.<\/p>\n<p>(g)\tsurrender<br \/>\nhis passport, if any, to the lower Court within a week.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the Sessions<br \/>\n\tJudge concerned will be free to issue warrant or to take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbefore the lower Court having jurisdiction to try the case.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute.
