PRAKASH TATIA, J.\n<\/pre>\n<p>Mr.OP Joshi,for the appellants.\n<\/p>\n<p>     Heard learned counsel for the appellants.<\/p>\n<p>     The appellants are aggrieved against the order dated<\/p>\n<p>3.11.2008 by which the appellants&#8217; application for grant of<\/p>\n<p>temporary injunction was rejected and the application of the<\/p>\n<p>defendant filed   alongwith counter         claim was allowed.<\/p>\n<p>However, the trial court directed both the parties to<\/p>\n<p>maintain the status quo and restrained from alienating the<\/p>\n<p>property in dispute.\n<\/p>\n<p>     According to learned counsel for the           appellants, the<\/p>\n<p>appellants are in possession of the part of the property and<\/p>\n<p>they are having title by virtue of the Will dated 21st August,<\/p>\n<p>1950. The appellants placed on record the documentary<\/p>\n<p>evidence to show that they are owner and in possession of<\/p>\n<p>the property. The defendant set up a gift deed dated 28th<\/p>\n<p>Nov., 2005, but that is of no use as well as the appellants&#8217;<br \/>\n                                                      SBCMA No.1628\/2008<br \/>\n                     Mahaveer Prasad &amp; Ors. Shri Aadi Gaur Vipra Samaj<\/p>\n<p>                                   -[ 2 ]-\n<\/p>\n<p>title is concerned, it is also submitted that the predecessor<\/p>\n<p>of the alleged donor himself transfered title in favour of the<\/p>\n<p>appellant by Will.     It is also submitted that the trial court<\/p>\n<p>has not decided the issue of prima facie case, balance of<\/p>\n<p>convenience and irreparable injury in detail though framed<\/p>\n<p>issue.    It is also submitted that in the counter claim the<\/p>\n<p>defendants themselves admitted possession of the appellant<\/p>\n<p>over the part of the property though under different<\/p>\n<p>capacity.\n<\/p>\n<p>        I considered the submission of learned counsel for the<\/p>\n<p>appellants and perused the facts mentioned in the counter<\/p>\n<p>claim.\n<\/p>\n<p>        The   apprehension         of        appellant        that   there   is<\/p>\n<p>observation of the trial court in the impugned order may be<\/p>\n<p>observation     on   merit    is     concerned,          it    has   no   legal<\/p>\n<p>foundation because of the reason that any observation<\/p>\n<p>made in the impugned order with respect the question of<\/p>\n<p>fact is only a prima facie finding of the court below which is<\/p>\n<p>required to be recorded while deciding the injunction<\/p>\n<p>application and it has nothing to do with the merit of the<\/p>\n<p>suit.    Therefore, appellants&#8217; rights in proving their title of<br \/>\n                                                    SBCMA No.1628\/2008<br \/>\n                   Mahaveer Prasad &amp; Ors. Vs. Shri Aadi Gaur Vipra Samaj<\/p>\n<p>                               -[ 3 ]-\n<\/p>\n<p>the property or the Will remain unaffected.<\/p>\n<p>     So far as possession is concerned , for that if the<\/p>\n<p>defendants have admitted possession of the appellant over<\/p>\n<p>the property in dispute that fact has not been rejected by<\/p>\n<p>the trial court in impugned order and, therefore, directing<\/p>\n<p>both the parties to maintain the status quo with respect to<\/p>\n<p>the property in dispute and not to alienate it in the facts<\/p>\n<p>and circumstances of the case is just and reasonable order,<\/p>\n<p>which could have been passed.\n<\/p>\n<p>     Once the order can be justified with the help of other<\/p>\n<p>grounds, it need not to be set aside merely because of the<\/p>\n<p>fact that it is not elaborate and detailed order.<\/p>\n<p>     In view of the above, I do not find any reason to<\/p>\n<p>interfere in the impugned order.
