The<br \/>\n\tpetitioner, thereafter, filed claim petition i.e. Workmen<br \/>\n\tCompensation Application No.3 of 1982 in the Court of learned Civil<br \/>\n\tJudge (S.D.) Surat which was transferred to Labour Court, Godhra<br \/>\n\twhere it was renumbered as Workmen Compensation Claim Application<br \/>\n\tNo.27 of 1996. In the said application, the learned Labour Court has<br \/>\n\tpassed an award for Rs.83,192\/- alongwith interest and amount of<br \/>\n\tpenalty of Rs.41,596\/- and directed the respondent &#8211; Insurance<br \/>\n\tCompany to make the aforesaid payment to the petitioner within a<br \/>\n\tperiod of 30 days from the date of knowledge of the said order.<br \/>\n\tAccordingly, the respondent deposited total amount of Rs.2,36,616\/-<br \/>\n\tin the Labour Court, Godhra.\n<\/p>\n<p>\tThe petitioners,<br \/>\n\tthereafter, moved an application being Distribution Application No.7<br \/>\n\tof 2010 in the Labour Court, Godhra requesting the Labour Court to<br \/>\n\tallow the petitioner to withdraw the amount. However, the Labour<br \/>\n\tCourt, Godhra by order dated 12.4.2010 allowed each of the<br \/>\n\tpetitioners to withdraw only 15% amount out of the said amount and<br \/>\n\tremaining 85% amount was ordered to be deposited in fixed deposit<br \/>\n\twith nationalized bank.\n<\/p>\n<p>\tIt is this order which is<br \/>\n\tunder challenge in the present petition.\n<\/p>\n<p>\tMr.Z.M.Shaikh, learned<br \/>\n\tadvocate appearing for Mr.S.K.Bukhari, for the petitioners submitted<br \/>\n\tthat the petitioner Nos.1, 6 and 7 are very aged 80 to 84 years and<br \/>\n\thence the amount awarded by the Labour Court should be disbursed<br \/>\n\tfully in favour of the petitioners.\n<\/p>\n<p>\tIn support of this<br \/>\n\tsubmission he relied on the decision of the Apex Court in the case<br \/>\n\tof  H.S.Ahammed Hussain and Anr. Vs. Irfan Ahammed and Anr,<br \/>\n\treported in (2002) 6 SCC 52,<br \/>\n\twherein the Apex Court held that in the facts and circumstances of<br \/>\n\tthe present case, the amount of compensation awarded in favour of<br \/>\n\tthe mothers should not be kept in fixed deposit in a nationalized<br \/>\n\tbank. In case the amounts have not been already invested, the same<br \/>\n\tshall be paid to the mothers, but if, however, invested by<br \/>\n\tdepositing the same in fixed deposit in a nationalized bank, there<br \/>\n\tmay be its premature withdrawal in case the parties so intend. Based<br \/>\n\ton this judgment the learned advocate for the petitioners submitted<br \/>\n\tthat in case of petitioner Nos.1, 6 and 7 the amount should be<br \/>\n\tdisbursed in full.\n<\/p>\n<p>\tHaving<br \/>\n\theard the learned counsel appearing for the petitioners and having<br \/>\n\tgone through the award passed by the Labour Court on the<br \/>\n\tDistribution<br \/>\n\tApplication, the Court is of the view<br \/>\n\tthat the Labour Court has considered all the aspects and passed an<br \/>\n\torder of withdrawal of 15% of the amount awarded and balance amount<br \/>\n\twas ordered to be kept in fixed deposit. It is in the interest of<br \/>\n\tthe petitioners as, if the amount is disbursed the same would be<br \/>\n\tspent and no useful purpose would be served. On the contrary, if<br \/>\n\tthere is  some occasion when the amount is required the petitioner<br \/>\n\tcan certainly make an application to that effect before the Labour<br \/>\n\tCourt and at that point of time further disbursement would be<br \/>\n\tconsidered. The judgment relied upon by the petitioners is on the<br \/>\n\tfacts of that case and it is not applicable to the present case. In<br \/>\n\tthis view of the matter, the Court does not see any infirmity in the<br \/>\n\torder passed by the Labour Court. However, it is made clear that in<br \/>\n\tfuture if some contingency arises and the amount is required it is<br \/>\n\topen for the petitioners to move an appropriate application<br \/>\n\tbefore the Labour Court for disbursement of the<br \/>\n\tamount. If such an application is moved the same shall be considered<br \/>\n\ton merits. It is also open for the petitioners to request Labour<br \/>\n\tCourt to permit the petitioners to withdraw interest that may accrue<br \/>\n\ton the amount invested.\n<\/p>\n<p>\t With these directions<br \/>\n\tthis petition is accordingly disposed off.\n<\/p>\n<p>\t                              (K.\n<\/p>\n<p>\tA.
