Radha Swami, son of Late Nandlal Singh.\n                       (All residents of Mohalla-Station Road, P.S.-Begusarai,\n                       District- Begusarai)\n                                             -----------\n<\/pre>\n<p>5.   26.08.2011             The informant-petitioner has preferred this revision<br \/>\n                    application against the order dated 14.01.2009 passed by<br \/>\n                    the learned Chief Judicial Magistrate, Begusarai in<br \/>\n                    Begusarai Mufassil P.S.Case No.324\/07 by which the<br \/>\n                    prayer of the petitioner for taking cognizance against the<br \/>\n                    accused opposite party nos. 2 to 11 has been rejected.\n<\/p>\n<p>                          The prosecution case, in brief, is that ten named<br \/>\n                    accused persons (Opposite Party Nos.2 to 11) came to the<br \/>\n                    house of the father-in-law of the petitioner and by using<br \/>\n                    abusive language asked whereabout of Mohan Rai at<br \/>\n                    which it was said that he was not at his house. The action<br \/>\n                    of the accused was protested by the family members of the<br \/>\n                    father-in-law of the informant-petitioner. Thereafter,<br \/>\n                    Sohan Rai was forcibly taken by the accused in place of<br \/>\n                    Mohan Rai. It has been further alleged that the accused<br \/>\n<span class=\"hidden_text\">                    2<\/span><\/p>\n<p>locked the family members of the informant in a room and<br \/>\nfled away taking Sohan Rai in the vehicle. On the<br \/>\nstatement of the informant-petitioner, Begusarai Sadar<br \/>\nMufassil P.S. Case No.324\/07 was lodged for the offence<br \/>\npunishable under Sections 447, 342 and 364\/34 of the<br \/>\nI.P.C. Subsequently, Section 302 of the I.P.C. was added<br \/>\nagainst the accused. After investigation, charge-sheet was<br \/>\nsubmitted against the accused Rahul Rai vide charge-sheet<br \/>\nno.285\/08. The case against the accused opposite party<br \/>\nnos. 2 to 11 was found not true and the investigation<br \/>\nagainst the other accused was kept pending. The learned<br \/>\nChief Judicial Magistrate took cognizance against the<br \/>\naccused Rahul Rai and the case was transferred to the<br \/>\ncourt of other Judicial Magistrate for commitment and the<br \/>\noffice was directed to split up the record since the<br \/>\ninvestigation against the co-accused was pending. A<br \/>\npetition was filed on behalf of the petitioner in the court of<br \/>\nlearned C.J.M. for taking cognizance against the accused<br \/>\n(opposite party nos. 2 to 11), which has been rejected by<br \/>\nthe learned C.J.M after hearing learned counsel for both<br \/>\nthe parties. Thereafter, the petitioner has filed this<br \/>\napplication against the impugned order dated 14.01.2009.\n<\/p>\n<p>      Heard learned counsel for the petitioner, learned<br \/>\ncounsel for the State and the learned counsel for opposite<br \/>\nparty no.10. The opposite party nos. 2 to 9 and 11 have not<br \/>\nappeared even after service of notice.\n<\/p>\n<p>      The main contention of the learned counsel for the<br \/>\npetitioner is that there is sufficient material in the case<br \/>\ndiary to show that the accused opposite parties have<br \/>\n<span class=\"hidden_text\">                    3<\/span><\/p>\n<p>committed the offence. The learned C.J.M has also found<br \/>\nthat there is material against the accused to have<br \/>\ncommitted offence, but he discarded their evidence as<br \/>\nthere is no eye witness of the alleged occurrence other than<br \/>\nthe relatives of the deceased.\n<\/p>\n<p>      The learned counsel for opposite party no.10<br \/>\nsubmits that cognizance of the offence has already been<br \/>\ntaken by the learned C.J.M and the order has been passed<br \/>\nfor issuance of notice against the sole accused Rahul Rai.<br \/>\nHe has further submitted that the learned C.J.M. has<br \/>\nrightly rejected the petition dated 16.09.2008 filed by the<br \/>\npetitioner for taking cognizance also against the accused<br \/>\nopposite parties. The learned Magistrate has taken the<br \/>\ncognizance against the Rahul Rai and thereafter, he was<br \/>\nnot competent to take cognizance against the other accused<br \/>\nas he has no power to review his own order. He has further<br \/>\nsubmitted that now the accused can only be summoned<br \/>\nunder Section 319 of the Cr.P.C.\n<\/p>\n<p>      After hearing the learned counsel for both the<br \/>\nparties and on perusal of the carbon copy of the case diary,<br \/>\nit appears that after investigation, charge-sheet was<br \/>\nsubmitted against the sole accused Rahul Rai. The case<br \/>\nagainst the accused opposite parties has been found not<br \/>\ntrue and the investigation against the other accused was<br \/>\npending. It further appears that the learned C.J.M has<br \/>\ntaken cognizance for the offence punishable under<br \/>\nSections 364, 302, 201 and 120B of the I.P.C. He has<br \/>\nfound a prima facie case against the sole accused Rahul<br \/>\nRai. It further appears that the petitioner has filed a<br \/>\n<span class=\"hidden_text\">                                  4<\/span><\/p>\n<p>              petition dated 16.09.2008 before the learned C.J.M. It<br \/>\n              further appears from the carbon copy of the case diary that<br \/>\n              there is material against the accused opposite parties to<br \/>\n              show that they are also involved in the alleged occurrence.<br \/>\n              The learned C.J.M. has also found that there is material<br \/>\n              against the accused opposite parties, but he has not taken<br \/>\n              cognizance against them as there is no eye witness of the<br \/>\n              alleged occurrence other than the relatives of the deceased.<br \/>\n              At the stage of taking cognizance, only a prima facie case<br \/>\n              is required to be found. It is not required to find out as to<br \/>\n              whether the evidence would lead to conviction of the<br \/>\n              accused or not. It is also settled principle of law that the<br \/>\n              Magistrate can take cognizance of the offence on police<br \/>\n              report itself against the accused not named in the final<br \/>\n              report. The Magistrate is not required to wait till the stage<br \/>\n              of Section 319 Cr.P.C. for taking cognizance against the<br \/>\n              accused not named as accused in charge-sheet. Reliance<br \/>\n              may be placed on a decision in the case of Uma Shankar<br \/>\n              Singh Versus State of Bihar and anr. reported in 2010<br \/>\n              AIR SCW 5868.\n<\/p>\n<p>                    Considering the facts and circumstances stated<br \/>\n              above, in my opinion, the impugned order is not fit to be<br \/>\n              sustained. The impugned order is set aside. The matter is<br \/>\n              remanded back to the learned Chief Judicial Magistrate,<br \/>\n              Begusarai for considering the case in accordance with law.\n<\/p>\n<p>                    In the result, this revision application is allowed.\n<\/p>\n<pre>V.K.
