SHAH\n\t\t\n\t\n\n \n\nDate\n: 25\/11\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\tPresent<br \/>\nCriminal Miscellaneous Application under section 482 of the Code of<br \/>\nCriminal Procedure has been preferred by the applicant &#8211;<br \/>\noriginal accused No.3 &#8211; Bhaveshbhai Nareshchandra Amin to quash<br \/>\nand set aside the Criminal Inquiry Case No.153\/2010 pending before<br \/>\nthe Court of learned Metropolitan Magistrate, Ahmedabad as well as<br \/>\ncomplaint\/FIR being M. Case No.2\/2010 registered with DCB, Ahmedabad<br \/>\nCity.\n<\/p>\n<p>2.\tToday,<br \/>\nwhen the application is taken up for hearing, Shri Viral Shah,<br \/>\nlearned advocate appearing on behalf of the applicant has produced on<br \/>\nrecord one additional affidavit affirmed by the applicant and relying<br \/>\nupon some documents\/report and upon telephonic instruction from Shri<br \/>\nTattvam K. Patel, learned advocate appearing on behalf of the<br \/>\napplicant, he seeks permission to withdraw the present application<br \/>\nunconditionally.\n<\/p>\n<p>3.\tWithout<br \/>\nexpressing any opinion on the merits of the case and\/or even the<br \/>\nreport of the concerned investigating officer and without accepting<br \/>\nthe same, applicant is simply permitted to withdraw the present<br \/>\nCriminal Miscellaneous Application.  However, it is observed that if<br \/>\nany report is submitted by the investigating officer before the<br \/>\nconcerned Magistrate, in that case, it is ultimately for the<br \/>\nconcerned Magistrate to consider the same in accordance with law and<br \/>\non merits and to consider whether the said report is to be accepted<br \/>\nor not and even before accepting such report, opportunity is to be<br \/>\ngiven to the complainant to lodge its objections against the said<br \/>\nreport and the learned Magistrate is bound to consider the same in<br \/>\naccordance with law and on merits.\n<\/p>\n<p>4.\tWith<br \/>\nthis, present application is dismissed as withdrawn.  Notice<br \/>\ndischarged.
