2.      We \u00a0 heard \u00a0 this \u00a0 case \u00a0 through \u00a0 video \u00a0 conferencing. \u00a0 The \u00a0 Appellant \u00a0 was\u00a0<\/p>\n
present\u00a0in\u00a0the\u00a0Bangalore\u00a0studio\u00a0of\u00a0the\u00a0NIC\u00a0while\u00a0the\u00a0Respondents\u00a0were\u00a0present\u00a0<\/p>\n
in\u00a0the\u00a0Mumbai\u00a0studio.\u00a0We\u00a0heard\u00a0their\u00a0submissions.<\/p>\n
3.      It\u00a0appears\u00a0the\u00a0Appellant\u00a0had,\u00a0in\u00a0two\u00a0separate\u00a0RTI\u00a0applications,\u00a0wanted\u00a0to\u00a0<\/p>\n
know\u00a0from\u00a0the\u00a0RBI\u00a0about\u00a0the\u00a0alleged\u00a0purchase\u00a0of\u00a0land\u00a0by\u00a0a\u00a0non\u00adresident\u00a0Indian\u00a0<\/p>\n
from\u00a0 an\u00a0 Indian\u00a0 citizen\u00a0 for\u00a0 a \u00a0 highly\u00a0 depressed\u00a0 consideration.\u00a0 The\u00a0 CPIO\u00a0 had\u00a0<\/p>\n
informed\u00a0him\u00a0that\u00a0the\u00a0RBI\u00a0had\u00a0given\u00a0no\u00a0permission\u00a0to\u00a0that\u00a0non\u00adresident\u00a0Indian\u00a0<\/p>\n

\n for\u00a0any\u00a0such\u00a0purchase\u00a0and\u00a0that,\u00a0in\u00a0case\u00a0any\u00a0violation\u00a0of\u00a0the\u00a0FEMA\u00a0provisions\u00a0<\/p>\n
had\u00a0taken\u00a0place,\u00a0the\u00a0Directorate\u00a0of\u00a0Enforcement\u00a0would\u00a0be\u00a0the\u00a0authority\u00a0to\u00a0look\u00a0<\/p>\n
into\u00a0the\u00a0matter\u00a0and\u00a0take\u00a0any\u00a0further\u00a0action.\n<\/p>\n<\/p>\n
4.      During \u00a0 the \u00a0 hearing, \u00a0 the \u00a0 Appellant \u00a0 admitted \u00a0 to \u00a0 have \u00a0 received \u00a0 these\u00a0<\/p>\n
replies\u00a0from\u00a0the\u00a0CPIO.\u00a0However,\u00a0he\u00a0had\u00a0certain\u00a0doubts\u00a0about\u00a0the\u00a0position\u00a0taken\u00a0<\/p>\n
by \u00a0 the \u00a0 RBI \u00a0 in \u00a0 the \u00a0 matter \u00a0 since \u00a0 he \u00a0 thought \u00a0 that \u00a0 it \u00a0 was\u00a0 the \u00a0 RBI \u00a0 which \u00a0 was\u00a0<\/p>\n
competent\u00a0to\u00a0impose\u00a0penalty\u00a0in\u00a0cases\u00a0of\u00a0violation\u00a0of\u00a0the\u00a0FEMA\u00a0provisions.\u00a0The\u00a0<\/p>\n
Respondents\u00a0clarified\u00a0that\u00a0the\u00a0RBI\u00a0had\u00a0only\u00a0power\u00a0to\u00a0compound\u00a0such\u00a0violations\u00a0<\/p>\n
only \u00a0 when \u00a0 the \u00a0 contravener \u00a0 approached \u00a0 them; \u00a0 otherwise, \u00a0 it \u00a0 was \u00a0 only \u00a0 the\u00a0<\/p>\n
Directorate \u00a0 of \u00a0 Enforcement \u00a0 which \u00a0 alone \u00a0 had \u00a0 the \u00a0 power \u00a0 to \u00a0 adjudicate \u00a0 on\u00a0<\/p>\n
violations\u00a0of\u00a0such\u00a0provisions\u00a0and\u00a0to\u00a0impose\u00a0any\u00a0penalty.<\/p>\n
5.      It\u00a0is\u00a0quite\u00a0clear\u00a0that\u00a0the\u00a0RBI\u00a0has\u00a0already\u00a0provided\u00a0whatever\u00a0information\u00a0it\u00a0<\/p>\n
could\u00a0on\u00a0the\u00a0subject.\u00a0The\u00a0Appellant\u00a0appears\u00a0to\u00a0be\u00a0dissatisfied\u00a0over\u00a0the\u00a0fact\u00a0that\u00a0<\/p>\n
no\u00a0action\u00a0has\u00a0been\u00a0taken\u00a0by\u00a0the\u00a0competent\u00a0authorities\u00a0against\u00a0the\u00a0non\u00adresident\u00a0<\/p>\n
Indian\u00a0who\u00a0had\u00a0purchased\u00a0the\u00a0land\u00a0from\u00a0an\u00a0Indian\u00a0citizen\u00a0at\u00a0highly\u00a0reduced\u00a0<\/p>\n
rates.\u00a0 Unfortunately,\u00a0the\u00a0 CIC\u00a0cannot\u00a0 help\u00a0in\u00a0this.\u00a0 The\u00a0Appellant\u00a0may\u00a0like\u00a0to\u00a0<\/p>\n
approach\u00a0the\u00a0Directorate\u00a0of\u00a0Enforcement\u00a0or\u00a0any\u00a0other\u00a0competent\u00a0authority\u00a0to\u00a0<\/p>\n
redress\u00a0his\u00a0grievance\u00a0and\u00a0to\u00a0look\u00a0into\u00a0his\u00a0complaint.\u00a0There\u00a0is\u00a0nothing\u00a0more\u00a0for\u00a0<\/p>\n
the\u00a0RBI\u00a0to\u00a0provide\u00a0him\u00a0by\u00a0way\u00a0of\u00a0information.\n<\/p>\n<\/p>\n
6.      The\u00a0appeal\u00a0is\u00a0disposed\u00a0off\u00a0accordingly.\n<\/p>\n
7.      Copies\u00a0of\u00a0this\u00a0order\u00a0be\u00a0given\u00a0free\u00a0of\u00a0cost\u00a0to\u00a0the\u00a0parties.<\/p>\n
