HASSANPUR, DISTT.- SAMASTIPUR\n                                      -----------\n<\/pre>\n<p>2.   27.8.2010                Heard learned counsel for the petitioner and<\/p>\n<p>                 the State.\n<\/p>\n<p>                              The   petitioner   assails   the    order   of   the<\/p>\n<p>                 Divisional Commissioner, Darbhanga in Case No. 8 of<\/p>\n<p>                 2009-10 dated 8.12.2009.\n<\/p>\n<p>                              Learned counsel for the petitioner submits that<\/p>\n<p>                 there was no compulsion or requirement under the<\/p>\n<p>                 regulations dated 13.6.1998 that a candidate appointed<\/p>\n<p>                 as an Aganwari Sewika herself was required to be from<\/p>\n<p>                 below the poverty line.\n<\/p>\n<p>                              The   impugned       order    holds     that     the<\/p>\n<p>                 appointment related to the year 2003, when the circular<\/p>\n<p>                 dated 13.6.1998 was in vogue. According to it one of the<\/p>\n<p>                 requirements was that an Anganwari Sewika must belong<\/p>\n<p>                 to the beneficiary group of the centre.<\/p>\n<p>                              Clause-1     of    the   circular   provides     for<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>           identification of villages and location where people below<\/p>\n<p>           the poverty line extremely poor and weak reside and<\/p>\n<p>           whose upliftment was necessary.          Clause-2 provides for<\/p>\n<p>           identification   in    such   villages    and    location    for<\/p>\n<p>           establishment of Anganwari Kendra for persons below the<\/p>\n<p>           poverty line.    Clause-5 (6) specifically provides that the<\/p>\n<p>           Aganwari Sewika at a centre shall be from amongst the<\/p>\n<p>           beneficiaries. A harmonious reading of Clause 1, 2 and<\/p>\n<p>           5(6) leads this Court to hold that first an identification has<\/p>\n<p>           to be done of persons residing below the poverty line in a<\/p>\n<p>           villages or location whose upliftment is necessary, the<\/p>\n<p>           Aganwari Sewika is then to be appointed from amongst<\/p>\n<p>           them. The purpose is salutary, the feelings and desire for<\/p>\n<p>           upliftment which shall be prevalent in a person similarly<\/p>\n<p>           situated will motivate a person from one amongst them of<\/p>\n<p>           the same category shall be entirely different from another<\/p>\n<p>           but may not have the same feelings\/suffering the same<\/p>\n<p>           travails as a person below the poverty line.<\/p>\n<p>                       There is no merit in this application.          It is<\/p>\n<p>           accordingly dismissed.\n<\/p>\n<\/p>\n<pre>P.
