No. 926 of 2008\n\n                * * * * * * * * * * * * * * * * * *\n\n                     Dated: 20-10-2008\n\n\n                          JUDGMENT\n<\/pre>\n<p>     The plaintiff in O.S. No. 243 of 2000 on the file of the<\/p>\n<p>Munsiff&#8217;a , Kozhikode is the appellant in this           Second<\/p>\n<p>Appeal. The said suit as originally instituted,       was one for<\/p>\n<p>perpetual injunction        against trespass.            It was<\/p>\n<p>subsequently amended seeking a further relief to the effect<\/p>\n<p>that the purchase certificate obtained by the defendants as<\/p>\n<p>in O.A. 796 of 1998 was null and void.\n<\/p>\n<p>     2.   As per the judgments and decrees passed<\/p>\n<p>concurrently by the courts below, the following factual<\/p>\n<p>findings have been recorded:-\n<\/p>\n<p>     From Ext.B1 jenm assignment deed dated 2-9-1904 it<\/p>\n<p>can be discerned that there is a complete dedication of the<\/p>\n<p>properties in favour of the Nellikkavu Bhagavathy Temple.<\/p>\n<p>The temple tank was constructed and has been used by the<\/p>\n<p>temple for the last several decades . Besides, a vedippura<\/p>\n<p>has also been in existence for several years and that was<\/p>\n<p>also being possessed and used by the            temple committee.<\/p>\n<p>From 1969 onwards the Devaswom committee has been in<\/p>\n<p>existence and the said committee has been in management<\/p>\n<p><span class=\"hidden_text\">R.S.A. No. 926 of 2008          -:2:-<\/span><\/p>\n<p>of the affairs in the said temple. It was the committee<\/p>\n<p>which was paying the land revenue for the entire properties<\/p>\n<p>including the plaint schedule property. The evidence does<\/p>\n<p>not show that the plaintiff or any of the erstwhile thavazhi<\/p>\n<p>members had ever been in possession of the property for<\/p>\n<p>several years.        Except the self serving assertion by the<\/p>\n<p>plaintiff, no evidence of possession was adduced by the<\/p>\n<p>plaintiff. No member of the plaintiff&#8217;s thavazhi was also<\/p>\n<p>examined to substantiate the plea of possession.<\/p>\n<p>       3.    Under the above circumstances, the courts below<\/p>\n<p>held that the plaintiff could not claim exclusive possession<\/p>\n<p>of the plaint schedule property so as to injunct the<\/p>\n<p>defendants from managing the affairs of the temple and its<\/p>\n<p>properties. The said findings are pure findings of fact. No<\/p>\n<p>question of law, much less, any substantial question of law<\/p>\n<p>arises for consideration in this Second Appeal which is<\/p>\n<p>accordingly dismissed in limine.\n<\/p>\n<p>       Dated this the 21st day of October 2008.\n<\/p>\n<\/p>\n<p>                                           V.
