Kheda, for the offence punishable under Sections 392 and 114 of<br \/>\nthe Indian Penal Code.\n<\/p>\n<p>3.\tLearned<br \/>\nadvocate Mr. Majamudar appearing on behalf of the applicant submitted<br \/>\nthat the applicant is an innocent person and he has been wrongly<br \/>\nimplicated in the offence. The applicant was produced before the<br \/>\nCourt in connection with complaint being C.R. No.146\/11 and he was<br \/>\ncharge-sheeted. He also submitted that nothing is recovered from the<br \/>\napplicant and TI parade is not carried out. Prima facie, it appears<br \/>\nthat there is no involvement of the applicant. Therefore, the<br \/>\napplicant may kindly be released on bail by imposing suitable<br \/>\nconditions.\n<\/p>\n<p>4.\tLearned<br \/>\nAPP Mr. Pandya strongly opposed the application of the applicant and<br \/>\nstated that the applicant is involved in serious offence. He also<br \/>\nstated that discretion may not be exercised in favour of the<br \/>\napplicant considering the seriousness of offence.\n<\/p>\n<p>5.\tHaving<br \/>\nconsidered the rival submissions and on perusal of the role<br \/>\nattributed to the applicant as reflected in the FIR, police papers,<br \/>\nprovisions of Sections 392 and 114 of the Indian Penal Code, quantum<br \/>\nof punishment and the fact that nothing is recovered from the<br \/>\napplicant and TI parade is not carried out, I am of the view that the<br \/>\napplicant deserves to be enlarged on bail.  At this stage of bail,<br \/>\nthis Court is not entering into merit of the case.\n<\/p>\n<p>6.\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the applicant is ordered to be enlarged on bail in connection<br \/>\nwith CR No. I- 36 of 2011 registered at Nadiyad (west) Police<br \/>\nStation, Dist. Khead on his executing a bond of Rs.10,000\/- [Rupees<br \/>\nten thousand only] with one surety of the like amount to the<br \/>\nsatisfaction of the Trial Court and subject to the conditions that he<br \/>\nshall:\n<\/p>\n<p>[a]\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>[b]\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c]\tsurrender<br \/>\nhis passport, if any, to the lower Court within a week;\n<\/p>\n<p>[d]\tnot<br \/>\nleave the State of Gujarat without the prior permission of the<br \/>\nSessions court concerned;\n<\/p>\n<p>[e]\tmark<br \/>\nhis presence at the concerned police station on 15th day<br \/>\nevery English Calender month at 11:00 a.m. till the trial is over;\n<\/p>\n<p>(f)\tfurnish<br \/>\nthe present address of his residence to the I.O. and also to the<br \/>\nCourt at the time of execution of the bond and shall not change his<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p>[g]\tmaintain<br \/>\nlaw and order.\n<\/p>\n<p>7.\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or to take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>8.\tBail<br \/>\nbond to be executed before the lower Court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>9.\tAt<br \/>\nthe trial, the Trial Court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>10.\tRule<br \/>\nis made absolute to the aforesaid extent.
