GOVERNMENT PLEADER for\nRespondent(s) : 1, \nNone for Respondent(s) :\n2, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE H.K.RATHOD\n\t\t\n\t\n\n \n\nDate\n: 30\/08\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.0\tHeard<br \/>\nlearned advocate Mr.Viraj J Dave appearing on behalf of the<br \/>\npetitioner and Mr.Anand Sharma, learned AGP for respondent State<br \/>\nauthority.\n<\/p>\n<p>2.0\tThe<br \/>\nbrief facts of this group of petitions are as under :\n<\/p>\n<p>2.1\tThe<br \/>\npetitioners are working as a part time Safai Kamdar on six hours<br \/>\ndaily basis receiving fixed salary per month and accordingly, more<br \/>\nthan ten years have passed except two petitions who have rendered<br \/>\ntheir service for more than four to five years with respondents. The<br \/>\nservices of petitioners were terminated on 17th April,<br \/>\n2006. Subsequently in pursuance of subsequent resolution dated 15th<br \/>\nJuly, 2006, petitioners have been taken back in service as part time<br \/>\nSafai Kamdar and thereafter, they remain continue by periodical<br \/>\nextension and now, they remain continue upto 30th<br \/>\nSeptember, 2011.\n<\/p>\n<p>2.2\tThe<br \/>\nprayers, made in this petition, by petitioner in prayer clause (A)<br \/>\nand (B), are quoted as under :\n<\/p>\n<p>&#8220;(A)\t\tThat<br \/>\nthis Hon&#8217;ble Court be pleased to issue writ of mandamus or a writ in<br \/>\nthe nature of writ of mandamus or any other appropriate writ or<br \/>\ndirection to the respondents no.2 to regularize the service of<br \/>\npetitioner with all consequential benefits admissible to regular<br \/>\nemployee and further be pleased to direct the respondent no.2 to<br \/>\ngrant the benefits of full time employee to the petitioner from the<br \/>\ndate on which the petitioner completed three years.\n<\/p>\n<p>(B)\t\tPending<br \/>\nadmission hearing and final disposal of the present petition, this<br \/>\nHon&#8217;ble Court be pleased to direct the respondent no.2 not to<br \/>\nterminate the service of petitioner and further be pleased to direct<br \/>\nthe respondent no.2 to grant the benefits of full time employee to<br \/>\nthe petitioner from the date on which the petitioner completed three<br \/>\nyears.&#8221;\n<\/p>\n<p>3.0\tIn<br \/>\nview of aforesaid prayer to regularise service of petitioner and not<br \/>\nto terminate service of petitioner and also to consider service<br \/>\nrendered by part time Sweeper as a full time employee of respondents.\n<\/p>\n<p>4.0\tLearned<br \/>\nadvocate Mr. Dave appearing on behalf of petitioner relied upon one<br \/>\ndecision given by this Court in Special Civil Application Nos.16042<br \/>\nof 2006 with 16044 of 2006 dated 3rd November, 2006 and<br \/>\nsubmitted that petitioner is prepared to make detailed representation<br \/>\nin respect of grievance voiced in present petition to respondents,<br \/>\nbut, learned advocate Mr. Dave submitted that some suitable<br \/>\ndirections may be issued to respondents so that they may consider<br \/>\nrepresentation which will be made by petitioner in light of aforesaid<br \/>\ndecision given by this Court.\n<\/p>\n<p>5.0\tIn<br \/>\nview of above submission made by learned advocate Mr. Dave and<br \/>\nconsidering submissions made by learned AGP Mr.Sharma, let petitioner<br \/>\nmay make detailed representation to respondents about his grievance<br \/>\nalong with copy of aforesaid decision given by this Court in Special<br \/>\nCivil Application Nos.16042 of 2006 with 16044 of 2006, dated 3rd<br \/>\nNovember, 2006, within a period of one month from date of receiving<br \/>\ncopy of present order.\n<\/p>\n<p>6.0\tAs<br \/>\nand when respondents receive such representation from petitioner, it<br \/>\nis directed to respondents to consider it sympathetically and examine<br \/>\ngrievance of present petitioner on basis of Government resolution and<br \/>\npolicy and then also to consider decision which has been given by<br \/>\nthis Court as supplied by petitioner dated 3rd November,<br \/>\n2006 along with representation and then to decide it considering<br \/>\nlength of service rendered by petitioner as a part time Safai Kamdar<br \/>\nand also to consider recent resolution issued by State Government and<br \/>\nthen to pass appropriate reasoned order in accordance with law within<br \/>\na period of three months from date of receiving copy of such<br \/>\nrepresentation from petitioner and communicate decision to petitioner<br \/>\nimmediately.\n<\/p>\n<p>7.0\tConsidering<br \/>\nfact that periodical extension in service has been granted by<br \/>\nrespondents which remained continue till 30th September,<br \/>\n2011.
