Justice ANTONY DOMINIC\n\n Dated :15\/02\/2008\n\n O R D E R\n                             ANTONY DOMINIC, J.\n\n            =============================\n\n                    W.P.(C)NOS.5223 &amp;5379   OF 2008\n\n           ==============================\n\n              DATED THIS THE  15TH DAY OF FEBRUARY 2008\n\n                                    JUDGMENT\n<\/pre>\n<p>       The   challenge   in   these   writ   petitions   is   against   the<\/p>\n<p>Government order dated 25-1-2008 directing   a joint inspection<\/p>\n<p>of the outboard engines of fishing boats.\n<\/p>\n<\/p>\n<p>       2.     It   is   seen   that   on   the   basis   of   guidelines     for   joint<\/p>\n<p>verification   for   kerosene   permits   in     fishing   sector     issued   on<\/p>\n<p>28-10-2007,   joint   inspection   is   to   be     conducted   and   that   the<\/p>\n<p>fitness of the outboard engines are   certified   and on that basis<\/p>\n<p>kerosene   is   to   be   supplied   at   subsidised   rates.     It   is   stated   in<\/p>\n<p>Ext.P1   dated   28-10-2007   that   permit   shall   not   be   issued   to<\/p>\n<p>outboard engines which are  more than six years old.<\/p>\n<p>         3.   According   to   the   petitioners,   this   process   was   already<\/p>\n<p>completed and now yet another fresh process of joint verification<\/p>\n<p>is ordered by the Government by order dated 25-1-2008 and it is<\/p>\n<p>in   this   background,   these   writ   petitions   have   been   filed<\/p>\n<p>challenging  the fresh joint verification.\n<\/p>\n<p>\n<span class=\"hidden_text\">W.P.C. 5223 &amp; 5379\/2008                -2-<\/span><\/p>\n<p>      4. As already stated, on the basis of the certificate   issued<\/p>\n<p>after   joint   verification,   a   concessional     supply   of   subsidised<\/p>\n<p>kerosene is given  and, therefore, what is reflected  in Ext.P1 is a<\/p>\n<p>scheme   for   concessional   supply   of   kerosene.     The   government<\/p>\n<p>having   introduced   the   said     scheme     is   always   at   liberty     to<\/p>\n<p>modify the scheme and it is in pursuance   of   that   right of the<\/p>\n<p>Government,     they   have   issued   Ext.P4   order   wherein   the<\/p>\n<p>condition  in the earlier  order that engines   more than six years<\/p>\n<p>old   will not be issued permit has been deleted.   It was directed<\/p>\n<p>that   irrespective     of   the   age   of     the   engine   based   on   its<\/p>\n<p>seaworthiness,   the   outboard   engine   would   be   eligible   for<\/p>\n<p>concessional   supply of kerosene.\n<\/p>\n<\/p>\n<p>      5. The petitioners contend that Ext.P4 is issued to  favour  a<\/p>\n<p>group of people who own out board engines, which are very old<\/p>\n<p>and are not seaworthy.   They also pointed out the possibility of<\/p>\n<p>the kerosene being   black marketed.   It may be true that Ext.P4<\/p>\n<p>and   the   concession   extended   therein   are   capable   of   being<\/p>\n<p>misused,   but   that   will   not   invalidate   the   scheme   of   the<\/p>\n<p>Government.      If  it is  misused, it is  for the authorities to    take<\/p>\n<p>care of that situation and  the petitioners can point out  violations<\/p>\n<p><span class=\"hidden_text\">W.P.C. 5223 &amp; 5379\/2008                    -3-<\/span><\/p>\n<p>for   rectifying   the   situation.     However,   that   cannot   restrain   the<\/p>\n<p>Government from modifying   a policy.\n<\/p>\n<\/p>\n<p>       6.   I   also   do   not   think     that   on   account   of   the   fresh   joint<\/p>\n<p>verification   as   per   Ext.P4   any   prejudice   is   caused   to   the<\/p>\n<p>petitioners.     In   any   case   they   being   the   beneficiaries   of   a<\/p>\n<p>concession,   are bound   to   comply with the conditions   thereof.<\/p>\n<p>If any joint verification is conducted, the beneficiaries are obliged<\/p>\n<p>to make their  outboard engines  for  joint verification.  I do not<\/p>\n<p>find anything  illegal in  Ext.P4 order.\n<\/p>\n<\/p>\n<p>       7.   The   petitioners   pray   that   the   Government   should   be<\/p>\n<p>directed   to   formulate   specific   guidelines   for     the   presence   of<\/p>\n<p>technical   experts     for   implementing   that   scheme.     It     may   be<\/p>\n<p>desirable to have a defect free  system by inclusion of technically<\/p>\n<p>competent persons to assess the   seaworthiness of the outboard<\/p>\n<p>engines.   That     certainly is a matter   requiring the attention of<\/p>\n<p>the     respondents   and   I   leave     it   them   to   formulate   such  a  fool<\/p>\n<p>proof scheme  for their future guidance.\n<\/p>\n<\/p>\n<p>       The writ petitions are dismissed.\n<\/p>\n<\/p>\n<pre>ks.
