In this appeal, claims Tribunal has awarded<br \/>\nRs.25,000\/- as compensation under &#8216;no fault liability&#8217; by order dated<br \/>\n03.05.2010.\n<\/p>\n<p>3.\tThe claimants have<br \/>\nfiled application u\/s.166 of the MV Act  in respect of injury<br \/>\nsustained in an accident. During pendency of application u\/s.166 of<br \/>\nthe MV Act, claimants filed application u\/s.140 of the MV Act<br \/>\nclaiming Rs.25,000\/- under &#8216;no fault liability&#8217;.\n<\/p>\n<p>4.\tLearned advocate<br \/>\nMr.Parikh submitted that though statutory defence is raised before<br \/>\nclaims Tribunal by appellant   Insurance Co., it has not been<br \/>\nproperly examined by claims Tribunal because of pendency of<br \/>\napplication u\/s.166 of the MV Act and it has been observed that it<br \/>\ncan be examined at the time of deciding  application u\/s.166 of the<br \/>\nMV Act.  The learned Advocate for the appellant Insurance Company<br \/>\nrelied upon  a decision of Apex Court in case of  <a href=\"\/doc\/1496598\/\">Yallwwa<br \/>\n&amp; Ors. v. National Insurance Co. Ltd. &amp; Anr.<\/a> reported in 2007<br \/>\nACJ 1934.\n<\/p>\n<p>5.\tHaving considered<br \/>\nthe submissions made by learned advocate for the appellant Insurance<br \/>\nCompany and also on perusing the interim order passed by claims<br \/>\nTribunal, vide Exh.6 dated 03.05.2010, it is noticed that the claims<br \/>\nTribunal has heard the learned Advocate for the Insurance Company,<br \/>\nconsidered FIR and Panchnama, MLC Certificate and disability<br \/>\ncertificate and particulars of insurance and also the fact that<br \/>\ningredients of Sections 140 and 142 of the MV Act have been satisfied<br \/>\nby claimant, without considering objection raised by Insurance Co.,<br \/>\nawarded benefit of Rs.25,000\/- in favour of claimants.\n<\/p>\n<p>6.\tThe fact remains<br \/>\nthat whatever statutory defence or legal objections are available to<br \/>\nInsurance Co., remain to be examined by claims Tribunal while<br \/>\ndeciding  application u\/s.166 of the MV Act on merits. Therefore, at<br \/>\nthis stage, it is not proper to admit this appeal and keep it pending<br \/>\ntill  application u\/s.166 of the MV Act is decided by claims<br \/>\nTribunal, Vadodara. Therefore, in the opinion of this Court, if this<br \/>\nappeal is disposed of without expressing any opinion on merits with a<br \/>\ndirection to Insurance Co. to deposit entire awarded amount together<br \/>\nwith cost and interest before claims Tribunal, Vadodara and out of<br \/>\nthat, some amount is allowed to be disbursed to the claimant and rest<br \/>\nof the amount is ordered to be invested with cumulative interest, it<br \/>\nwill meet the ends of justice.\n<\/p>\n<p>7.\tIn light of the<br \/>\naforesaid observations, the claims Tribunal is directed to decide the<br \/>\napplication u\/s.166 of the MV Act independently on the basis  of<br \/>\nevidence on record and in accordance with law and without being<br \/>\ninfluenced by interim order dated 03.05.2010 passed under Section 140<br \/>\nof the MV Act as early as possible.\n<\/p>\n<p>8.\tMeanwhile, the<br \/>\nappellant   Insurance Co. is directed to deposit the awarded amount<br \/>\ntogether with cost and interest before claims Tribunal within a<br \/>\nperiod of two weeks from the date of receipt of this order.\n<\/p>\n<p>9.\tOnce the said<br \/>\namount is deposited by the Insurance Co.,  claims Tribunal is<br \/>\ndirected to invest the amount in a Fixed Deposit in the name of Nazir<br \/>\nof claims Tribunal in any nationalized bank, initially for a period<br \/>\nof three years, subject to periodical renewals, till application<br \/>\nu\/s.166 of the MV Act is decided by claims Tribunal. The claims<br \/>\nTribunal shall not permit withdrawal of application u\/s.166 of the MV<br \/>\nAct and  claimant shall not  abandon the proceedings.
