Shah, learned A.P.P. waives service of Rule on behalf of the<br \/>\nState.  In the facts and circumstances of the case and by consent of<br \/>\nboth the sides, this application is taken up for hearing today.\n<\/p>\n<p>2.\tThis<br \/>\napplication is preferred under Section 439 of the Code of Criminal<br \/>\nProcedure for regular bail in connection with FIR registered as CR<br \/>\nNo.I-105 of 2008 with Mandvi Police Station, Kutchh for the offence<br \/>\npunishable under Sections 143,147,148 and 302 of the Indian Penal<br \/>\nCode.\n<\/p>\n<p>3.\tLearned<br \/>\nadvocate for the petitioners submitted that both the petitioners are<br \/>\nfalsely implicated in the commission of offence and false case is<br \/>\nfoisted on them. Considering the role attributed to the petitioners<br \/>\nwhich is reflected in the F.I.R. at Annexure A to the petition, it is<br \/>\na fit case to enlarge both the petitioners on bail.\n<\/p>\n<p>4.\tMs.M.L.\n<\/p>\n<p>Shah, learned A.P.P. representing the State submitted that the<br \/>\npetitioners are involved in the serious offence punishable under<br \/>\nSections  143,147,148 and 302 of the Indian Penal Code. The<br \/>\npetitioners along with the other accused persons formed unlawful<br \/>\nassembly and caused the death of the deceased in a most brutal<br \/>\nmanner. Considering the aforesaid facts and circumstances of the<br \/>\ncase, the petition does not call for any interference by this Court<br \/>\nand it is liable to be dismissed.\n<\/p>\n<p>5.\tI<br \/>\nhave heard Mr.Anandjiwala, learned advocate for the petitioners and<br \/>\nMs.M.L. Shah, learned A.P.P. for the State at length and in great<br \/>\ndetail.  I have also considered the role played by both the<br \/>\npetitioners in the alleged commission of offence punishable under<br \/>\nSections 143,147,148 and 302 of the Indian Penal Code. Considering<br \/>\nthe role attributed to the petitioners, the manner in which they are<br \/>\ninvolved along with the other accused persons and in the peculiar<br \/>\nfacts and circumstances of the case, I am inclined to exercise my<br \/>\ndiscretion in favour of the petitioners.\n<\/p>\n<p>6.\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the petitioners are ordered to be enlarged on bail in connection<br \/>\nwith CR No.I-105 of 2008 registered at Mandvi Police Station, Kutchh<br \/>\non executing a bond of Rs.10,000\/- each [Rupees ten thousand only]<br \/>\nwith one surety each of the like amount to the satisfaction of the<br \/>\nTrial Court and subject to the conditions that they shall:\n<\/p>\n<p>[a]\tnot<br \/>\ntake undue advantage of their liberty or abuse their liberty;\n<\/p>\n<p>[b]\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c]\tsurrender<br \/>\ntheir passport, if any, to the lower Court within a week;\n<\/p>\n<p>[d]\tnot<br \/>\nleave the State of Gujarat without the prior permission of the<br \/>\nSessions Court concerned;\n<\/p>\n<p>[e]\tmark<br \/>\ntheir presence at the concerned police station on any day of every<br \/>\nfirst week of English calendar month between 9.00 AM and 2.00 PM.<br \/>\ntill the trial is over;\n<\/p>\n<p>[f]\tfurnish<br \/>\nthe present address of their residence to the I.O. and also to the<br \/>\nCourt at the time of execution of the bond and shall not change their<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p>[g]\tmaintain<br \/>\nlaw and order.\n<\/p>\n<p>7.\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or to take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>8.\tBail<br \/>\nbond to be executed before the lower Court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>9.\tAt<br \/>\nthe trial, the Trial Court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the petitioners on bail.\n<\/p>\n<p>\tRule<br \/>\nis made absolute to the aforesaid extent.\n<\/p>\n<p>\tDirect<br \/>\nservice is permitted.\n<\/p>\n<p>(H.B.ANTANI,<br \/>\nJ.)<\/p>\n<p>Hitesh<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Lalbai vs State on 11 November, 2011 Author: H.B.Antani, Gujarat High Court Case Information System Print CR.MA\/1033720\/2008 4\/ 4 ORDER IN THE HIGH COURT OF GUJARAT AT AHMEDABAD CRIMINAL MISC.APPLICATION No. 10337 of 2008 ========================================================= LALBAI TEJU KALYAN SANGHAR &amp;
