           Petitioner is a person of Indian origin, who has<\/p>\n
subsequently acquired citizenship of the United States of<\/p>\n
America. According to the petitioner, on the strength of Visa<\/p>\n
he has obtained, since 2002 he has been residing in<\/p>\n
Pathanamthitta district of Kerala State. Petitioner was issued<\/p>\n
an arms licence, which was also renewed subsequently.<\/p>\n
      2.   However, in 2009, when the petitioner made an<\/p>\n
application for renewal of his arms licence, that was rejected<\/p>\n
by Ext.P4 order passed by the third respondent, stating mainly<\/p>\n
that the Arms Act and Rules do not have any provision for<\/p>\n
issuing licence to foreign citizens.              It is also stated that a<\/p>\n
citizen of a foreign country can be permitted to import arms for<\/p>\n
the purpose of sports only. On that basis, the application for<\/p>\n
renewal was declined and the petitioner was ordered to<\/p>\n
surrender his gun.\n<\/p>\n

      3.    Aggrieved by Ext.P4 order, petitioner filed an<\/p>\n
appeal before the second respondent. The appeal was also<\/p>\n
rejected by Ext.P6 order. In Ext.P6 order, it is stated that,<\/p>\n
under the scheme of the Arms Act, 1959, licence is usually<\/p>\n
granted for crop protection and self protection and that in the<\/p>\n
appeal, the petitioner has not explained for what he needed<\/p>\n
the weapon.        Further, it is also stated that he has not<\/p>\n
mentioned that there is any threat for his life or property. It is<\/p>\n
in these circumstances, challenging the aforesaid order, this<\/p>\n
writ petition has been filed seeking to direct the respondents<\/p>\n
to renew Ext.P2 licence issued to the petitioner.<\/p>\n
      4.    Contention raised by the learned counsel for the<\/p>\n
petitioner is that Section 13 of the Arms Act, 1959, no<\/p>\n
distinction is made among Indian citizens and others for the<\/p>\n
grant of arms licence. Counsel also placed reliance on the<\/p>\n
judgment reported in Ashok kumar Harakchand Shab Vs.<\/p>\n
State of Gujarat [2000 (3) KLT SN Case No.45] to<\/p>\n
substantiate this plea.\n<\/p>\n

     5.     Section 13 of the Arms Act, 1959, provides for<\/p>\n
grant of licenses. Section 13(3) of the Act, being relevant,<\/p>\n
reads as follows:-\n<\/p>\n
                  “S.13(3). The licensing authority shall<\/p>\n
            grant –\n<\/p><\/blockquote>\n
                  (a)   a licence under section 3 where<\/p>\n
            the licence is required-\n<\/p><\/blockquote>\n
                  (i)   by a citizen of India in respect of a<\/p>\n
            smooth bore gun having a barrel of not less<\/p>\n
            than twenty inches in length to be used for<\/p>\n
            protection or sport or in respect of a muzzle<\/p>\n
            loading gun to be used for bona fide crop<\/p>\n
            protection:\n<\/p><\/blockquote>\n
                  Provided that where having regard to<\/p>\n
            the circumstances of any case, the licensing<\/p>\n
            authority is satisfied that a muzzle loading<\/p>\n
            gun will not be sufficient for crop protection,<\/p>\n
            the licensing authority may grant a licence in<\/p>\n
            respect of any other smooth bore gun as<\/p>\n
            aforesaid for such protection; or<\/p>\n<\/blockquote>\n
                  (ii)  in respect of a point 22 bore rifle<\/p>\n
            or an air rifle to be used for target practice by<\/p>\n
            a member of a rifle club or rifle association<\/p>\n

            licensed   or   recognised    by   the   Central<\/p>\n
            Government;\n<\/p><\/blockquote>\n
                  (b)   a licence under section 3 in any<\/p>\n
            other case or a licence under section 4,<\/p>\n
            section 5, section 6, section 10 or section 12, if<\/p>\n
            the licensing authority is satisfied that the<\/p>\n
            person by whom the licence is required has a<\/p>\n
            good reason for obtaining the same.”<\/p><\/blockquote>\n
      6.    In so far as the case in hand is concerned, the<\/p>\n
contention of the petitioner is that he needs the weapon for<\/p>\n
self protection. In my view, if the requirement of gun is for self<\/p>\n
protection, the claim will have to be dealt with section 13(3)(a)<\/p>\n
(i). A reading of this provision shows that, for self protection<\/p>\n
and crop protection, licence can be granted only to citizens of<\/p>\n
India.   Counsel for the petitioner relied on Clause (b) and<\/p>\n
contended that the said provision did not distinguish between<\/p>\n
the citizens of the country and others. I am inclined to think<\/p>\n
that a combined reading of entire section 13(3) would show<\/p>\n
that, cases of self protection and crop protection are outside<\/p>\n
the purview of Clause (b). If that be so, the request of the<\/p>\n

petitioner is liable to be rejected.\n<\/p>\n
      7.    A reading of the judgment relied on by the counsel<\/p>\n
for the petitioner also, in my view, recognises the aforesaid<\/p>\n
view because that judgment itself lays down that what is<\/p>\n
discernible from the provisions of the Act is that there is no<\/p>\n
express or implied ban or restriction against the consideration<\/p>\n
of application for licence on the basis of citizenship except as<\/p>\n
provided in Section 13(3)(a)(i) of the Act.<\/p>\n
      8.    Therefore, in my view, the authorities cannot be<\/p>\n
faulted for the view they have taken in the impugned orders.<\/p>\n
      Writ petition fails and it is dismissed.<\/p>\n
