BALAKRISHNAN NAIR &amp; C.T.RAVIKUMAR, JJ.\n                     ------------------------------\n                      W.A.No. 880 OF 2008\n                     -------------------------------\n             Dated this the 12th day of June, 2009\n\n                         J U D G M E N T\n<\/pre>\n<p>                         ~~~~~~~~~~~<\/p>\n<p>Balakrishnan Nair, J.\n<\/p>\n<\/p>\n<p>     The point that arises for decision in this appeal is, whether a<\/p>\n<p>Senior Grade Assistant in the Secretariat Subordinate Service has<\/p>\n<p>to complete one year&#8217;s service before she is promoted to the post<\/p>\n<p>of Selection Grade Assistant.\n<\/p>\n<\/p>\n<p>     2.    The brief facts of the case are the following:<\/p>\n<p>     The writ petitioner, the respondent herein, was appointed as<\/p>\n<p>Assistant Grade-II in the Secretariat Subordinate Service on<\/p>\n<p>1.6.1990. She was promoted as Assistant Grade-I on 25.5.1996.<\/p>\n<p>She was further promoted as Senior Grade Assistant by Ext.P11<\/p>\n<p>order dated 27.10.2001. She went on leave without allowance for<\/p>\n<p>a period of three years from 12.11.2001. The leave was granted<\/p>\n<p>as per Ext.P12 order dated 9.11.2001.              The said leave was<\/p>\n<p>extended for a further period of one year by Ext.P13 order dated<\/p>\n<p><span class=\"hidden_text\">W.A.No.880\/2009                 2<\/span><\/p>\n<p>25.10.2004. Later, she rejoined duty on 18.7.2005 cancelling the<\/p>\n<p>unavailed portion of leave. Immediately, she claimed promotion<\/p>\n<p>to the post of Selection Grade Assistant, as vacancies were<\/p>\n<p>available in that post. Ext.P15 was the representation filed by<\/p>\n<p>her. The Government considered the representation and rejected<\/p>\n<p>it by Ext.P17 stating that since no probation was prescribed for<\/p>\n<p>the post of Senior Grade Assistant, she has to complete at least<\/p>\n<p>one year&#8217;s service in that post within a continuous period of two<\/p>\n<p>years to become eligible for promotion. This decision was taken<\/p>\n<p>relying on the proviso to Rule 28(a)(ii) of the Kerala State and<\/p>\n<p>Subordinate Service Rules (for short &#8216;KS &amp; SSR&#8217;)<\/p>\n<p>     3.    The 1st respondent\/petitioner was of the view that<\/p>\n<p>since the post of Selection Grade Assistant is a Higher Grade<\/p>\n<p>Post of Senior Assistant, her case is covered by Rule 28(e) of the<\/p>\n<p>General Rules.      Raising this contention, she moved the<\/p>\n<p>Government. As per the direction of this Court, the Government<\/p>\n<p>reconsidered her case and again rejected her claim by Ext.P26.<\/p>\n<p>The writ petition was filed challenging Exts.P17 and P26. She<\/p>\n<p>sought a further direction to promote her as Selection Grade<\/p>\n<p>Assistant with retrospective effect from the date of occurrence of<\/p>\n<p><span class=\"hidden_text\">W.A.No.880\/2009                  3<\/span><\/p>\n<p>first vacancy in that category after she rejoined duty on<\/p>\n<p>18.7.2005. According to the 1st respondent\/writ petitioner, the<\/p>\n<p>proviso to Rule 28(a)(ii) of the KS &amp; SSR has no application and<\/p>\n<p>Rule 28(e) which has been incorporated in the Special Rules for<\/p>\n<p>Kerala Secretariat Subordinate Service, as the 2nd provisio to<\/p>\n<p>Rule 10 thereof, will govern the case. The appellants, who are<\/p>\n<p>respondents in the writ petition, resisted the prayers supporting<\/p>\n<p>the stand taken by them in the orders impugned.<\/p>\n<p>      4.    The learned Single Judge, after hearing both sides,<\/p>\n<p>allowed the writ petition. According the learned Single Judge,<\/p>\n<p>Rule 10 of the Special Rules for the Secretariat Subordinate<\/p>\n<p>Service prescribes probation for various posts. Therefore, Rule<\/p>\n<p>28(a)(ii) of the KS &amp; SSR would not apply. Based on that finding,<\/p>\n<p>reliefs were also granted. The respondents in the writ petition,<\/p>\n<p>feeling aggrieved by the said judgment, have preferred this Writ<\/p>\n<p>Appeal.\n<\/p>\n<\/p>\n<p>      5.    We heard the learned counsel on both sides.      The<\/p>\n<p>learned senior Government Pleader, Sri. Benny Gervasis,<\/p>\n<p>submitted that the finding of the learned Single Judge that since<\/p>\n<p><span class=\"hidden_text\">W.A.No.880\/2009                  4<\/span><\/p>\n<p>probation is prescribed for certain posts in the Secretariat<\/p>\n<p>Subordinate Service, the proviso to Rule 28(a)(ii) of the KS &amp;<\/p>\n<p>SSR have no application is untenable.        If, probation is not<\/p>\n<p>prescribed for a particular post, then for further promotion from<\/p>\n<p>that post, the 2nd proviso to Rule 28(a)(ii) of the KS &amp; SSR will<\/p>\n<p>govern. According to the learned senior Government Pleader,<\/p>\n<p>the   learned      Single   Judge   has    misread    the   Rule.<\/p>\n<p>Sri.K.P.Rajeevan, the learned counsel for the 1st respondent, fully<\/p>\n<p>supported the view taken by the learned Single Judge.          He<\/p>\n<p>further added that, in view of the 2nd proviso to Rule 10 of the<\/p>\n<p>Special Rules, it should be taken that the operation of the<\/p>\n<p>proviso to Rule 28(a)(ii) of the KS &amp; SSR stands excluded.<\/p>\n<p>Something not expressly stated in the Special Rules concerning<\/p>\n<p>probation cannot be made applicable by the process of<\/p>\n<p>interpretation, it is submitted.\n<\/p>\n<\/p>\n<p>     6.    The facts in this case are not disputed. If the proviso<\/p>\n<p>to Rule 28(a)(ii) of the KS &amp; SSR applies, the 1st respondent will<\/p>\n<p>be eligible to get promotion to post of Selection Grade Assistant<\/p>\n<p>only on completion of one year&#8217;s service from 18.7.2005. If the<\/p>\n<p>said proviso is not applicable, she is entitled to get the first<\/p>\n<p><span class=\"hidden_text\">W.A.No.880\/2009                     5<\/span><\/p>\n<p>arising vacancy in that cadre after she rejoined on the said date.<\/p>\n<p>Rule 28(a)(ii) of the KS &amp; SSR reads as follows:<\/p>\n<blockquote><p>            &#8220;28(a)(ii)  Where the Special Rules for a<br \/>\n            service provide for appointment by promotion<br \/>\n            to any class or category from a specified<br \/>\n            class or category of such service, no member<br \/>\n            shall be eligible for such appointment unless<br \/>\n            he   is  a  full  member    or   an  approved<br \/>\n            probationer in the class or category so<br \/>\n            specified:\n<\/p><\/blockquote>\n<blockquote><p>                  Provided that if he is the holder of a<br \/>\n            post in any service for which no probation has<br \/>\n            been prescribed, he shall not be eligible for<br \/>\n            promotion unless he has put in satisfactory<br \/>\n            service in that post for a period of one year<br \/>\n            on duty within a continuous period of two<br \/>\n            years.&#8221;<\/p><\/blockquote>\n<p>     7.    The main part of the above quoted clause would show<\/p>\n<p>that, if promotion to a category is to be made from a specified<\/p>\n<p>category, an incumbent can be promoted, if only, he is a full<\/p>\n<p>member or an approved probationer in the specified category.<\/p>\n<p>The proviso would provide that for a particular post in a service<\/p>\n<p>probation is not prescribed, he will not get promotion from that<\/p>\n<p>post unless he has put in satisfactory service for one year on<\/p>\n<p>duty within a continuous period of two years. The above Rule<\/p>\n<p>cannot be understood as saying that, if probation is prescribed<\/p>\n<p><span class=\"hidden_text\">W.A.No.880\/2009                     6<\/span><\/p>\n<p>for some posts in a service, the 2nd proviso will not have any<\/p>\n<p>application. The learned Single Judge read the Rule like that.<\/p>\n<p>The said view is unsupportable going by the plain meaning of the<\/p>\n<p>words of the above quoted clause (ii) of sub-rule (a) of Rule 28 of<\/p>\n<p>the KS &amp; SSR.\n<\/p>\n<\/p>\n<p>     8.    Rule 28(e) Reads as follows:\n<\/p>\n<pre>            \"28(e)      Probation where there are more\n            than one grade to the same category:-\n            Notwithstanding    anything  to  the  contrary\n<\/pre>\n<p>            contained in the Special Rules where there are<br \/>\n            more than one grade to the same category and<br \/>\n            duties and responsibilities attached to the<br \/>\n            various grades are one and the same, and<br \/>\n            appointment to the higher grades are made by<br \/>\n            promotion   from    the  lower   grades,  then<br \/>\n            probation shall be insisted only in the lowest<br \/>\n            grade to such category.&#8221;\n<\/p>\n<p>\nIf there are more than one grade in the same category of post<\/p>\n<p>and if the duties and responsibilities are same for the various<\/p>\n<p>grades, then probation need be insisted only in the lowest grade<\/p>\n<p>for promotion to higher grade. It is unnecessary to complete<\/p>\n<p>probation in every grade, as per the above quoted Rule. The said<\/p>\n<p>Rule will definitely apply to the case on hand as the posts<\/p>\n<p>concerned are different grades of the same post of Assistant.<\/p>\n<p>The above quoted Rule has been incorporated the Special Rules<\/p>\n<p><span class=\"hidden_text\">W.A.No.880\/2009                  7<\/span><\/p>\n<p>also as 2nd proviso to Rule 10 of the Special Rules for Secretariat<\/p>\n<p>Subordinate Service.      We are of the view that the above<\/p>\n<p>provision relieves an incumbent from the burden of completing<\/p>\n<p>probation in every grade of the same post and not from the<\/p>\n<p>obligation to complete one year&#8217;s service prescribed in the<\/p>\n<p>proviso to Rule 28(a)(ii) of the KS &amp; SSR. In other words, the<\/p>\n<p>Rule 28(e) will not obliterate the proviso 28(a)(ii). Both of them<\/p>\n<p>will operate simultaneously. The view to the contrary taken by<\/p>\n<p>the learned Single Judge is unsustainable. So, the respondent<\/p>\n<p>has to complete one year&#8217;s service after she rejoined duty for<\/p>\n<p>getting promotion to the post of Selection Grade Assistant. We<\/p>\n<p>are told that the respondent has already been granted promotion<\/p>\n<p>on completion of one year&#8217;s service in the lower grade.<\/p>\n<p>     In the result, the Writ Appeal is allowed. The judgment of<\/p>\n<p>the learned Single Judge is reversed and the Writ Petition is<\/p>\n<p>dismissed.
