RADHAKRISHNAN, J.\n\n= = = = = = = = = = = = = = = = = = = = = = = =\n\n          W.P.(C).No.35800 of 2008-J\n\n= = = = = = = = = = = = = = = = = = = = = = = =\n\n   Dated this the 10th day of December, 2008.\n\n                   JUDGMENT\n<\/pre>\n<p>Heard.\n<\/p>\n<p>The petitioner is YMCA. It has two buildings in a<\/p>\n<p>plot. It availed a facility from the respondents,<\/p>\n<p>defaulted in repayment and is facing SARFAESI Act<\/p>\n<p>proceedings.  The  income   generated  from   the<\/p>\n<p>buildings appears to be wholly insufficient to<\/p>\n<p>pay   off    the   outstandings.    Under    such<\/p>\n<p>circumstances,  to    sustain  the   petitioner&#8217;s<\/p>\n<p>activities as a non-profit establishment with<\/p>\n<p>certain  philanthropic  activities,  the  learned<\/p>\n<p>counsel for the petitioner requested that the<\/p>\n<p>respondents  should   bestow  attention  to   the<\/p>\n<p>possibility  of  bifurcating  the   interest  and<\/p>\n<p>selling off one building which, according to the<\/p>\n<p>petitioner, will fetch the entire outstandings.<\/p>\n<p><span class=\"hidden_text\">WP(C)35800\/08          -: 2 :-<\/span><\/p>\n<p> Recording    this submission,    the  petitioner is<\/p>\n<p> directed to make appropriate appearance before<\/p>\n<p> the second respondent and have the matter worked<\/p>\n<p> out. If that does not work out, it will be open<\/p>\n<p> to the respondents to sell the entire security<\/p>\n<p> property to realize the outstandings. Let the<\/p>\n<p> petitioner   make  appearance    before  the  second<\/p>\n<p> respondent      through      competent    authorized<\/p>\n<p> representative within three weeks from now. To<\/p>\n<p> enable the aforesaid proceedings, the impugned<\/p>\n<p> proceedings will stand suspended for 45 days. If<\/p>\n<p> the petitioner does not appear before the second<\/p>\n<p> respondent    within  the     time  stipulated, the<\/p>\n<p> benefits of this judgment will stand recalled and<\/p>\n<p> the respondents will be at liberty to sell the<\/p>\n<p> entire property, without fresh notice to the<\/p>\n<p> petitioner.
