JUSTICE SHIVA KIRTI SINGH)<\/p>\n<p>02.   24.08.2011                   Heard learned counsel for the appellant and learned<\/p>\n<p>                      counsel for the University and perused the order dated<\/p>\n<p>                      04.04.2011 of the writ court whereby writ petition bearing<\/p>\n<p>                      C.W.J.C. No.12772 of 2010 has been dismissed.<\/p>\n<p>                                   The writ court noticed that petitioner had absented<\/p>\n<p>                      from the college since 2002 and there was nothing to show that<\/p>\n<p>                      he was granted leave of any kind during that time, on that<\/p>\n<p>                      account writ court did not grant any relief to the petitioner.<\/p>\n<p>                                   We have been shown that petitioner&#8217;s name is not<br \/>\n<span class=\"hidden_text\"> Patna High Court LPA No.799 of 2011 (2) dt.24-08-2011<\/span><br \/>\n<span class=\"hidden_text\">                                            2<\/span><\/p>\n<p>                 included in the list of teachers and employees of the college<\/p>\n<p>                 submitted to the State Government. The college in question is<\/p>\n<p>                 an affiliated college managed by a governing body and the<\/p>\n<p>                 university itself has a limited role in respect of such colleges<\/p>\n<p>                 particularly when they were not receiving any aid earlier. Now<\/p>\n<p>                 when the State Government has started the scheme for grant of<\/p>\n<p>                 some kind of aid or monetary benefits, disputes have started<\/p>\n<p>                 surfacing like present one claiming that petitioner was a lawful<\/p>\n<p>                 teacher of the college. The action impugned is basically of the<\/p>\n<p>                 governing body of the college or its management which is<\/p>\n<p>                 private in nature. Hence, in our view also the writ petition was<\/p>\n<p>                 rightly dismissed. If so advised the appellant may avail other<\/p>\n<p>                 alternative remedy by approaching the University or Tribunal if<\/p>\n<p>                 constituted for the purpose, or the Civil Court for seeking<\/p>\n<p>                 appropriate relief in accordance with law.<\/p>\n<p>                              The appeal is accordingly disposed of.\n<\/p>\n<\/p>\n<p>                                                   (Shiva Kirti Singh, J.)<\/p>\n<p>                                                    (Shivaji Pandey, J.)<br \/>\n Mkr.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211;
