By this petition, the petitioner seeks a writ to quash<br \/>\n       the order dated 11.08.2009 (Annexure P\/1) whereby the<br \/>\n       petitioner, posted on deputation at Naya Raipur Development<br \/>\n       Authority (for short `NRDA&#8217;), Raipur  as Revenue Inspector,<br \/>\n       has been repatriated to his parent department i.e. Revenue<br \/>\n       Department.\n<\/p>\n<p>2.   The indisputable facts, in brief, are that the parent<br \/>\ndepartment of the petitioner as Revenue Inspector is the<br \/>\nRevenue Department of the State Government of Chhattisgarh.<br \/>\nThe petitioner was sent on deputation vide order dated<br \/>\n27.08.2001 to Capital Area Development Authority (for short<br \/>\n`CADA&#8217;) and posted at Raipur, which was later on renamed as<br \/>\nNRDA.\n<\/p>\n<p>3.   Shri Sharma, learned counsel appearing for the<br \/>\npetitioner submits that the impugned order has been passed<br \/>\narbitrarily, unreasonably and with an ulterior motive. Shri<br \/>\nSharma further submits that the borrowing department has not<br \/>\ntake any permission from the parent department to repatriate<br \/>\nthe services of the petitioner to the parent department. It<br \/>\nis further contended that since there is scarcity of staff<br \/>\nin the NRDA, therefore, there is no need to repatriate the<br \/>\npetitioner back to his parent department.\n<\/p>\n<p>4.   Shri Thakur, learned Deputy Advocate General appearing<br \/>\nfor the State\/respondents 1 to 3 and Shri B.D.Guru, learned<br \/>\ncounsel appearing for the respondent No. 4 submit that the<br \/>\ndeputationist can be repatriated back to his parent<br \/>\ndepartment at the instance of either the borrowing<br \/>\ndepartment or the parent department. The deputationist has<br \/>\nno vested right to continue even after expiry of minimum<br \/>\nprescribed period of deputation.\n<\/p>\n<p>5.   I have heard learned counsel appearing for the parties,<br \/>\nperused the pleadings and the documents appended thereto.<br \/>\nAdmittedly, in the present case, it is evident that the<br \/>\npetitioner was sent on deputation by order dated 27.08.2001<br \/>\n(though a copy of the order whereby the petitioner was sent<br \/>\non deputation to NRDA has not been filed with the petition)<br \/>\nand by order dated 11.08.2009 (Annexure P\/1), the petitioner<br \/>\nwas repatriated back to the parent department after<br \/>\ncompletion of minimum period of two years. The petitioner<br \/>\nwas on deputation for about eight years.\n<\/p>\n<p>  6.   The law on deputation is very clear. The Supreme Court<br \/>\n       in <a href=\"\/doc\/1180843\/\">State of Punjab and others vs. Inder Singh and others<\/a>1<br \/>\n       while considering the deputation and repatriation to the<br \/>\n       parent cadre\/department on expiry of period of deputation<br \/>\n       observed as under :-\n<\/p>\n<blockquote><p>                &#8220;18.  The  concept  of  &#8220;deputation&#8221;  is<br \/>\n                well  understood in service law and  has<br \/>\n                a  recognized meaning. &#8220;Deputation&#8221;  has<br \/>\n                a  different connotation in service  law<br \/>\n                and  the dictionary meaning of the  word<br \/>\n                &#8220;deputation&#8221;  is of no help.  In  simple<br \/>\n                words    &#8220;deputation&#8221;   means    service<br \/>\n                outside the cadre or outside the  parent<br \/>\n                department.  Deputation is  deputing  or<br \/>\n                transferring  an  employee  to  a   post<br \/>\n                outside  his cadre, that is to  say,  to<br \/>\n                another   department  on   a   temporary<br \/>\n                basis.   After  the  expiry  period   of<br \/>\n                deputation  the  employee  has  to  come<br \/>\n                back  to his parent department to occupy<br \/>\n                the   same   position  unless   in   the<br \/>\n                meanwhile  he  has earned  promotion  in<br \/>\n                his   parent  department  as   per   the<br \/>\n                Recruitment Rules. Whether the  transfer<br \/>\n                is   outside   the   normal   field   of<br \/>\n                deployment  or  not is  decided  by  the<br \/>\n                authority  who controls the  service  or<br \/>\n                post   from   which  the   employee   is<br \/>\n                transferred. There can be no  deputation<br \/>\n                without  the  consent of the  person  so<br \/>\n                deputed  and  he would, therefore,  know<br \/>\n                his   rights  and  privileges   in   the<br \/>\n                deputation  post. The law on  deputation<br \/>\n                and repatriation is quite settled as  we<br \/>\n                have  also  seen  in  various  judgments<br \/>\n                which we have referred to above&#8230;..&#8221;\n<\/p><\/blockquote>\n<p>  7.   The  Supreme Court in Umapati Choudhary v.  State  of<br \/>\n       Bihar and another2 has defined `deputation&#8217; in the following<br \/>\n       terms:-\n<\/p>\n<blockquote><p>                &#8220;Deputation  can be aptly  described  as<br \/>\n                an  assignment of an employee  (commonly<br \/>\n                referred  to  as  the deputationist)  of<br \/>\n                one  department  or  cadre  or  even  an<br \/>\n                organization  (commonly referred  to  as<br \/>\n                the   parent   department   or   lending<br \/>\n                authority)  to  another  department   or<br \/>\n                cadre    or    organization    (commonly<br \/>\n                referred    to    as    the    borrowing<br \/>\n                authority).  The necessity  for  sending<br \/>\n                on  deputation arises in public interest<br \/>\n                to   meet   the  exigencies  of   public<br \/>\n                service.  The  concept of deputation  is<br \/>\n                consensual  and  involves  a   voluntary<br \/>\n                decision  of  the employer to  lend  the<br \/>\n                services   of   his   employee   and   a<br \/>\n                corresponding   acceptance    of    such<br \/>\n                service  by  the borrowing employer.  It<br \/>\n                also   involves  the  consent   of   the<br \/>\n                employee to go on deputation or not.&#8221;\n<\/p><\/blockquote>\n<p>  8.   Further,  in  <a href=\"\/doc\/527418\/\">Kunal  Nanda vs.  Union  of  India  and<\/a><br \/>\n       another3, the Supreme Court observed as under:\n<\/p>\n<blockquote><p>                &#8220;6..The   basic   principle   underlying<br \/>\n                deputation  itself is  that  the  person<br \/>\n                concerned can always and at any time  be<br \/>\n                repatriated to his parent department  to<br \/>\n                serve  any substantive position  therein<br \/>\n                at   the  instance  of  either  of   the<br \/>\n                departments  and  there  is  no   vested<br \/>\n                right  in such a person to continue  for<br \/>\n                long  on  deputation or get absorbed  in<br \/>\n                the  department to which he had gone  on<br \/>\n                deputation..&#8221;\n<\/p><\/blockquote>\n<p>  9.   The Supreme Court in <a href=\"\/doc\/31592\/\">Prasar Bharti &amp; Ors. vs. Amarjeet<br \/>\n       Singh &amp; Ors4.<\/a> observed that;\n<\/p>\n<blockquote><p>                   &#8220;13.   There   exists  a  distinction<br \/>\n                between   `transfer&#8217;  and  `deputation&#8217;.<br \/>\n                `Deputation&#8217;  connotes  service  outside<br \/>\n                the   cadre   or  outside   the   parent<br \/>\n                department  in  which  an  employee   is<br \/>\n                serving.    `Transfer&#8217;,   however,    is<br \/>\n                limited  to equivalent post in the  same<br \/>\n                cadre   and   in  the  same  department.<br \/>\n                Whereas  deputation would be a temporary<br \/>\n                phenomenon,  transfer  being  antithesis<br \/>\n                must exhibit the opposite indications.&#8221;\n<\/p><\/blockquote>\n<p>  10.  The question of law, as stated hereinabove, came into<br \/>\n       consideration in the matter of <a href=\"\/doc\/639135\/\">Radhe Lal Nag v. Government<br \/>\n       of Chhattisgarh and others<\/a> [WP(S) No. 3997\/2007] decided on<br \/>\n       27.3.2008, wherein this Court, after having examined the<br \/>\n       circular dated 02.12.1988 dealing with the period  of<br \/>\n       deputation, held as under:\n<\/p>\n<blockquote><p>                &#8220;6.  As per the circular dated 2.12.1988<br \/>\n                (Annexure  p\/3)  in  normal  cases   the<br \/>\n                minimum  period  of  deputation  is  two<br \/>\n                years,  which  can  be  extended  for  a<br \/>\n                period   of  four  years. Applying  the  well  settled  principles  of  law  on<br \/>\n       deputation to the facts of the case, continuation of the<br \/>\n       employees on deputation or repatriation on completion of<br \/>\n       deputation period does not depend on their consent. After<br \/>\n       completion  of  minimum  period  of  deputation,  the<br \/>\n       petitioner\/employee may be repatriated back to the parent<br \/>\n  department.\n<\/p>\n<p>12.  In view of foregoing and for the reasons mentioned<br \/>\nhereinabove, no interference is warranted with the order<br \/>\ndated 11.08.2009 (Annexure-P\/1). Accordingly, the writ<br \/>\npetition is dismissed at the motion stage itself.
