(Oral)\n<\/pre>\n<p>            This order shall deal with three petitions viz. CWP 15602 of<\/p>\n<p>2007 <a href=\"\/doc\/245379\/\">(Karnail Singh v. State of Punjab and others<\/a>), CWP 15388 of 2007<\/p>\n<p><a href=\"\/doc\/1943418\/\">(Teja Singh v. State of Punjab and others<\/a>) and CWP 15600 of 2007<\/p>\n<p><a href=\"\/doc\/322120\/\">(Subhash Kumar v. State of Punjab and others<\/a>), as common questions of<\/p>\n<p>fact and law are involved.\n<\/p>\n<p>            For reference to record, CWP 15602 of 2007 <a href=\"\/doc\/245379\/\">(Karnail Singh v.<\/p>\n<p>State of Punjab and others<\/a>) is being taken up.\n<\/p>\n<p><span class=\"hidden_text\"> Civil Writ Petition No. 15602 of 2007                            2<\/span><\/p>\n<p>            This petition under Articles 226\/227 of the Constitution of<\/p>\n<p>India has   been filed praying for issuance of a writ in the nature of<\/p>\n<p>certiorari quashing the action of the respondents in not treating the<\/p>\n<p>petitioner as a regular Provincial Reserve (P.R.) Chowkidar, though the<\/p>\n<p>petitioner retired after rendering about 22 years of service. The petitioner<\/p>\n<p>has not been granted the benefit of gratuity, pension and other pensionary<\/p>\n<p>benefits, which action of the respondents is arbitrary and unconstitutional,<\/p>\n<p>being violative of Articles 14 and 16 of the Constitution of India.<\/p>\n<p>            It has been pleaded that the petitioner was given appointment<\/p>\n<p>as Provincial Reserve Chowkidar on 12.1.1983, through Employment<\/p>\n<p>Exchange.    After putting in about 22 years of service, the petitioner<\/p>\n<p>superannuated on 30.9.2006.      When the petitioner was not given the<\/p>\n<p>pensionary benefits, the petitioner approached the respondents by way of<\/p>\n<p>making a representation and also otherwise.       The petitioner has been<\/p>\n<p>orally informed that the petitioner, being a temporary employee, cannot be<\/p>\n<p>given pensionary benefits. It has been pleaded that similarly situated<\/p>\n<p>persons have been given pensionary benefits.\n<\/p>\n<p>            Learned counsel for the petitioner states that the case of the<\/p>\n<p>petitioner is covered by the judgments rendered in CWP No.7780 of 2004<\/p>\n<p><a href=\"\/doc\/434840\/\">(Rakha Singh v. State of Punjab and others<\/a>) decided on 27.1.2005, and<\/p>\n<p>CWP No.16786 of 2001 <a href=\"\/doc\/1768134\/\">(Baldev Singh v. State of Punjab)<\/a> decided on<\/p>\n<p>5.12.2002. The petitions were allowed by this Court. The State of Punjab<\/p>\n<p>filed a Special Leave Petition before the Hon&#8217;ble Supreme Court of India,<\/p>\n<p>which was dismissed.\n<\/p>\n<p>            Learned counsel for the petitioner has further informed the<br \/>\n<span class=\"hidden_text\"> Civil Writ Petition No. 15602 of 2007                             3<\/span><\/p>\n<p>Court that considering the legal position, even the respondent-State has<\/p>\n<p>issued instructions on 17.4.2009 (Annexure P-8).<\/p>\n<p>             Learned counsel for the petitioner further states that similar<\/p>\n<p>issue was considered by this very Bench, while dealing with CWP 15397<\/p>\n<p>of 2007 <a href=\"\/doc\/104390275\/\">(Amrik Singh v. State of Punjab and others<\/a>) decided on<\/p>\n<p>22.7.2009.\n<\/p>\n<p>             Learned counsel for the respondent-State contends that,<\/p>\n<p>indeed, the Special Leave Petition filed by the respondent-State has been<\/p>\n<p>dismissed. In view of the settled law, the instructions (Annexure P-8)<\/p>\n<p>have been issued by the respondents under which the petitioner is entitled<\/p>\n<p>to the relief claimed in the petition.\n<\/p>\n<p>             In view of the facts and circumstances noticed above, I am of<\/p>\n<p>the opinion that the petitioner is entitled to the pensionary benefits, the<\/p>\n<p>petitioner having served the respondents for about 22 years.<\/p>\n<p>             Accordingly, the petition is allowed.\n<\/p>\n<p>             The respondents are directed to give pensionary benefits to<\/p>\n<p>the petitioner within 3 months of receipt of certified copy of the order.<\/p>\n<pre>August 31, 2009                                           ( AJAI LAMBA )\nKang                                                              JUDGE\n\n\n\n1.
