Whether the Judgment should be reported in the Digest?\n\n\nA.K. SIKRI, J.\n<\/pre>\n<p>1.        In all these appeals, common question of law arises for<\/p>\n<p>determination. The question of law which was framed in ITA<\/p>\n<p>811\/2007 runs as follows:-\n<\/p>\n<\/p>\n<blockquote><p>                    &#8220;Whether on the facts of the present case, the<br \/>\n                    Tribunal was justified in law in deleting the addition<br \/>\n                    of Rs.8,67,010 made as undisclosed income of the<br \/>\n                    assessee for assessment year 1999-2000 under<br \/>\n                    Section 158BC of the Act?&#8221;<\/p>\n<p>2.        Except the difference of amount which is deleted in other<\/p>\n<p>cases, the question of law is identical. Therefore, we are proceedings<\/p>\n<p>to discuss the question of law on the basis of facts appearing in ITA<\/p>\n<p><span class=\"hidden_text\">ITA 811 OF 2007,ITA 818 OF 2007,ITA 378 OF 2008,                 Page 2 of 14<\/span><br \/>\nITA 742 OF 2007ITA 416 OF 2008<br \/>\n 811\/2007. Record of factual matrix does not need a large canvas.<\/p>\n<p>Succinctly stated, the facts are that on 13th January, 2000, a search<\/p>\n<p>and seizure operation was carried out on Shyam Telecom Group of<\/p>\n<p>Companies (to which these assessee group of companies belonged).<\/p>\n<p>There was no specific search warrant in the name of the assessee<\/p>\n<p>company. However, according to the department, since the papers<\/p>\n<p>relating to the assessee company were also seized during the course<\/p>\n<p>of the search, notice under Section 158 BC read with Section 158 BD<\/p>\n<p>of the Income-Tax Act (hereinafter referred to as \u201ethe Act\u201f) was also<\/p>\n<p>issued to the assessee for the block assessment period 1 st April, 1989<\/p>\n<p>to 13th January, 2000.                       The assessee in response thereto filed its<\/p>\n<p>return declaring undisclosed income at \u201enil\u201f.                     The assessment was<\/p>\n<p>however framed determining undisclosed income at ` 8,67,010\/- for<\/p>\n<p>the assessment year 1999-2000. While making this assessment, the<\/p>\n<p>Assessing Officer treated the long term capital gain on the sale of<\/p>\n<p>shares as undisclosed income. The CIT (A) confirmed the aforesaid<\/p>\n<p>order of the Assessing Officer. However, the ITAT has allowed the<\/p>\n<p>appeal of the assessee vide impugned judgment dated 12th October,<\/p>\n<p>2006 thereby deleting the aforesaid addition.<\/p>\n<p>3.        We may note at this stage that the case of the assessee before<\/p>\n<p>the authorities below was that shares in question which were sold<\/p>\n<p>had already been disclosed to the department prior to the date of<\/p>\n<p>search. The assessee had earned capital gain which were reflected<\/p>\n<p>in the balance sheet as on 31st March, 1998 and the said balance<\/p>\n<p>sheet was filed with the department alongwith the return of income<\/p>\n<p>for the assessment year 1998-99. On this basis it was argued that<\/p>\n<p>when the investment in the shares in question on which capital gain<\/p>\n<p><span class=\"hidden_text\">ITA 811 OF 2007,ITA 818 OF 2007,ITA 378 OF 2008,                         Page 3 of 14<\/span><br \/>\nITA 742 OF 2007ITA 416 OF 2008<br \/>\n was realized by the assessee had been shown in the balance sheet<\/p>\n<p>filed by the assessee prior to the date of search, it could not be<\/p>\n<p>presumed that capital gain derived from the sale of said shares<\/p>\n<p>would not have been shown by the assessee.                   This plea of the<\/p>\n<p>assessee has been accepted by the Tribunal and validity of these<\/p>\n<p>reasons on which addition is deleted, is the question before us. Few<\/p>\n<p>dates which are relevant for this purpose are noted below:-<\/p>\n<pre>\uf0b7         Return for the concerned assessment\n          year was due on                                        - 31.12.1999\n\n\uf0b7         Search operation carried out on                         -31.1.2000\n\n\uf0b7         Return filed under Section 139 (4) of the Act on   - 31.3.2000\n<\/pre>\n<p>          This return was processed under Section 143 (1)of the Act.<\/p>\n<p>4.        Some of the provisions of Income Tax Act which are to be kept<\/p>\n<p>in mind while answering the questions are as under:-<\/p>\n<blockquote><p>          (1)As per Section 139 of the Act, every person whose<\/p>\n<p>               total income in respect of which he is assessable<\/p>\n<p>               under the Act during the previous year exceeds the<\/p>\n<p>               maximum amount which is not chargeable to income-\n<\/p><\/blockquote>\n<blockquote><p>               tax,      is required to file the income tax return on or<\/p>\n<p>               before the due date in the prescribed from and<\/p>\n<p>               verified in the prescribed manner.<\/p><\/blockquote>\n<p>          (2)After the return is filed, for the purpose of making<\/p>\n<p>               assessment, the Assessing Officer may serve notice<\/p>\n<p>               under Section 142 (1) of the Act.       However, if it is<\/p>\n<p>               found that such a person has not made a return<\/p>\n<p>               within the time allowed under sub Section (1) of<\/p>\n<p>               Section 138, Clause (i) of sub Section (1) of Section<\/p>\n<p><span class=\"hidden_text\">ITA 811 OF 2007,ITA 818 OF 2007,ITA 378 OF 2008,                Page 4 of 14<\/span><br \/>\nITA 742 OF 2007ITA 416 OF 2008<br \/>\n                142 of the Act                  authorizes the Assessing Officer to<\/p>\n<p>               serve a notice regarding such defaulting person to<\/p>\n<p>               furnish a return of his income by the dates specified<\/p>\n<p>               therein.          If the return is not filed within the time<\/p>\n<p>               allowed under Section 131 (1) or under a notice<\/p>\n<p>               issued under Section (1) of Section 142, such person<\/p>\n<p>               may still furnish the return of previous year at any<\/p>\n<p>               time before the expiry of one year from the end of the<\/p>\n<p>               relevant assessment year or before the completion of<\/p>\n<p>               assessment, whichever is earlier.\n<\/p>\n<\/p>\n<p>5.        Chapter-XIV B of the Act, which was inserted by the Finance<\/p>\n<p>Act, 1995              w.e.f. 1st July, 1995 deals              with said procedure for<\/p>\n<p>assessment of search cases and it starts with Section 158B which<\/p>\n<p>provides certain definitions for the said Chapter. Clause (a) thereof<\/p>\n<p>defines \u201eblock period\u201f. Clause (b) gives the definition of \u201eundisclosed<\/p>\n<p>income\u201f and reads as under:-\n<\/p>\n<\/p>\n<blockquote><p>                        &#8220;\u201fundisclosed income\u201f includes any money,<br \/>\n                        bullion, jewellery or other valuable article or<br \/>\n                        thing or any income based on any entry in the<br \/>\n                        books of account or other documents or<br \/>\n                        transactions, where such money, bullion,<br \/>\n                        jewellery, valuable article, thing, entry in the<br \/>\n                        books of account or other document or<br \/>\n                        transaction represents wholly or partly income or<br \/>\n                        property which has not been or would not have<br \/>\n                        been disclosed for the purpose of this Act, or any<br \/>\n                        expense, deduction or allowance claimed under<br \/>\n                        this Act which is found to be false.&#8221;\n<\/p><\/blockquote>\n<p>6.        Section 158BA deals with assessment of undisclosed income as<\/p>\n<p>a result of search Section 158BB enumerates the procedure for<\/p>\n<p>computation of undisclosed income for the block period. Sub Section<\/p>\n<p>(1) thereof mandates that the undisclosed income of the block period<\/p>\n<p><span class=\"hidden_text\">ITA 811 OF 2007,ITA 818 OF 2007,ITA 378 OF 2008,                          Page 5 of 14<\/span><br \/>\nITA 742 OF 2007ITA 416 OF 2008<br \/>\n shall be the aggregate of total income of the previous years falling<\/p>\n<p>within the block period computed, in accordance with the provisions<\/p>\n<p>of this Act, on the basis of evidence found as a result of search or<\/p>\n<p>requisition of books of accounts or other documents and such other<\/p>\n<p>material or information as are available with the Assessing officer<\/p>\n<p>and relatable to such evidence, as reduced by the aggregated of the<\/p>\n<p>total income, or as the case may be, as increased by the aggregate<\/p>\n<p>of losses of such previous years. Clause (c) of sub section (1) deals<\/p>\n<p>with the situation where the due date for filing a return has expired<\/p>\n<p>but no return of income has been filed. In that case income can be<\/p>\n<p>determined on the basis of the records mentioned therein.<\/p>\n<p>7.        In the present case, as noted above, due date by which the<\/p>\n<p>return was to be filed was 31st December, 1999 but return was not<\/p>\n<p>filed as on that date.                       Within a few days thereafter i.e.    on 30th<\/p>\n<p>January, 2000 search operation was carried out. Return was filed on<\/p>\n<p>31st March, 2000. However, it was within the time stipulated under<\/p>\n<p>Section 139 (4) of the Act. According to the Assessing Officer, since<\/p>\n<p>the return was not filed within the stipulated date, the disclosure of<\/p>\n<p>long term capital gain in the said return filed after warrants could not<\/p>\n<p>be taken into consideration, more so, as till the date of search no<\/p>\n<p>return was filed. In the opinion of the Assessing Officer, therefore, the<\/p>\n<p>assessment could be made under Section 158 BB of the Act on the<\/p>\n<p>basis of seized documents, as if no return was filed.                   The contention<\/p>\n<p>of the assessee that income may be treated as disclosed was not<\/p>\n<p>accepted on the basis of the following discussion:-<\/p>\n<blockquote><p>          &#8220;I do not agree with the submission made by the<br \/>\n          assessee. A provision contained in a section under any<br \/>\n          chapter cannot be interpreted in isolation, rather it<\/p>\n<p><span class=\"hidden_text\">ITA 811 OF 2007,ITA 818 OF 2007,ITA 378 OF 2008,                         Page 6 of 14<\/span><br \/>\nITA 742 OF 2007ITA 416 OF 2008<br \/>\n           should be interpreted keeping in mind all other provisions<br \/>\n          of that chapter. Provisions of section 158B are contained<br \/>\n          in Chapter XIV-B which also contains section 158 BA and<br \/>\n          158 BB.              Section 158 BA lays down procedure for<br \/>\n          assessment of undisclosed income as a result of search.<br \/>\n          The section starts with the words &#8220;Notwithstanding<br \/>\n          anything contained in any other provisions of this Act&#8230;.<br \/>\n          the         Assessing Officer shall proceed to assess the<br \/>\n          undisclosed income in accordance with the provisions of<br \/>\n          this Chapter&#8221;. Section 158 BB gives the procedure for<br \/>\n          computation of undisclosed income of the block period<br \/>\n          and is also contained in Chapter XIV-B. As per Section<br \/>\n          158 BA therefore, the provisions of section 158 BB have<br \/>\n          to be applied for computation of undisclosed income. I<br \/>\n          will like to quote the decision of the Hon\u201fble Calcutta High<br \/>\n          Court in the case of Shaw Wallace &amp; Co. Ltd. Vs. ACIT<br \/>\n          (1999, 238, ITR 13) which is as under:-\n<\/p><\/blockquote>\n<blockquote><p>                    &#8221; It will be found from section 158 BB that the<br \/>\n                    Assessing Officer is to compute total income<br \/>\n                    twice. One has to emphasise the combination<br \/>\n                    of words \u201etotal income\u201f. The First computation<br \/>\n                    of total income under section 158BB is on an<br \/>\n                    aggregate of materials including returns. The<br \/>\n                    second computation of total income is as per<br \/>\n                    direction and definition given in section 158 BB<br \/>\n                    irrespective of whatever might be contained in<br \/>\n                    the other provisions of the Act. That such<br \/>\n                    computation of the second total income is to be<br \/>\n                    made irrespective of other provisions is seen<br \/>\n                    from the words of section 158BA, which states<br \/>\n                    that the Assessing Officer must proceed to<br \/>\n                    assess the undisclosed income as per section<br \/>\n                    158 BB notwithstanding any other provisions<br \/>\n                    contained in the Act.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>                    From the discussion above, I am of the view that<br \/>\n                    the returned income of the assessee for A.Y.<br \/>\n                    1999-00 is to be taken at NIL for the purposes of<br \/>\n                    calculating of undisclosed income under the<br \/>\n                    provisions of section 158 BB (1)(c). This will<br \/>\n                    result in determination of undisclosed income at<br \/>\n                    ` 8,67,010\/- calculated as under&#8230;&#8221;\n<\/p><\/blockquote>\n<\/blockquote>\n<p><span class=\"hidden_text\">ITA 811 OF 2007,ITA 818 OF 2007,ITA 378 OF 2008,                Page 7 of 14<\/span><\/p>\n<blockquote><p>ITA 742 OF 2007ITA 416 OF 2008\n<\/p><\/blockquote>\n<p> 8.        The Income Tax Appellate Tribunal, on the other hand,               has<\/p>\n<p>held that as a return of income was filed under Section 139 of the<\/p>\n<p>Act, wherein capital gains on the sale of shares were disclosed, it is<\/p>\n<p>to be treated as return filed within the permissible limits and the<\/p>\n<p>assessment could not take place under Section 158 BB (1) (c) of the<\/p>\n<p>Act.\n<\/p>\n<\/p>\n<p>9.        The Tribunal relied upon the judgment of this Court in CIT Vs.<\/p>\n<p>Mrs. Kum Kum Kohli, 276 ITR 589.                   We may state at the outset<\/p>\n<p>that the decision of Mrs. Kumkum Kohli (supra) cannot be the sole<\/p>\n<p>basis for determining the real controversy. That was a case where<\/p>\n<p>this Court upheld the decision of the Tribunal in Mrs.Kumkum<\/p>\n<p>(supra). The assessee had paid advance tax much before the date of<\/p>\n<p>search and the capital gains earned during the assessment year,<\/p>\n<p>though the return was not filed and had also disclosed the said<\/p>\n<p>transaction in the books of accounts. On this basis, it was held that<\/p>\n<p>the income returned by the assessee disclosed the aforesaid income<\/p>\n<p>and thus the provisions of Chapter XIV B were not applicable as<\/p>\n<p>nothing new was found during the search.\n<\/p>\n<\/p>\n<p>10.       Having regard to the fact that much before the date of search<\/p>\n<p>advance tax had been paid and, therefore, it cannot be said that the<\/p>\n<p>assessee would not have disclosed such amounts in the return to be<\/p>\n<p>filed, for which the period had not expired, it was observed as under:<\/p>\n<blockquote><p>                    &#8220;At the time of hearing, ld. AR for the assessee<br \/>\n                    while taking us through the paper books<br \/>\n                    demonstrated that the shares in question which<br \/>\n                    were sold was already disclosed to the<br \/>\n                    department prior to the date of search. The<br \/>\n                    assessee earned capital gain which was reflected<br \/>\n                    in the balance sheet as on 31.3.1998 and that the<br \/>\n                    said balance sheet was filed with the department<br \/>\n                    alongwith the return of income for the AY 1998-\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">ITA 811 OF 2007,ITA 818 OF 2007,ITA 378 OF 2008,               Page 8 of 14<\/span><\/p>\n<p>ITA 742 OF 2007ITA 416 OF 2008\n<\/p>\n<p>                     99. Acknowledgement for filing of the return of<br \/>\n                    income for the AY 1998-99 on 30th December,<br \/>\n                    1999 has been filed at page 39 of the paper book.<br \/>\n                    In the circumstances, we are of the considered<br \/>\n                    opinion that when the investment in shares in<br \/>\n                    question on which capital gain was realized by the<br \/>\n                    assessee had been shown I the balance sheet<br \/>\n                    filed by the assessee, prior to the date of search,<br \/>\n                    it cannot be assumed that capital gain derived on<br \/>\n                    the sale of such shares would have been shown by<br \/>\n                    the assessee. In the above circumstances, in<br \/>\n                    view of the order of the Delhi High Court in the<br \/>\n                    case of CIT Vs Mrs. Kumkum Kohli, 276 ITR 589<br \/>\n                    (Del) (supra), in our considered opinion, capital<br \/>\n                    gains on such shares cannot be treated as<br \/>\n                    undisclosed income of the assessee           under<br \/>\n                    Chapter XIV B of the Act. Hence, we set aside the<br \/>\n                    orders of the Ld. CIT (A) and allow the ground of<br \/>\n                    appeal of the assessee.&#8221;\n<\/p>\n<\/p>\n<p>11.       In the present case, the search has taken place after the last<\/p>\n<p>date of filing the return under Section 139 (1) of the Act. There is no<\/p>\n<p>overt act on the part of the assessee which would indicate that<\/p>\n<p>assessee had the intention to disclose the income. On the contrary,<\/p>\n<p>when the aforesaid documents relating to the sale of shares leading<\/p>\n<p>to income in the form of long term capital gain were seized during<\/p>\n<p>the search on 13th January, 2000, it is thereafter that return was filed<\/p>\n<p>on 13.1.2000 disclosing this transaction. However, this return is filed<\/p>\n<p>under Section 139 (4) of the Act i.e. within the time stipulated in the<\/p>\n<p>notice issued by the Assessing Officer but after the date of search<\/p>\n<p>and after the expiry of normal date for filing the return. In such a<\/p>\n<p>situation, can it be said that the filing of the return relates back to<\/p>\n<p>the original date by which the return is to be filed. Answer to this has<\/p>\n<p>to be in the negative in view of the two judgments &#8211; one of Madhya<\/p>\n<p>Pradesh High Court and other of Madras High Court with which we<\/p>\n<p>concur.         In the case of Dr. Brijesh Lahoti Vs. CIT, 282 ITR 349,<\/p>\n<p>Madhya Pradesh High Court, held as under:-<\/p>\n<p><span class=\"hidden_text\">ITA 811 OF 2007,ITA 818 OF 2007,ITA 378 OF 2008,               Page 9 of 14<\/span><br \/>\nITA 742 OF 2007ITA 416 OF 2008<br \/>\n                     &#8220;9.Mr.Chaphekar, learned senior counsel appearing<br \/>\n                    for appellant, submitted that there may be cases<br \/>\n                    outside Sub-section (3) of Section 158BA of the Act<br \/>\n                    where it can be held that income of the assessee<br \/>\n                    has been disclosed. In fact, he relied on the<br \/>\n                    Division Bench judgment of the Madras High Court<br \/>\n                    in the case of A.R. Enterprises (supra) in support of<br \/>\n                    his submission in which payment of advance tax<br \/>\n                    before the date of search, even in a case where no<br \/>\n                    return had been filed under Section 139(1) of the<br \/>\n                    Act, has been held to be a case where income has<br \/>\n                    been disclosed.\n<\/p>\n<p>                    10. We agree with Mr. Chaphekar, learned senior<br \/>\n                    counsel for appellant, that where the assessee<br \/>\n                    discloses his income to the Department before the<br \/>\n                    date of search in some manner or the other, it may<br \/>\n                    be difficult to hold that such income is to be<br \/>\n                    treated as undisclosed income for the purpose of<br \/>\n                    assessment in accordance with Chapter XIV-B of<br \/>\n                    the Act. In A.R. Enterprises (supra), the Division<br \/>\n                    Bench of the Madras High Court has found that<br \/>\n                    search had taken place on 23rd Feb., 1996, but for<br \/>\n                    the asst. yr. 1995-96 even though the assessee<br \/>\n                    had not filed the return, it had paid advance tax of<br \/>\n                    Rs. 4,80,000 in three instalments on 15th Sept.,<br \/>\n                    1994, 12th Dec., 1994 and 15th March, 1995 much<br \/>\n                    before search and the Division Bench accordingly<br \/>\n                    held that the income of the assessee in that case<br \/>\n                    cannot be treated to be as &#8216;undisclosed income&#8217; for<br \/>\n                    the purpose of assessment under Chapter XIV-B of<br \/>\n                    the Act. But, in the present case, the search took<br \/>\n                    place on 20th Dec., 1996 and there was no<br \/>\n                    material to show that before 20th Dec., 1.996 the<br \/>\n                    appellant had in any manner disclosed his income<br \/>\n                    to the authorities under the Act. Thus, even if we<br \/>\n                    accept the contention of Mr. Chaphekar learned<br \/>\n                    senior counsel, that Sub-section (3) of Section<br \/>\n                    158BA of the Act is not exhaustive of the cases in<br \/>\n                    which income should not be treated as undisclosed<br \/>\n                    income, in the present case, we find no material to<br \/>\n                    establish that the appellant had, in any manner,<br \/>\n                    disclosed his income for the purpose of the Act<br \/>\n                    before the date of search on 20th Dec., 1996.<\/p>\n<p>12.       Before Madras High Court, the issue cropped up, albeit in other<\/p>\n<p>context where the provisions and constitutionality of Section 158 BB<\/p>\n<p>of the Act was challenged. It was argued that once the return is not<\/p>\n<p>filed after the due date under Section 139 (1), before the expiry of<\/p>\n<p><span class=\"hidden_text\">ITA 811 OF 2007,ITA 818 OF 2007,ITA 378 OF 2008,                Page 10 of 14<\/span><br \/>\nITA 742 OF 2007ITA 416 OF 2008<br \/>\n period specified in Section 139 (4) and the search take place before<\/p>\n<p>filing of the return, the assessee would lose the benefit of filing the<\/p>\n<p>return under Section 139 (4) of the Act and therefore provisions of<\/p>\n<p>Section 158BB were ultra vires and unconstitutional. This contention<\/p>\n<p>was rejected and relevant observations of the Court dealing with this<\/p>\n<p>contention are as under:\n<\/p>\n<\/p>\n<blockquote><p>                   &#8220;Learned counsel for the petitioner contended that<br \/>\n                   this provision is unconstitutional as it has the effect<br \/>\n                   of depriving an honest assessee the several<br \/>\n                   deductions allowable under other provisions of the<br \/>\n                   Act even in cases where an assessee has, by<br \/>\n                   relying on Section 139(4), filed a return of income<br \/>\n                   after the due date specified in Section 139(1), but<br \/>\n                   before the expiry of the period specified in Section<br \/>\n                   139(4). Section 139(4) enables a person who has<br \/>\n                   not filed a return within the time allowed under<br \/>\n                   Section 139(1) or under a notice issued under<br \/>\n                   Section 142(1) to furnish the return for any<br \/>\n                   previous year at any time before the expiry of one<br \/>\n                   year from the end of the relevant assessment year<br \/>\n                   or before the completion of the assessment,<br \/>\n                   whichever is earlier.\n<\/p><\/blockquote>\n<blockquote><p>                    The petitioner in this case had not filed his return<br \/>\n                   for the assessment year 1994-95 as also for the<br \/>\n                   assessment year 1995-96 on or before August 31,<br \/>\n                   1994, and August 31, 1995, respectively. The<br \/>\n                   search was conducted in his premises on January<br \/>\n                   18, 1996. Thereafter the assessment was made for<br \/>\n                   the block period by taking into account the amount<br \/>\n                   ascertained as having been not disclosed at the<br \/>\n                   time of search and adding thereto, the income<br \/>\n                   shown in the return filed by the assessee on March<br \/>\n                   29, 1996, after search. According to the assessee,<br \/>\n                   the inclusion of the income shown in the returns<br \/>\n                   filed within the extended date provided under<br \/>\n                   Section 139(4) has the effect of depriving&#8221; the<br \/>\n                   petitioner of the valuable right conferred on him by<br \/>\n                   Section 139(4) and, therefore, Section 158BB(1)(c)<br \/>\n                   is arbitrary, ultra vires the Act and unconstitutional.\n<\/p><\/blockquote>\n<blockquote><p>                    The provision with which we are concerned is a<br \/>\n                   provision in a taxing statute. It is open to<br \/>\n                   Parliament to classify the taxpayers on any rational<br \/>\n                   basis ; also treat the different classes of taxpayers<br \/>\n                   differently. It is also permissible for Parliament to<br \/>\n                   classify in a rational and non-arbitrary manner, the<br \/>\n                   assessees further in relation to their conduct.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">ITA 811 OF 2007,ITA 818 OF 2007,ITA 378 OF 2008,                 Page 11 of 14<\/span><\/p>\n<p>ITA 742 OF 2007ITA 416 OF 2008<br \/>\n                    Parliament can legislate with respect to the<br \/>\n                   assessees who comply with the requirements of law<br \/>\n                   and extend such concessions as it deems fit to such<br \/>\n                   assessees, which concessions it may choose to<br \/>\n                   deny to those who have violated the law and such<br \/>\n                   violations have been established by reason of the<br \/>\n                   action taken by the authorities. It is in that<br \/>\n                   background and with the object of laying down a<br \/>\n                   special procedure for the assessment of the<br \/>\n                   assessees who fail to comply with the law by not<br \/>\n                   disclosing in full their taxable income and by not<br \/>\n                   paying the taxes properly due from them that<br \/>\n                   Chapter XIV-B consisting of sections 158B &amp; 158BH<br \/>\n                   was inserted in the Income-tax Act by the Finance<br \/>\n                   Act, 1995, with effect from July 1, 1995.\n<\/p>\n<p>                   The assumption made in the scheme of the Act that<br \/>\n                   a person who comes forward with the return or with<br \/>\n                   further information after a search, does so only on<br \/>\n                   account of the detection already effected under the<br \/>\n                   search and the likelihood of further exposure is a<br \/>\n                   reasonable assumption and it can in no way be<br \/>\n                   regarded as arbitrary. The special procedure<br \/>\n                   provided in Chapter XIV-B is meant to apply to all<br \/>\n                   such cases notwithstanding anything contained in<br \/>\n                   any other provisions of the Act, as provided in<br \/>\n                   Section 158BA(1), and the other provisions of the<br \/>\n                   Act, therefore cannot control the contents of this<br \/>\n                   Chapter except to the extent provided for in<br \/>\n                   Chapter XIV-B.\n<\/p>\n<p>                    There is no fundamental right in an assessee to<br \/>\n                   commit breaches of the law. The right that can be<br \/>\n                   asserted by one who has chosen to violate the law<br \/>\n                   is the right to be treated in a manner similar to that<br \/>\n                   in which other similar offenders are treated.<br \/>\n                   Chapter XIV-B accords similar treatment to all<br \/>\n                   persons belonging to the class for whom that<br \/>\n                   Chapter is to apply. There is no discrimination<br \/>\n                   therein among those who suffer such searches.&#8221;<\/p>\n<p>13.       We may, however, clarify that in the aforesaid case, the Madras<\/p>\n<p>High Court also observed that mere payment of advance tax by dates<\/p>\n<p>would not establish and intend to disclose the income and the<\/p>\n<p>disclosure is to be made by filing the return.             However, with this<\/p>\n<p>observation we would not agree, having regard to the judgment of<\/p>\n<p>this court in Mrs. Kumkum Kohli (supra).\n<\/p>\n<\/p>\n<p>14.       We thus summarize the position as under:-<\/p>\n<p><span class=\"hidden_text\">ITA 811 OF 2007,ITA 818 OF 2007,ITA 378 OF 2008,                Page 12 of 14<\/span><br \/>\nITA 742 OF 2007ITA 416 OF 2008\n<\/p>\n<p>                (a) Where the stipulated date of filing the return of<br \/>\n                    income as prescribed under Section 139 (1)of the<br \/>\n                    Act is over and return is not filed, it has to be<br \/>\n                    normally held that the income has not been<br \/>\n                    disclosed for the purpose of this Act.\n<\/p>\n<\/p>\n<p>               (b) If the search takes place under Section 132 of the<br \/>\n                    Act and by that date return is not filed, and the date<br \/>\n                    of filing the normal return has expired, filing of the<br \/>\n                    return thereafter under Section 139 (4) of the Act<br \/>\n                    would be of no consequence for the applicability of<br \/>\n                    Chapter XIV B of the Act.\n<\/p>\n<p>               (c) Even if the return              is not filed but the assessee is<\/p>\n<p>                    able to demonstrate that he had disclosed his<\/p>\n<p>                    income to the department before the date of search<\/p>\n<p>                    in the some manner or the other, it would not be<\/p>\n<p>                    treated           undisclosed income for the purpose of<\/p>\n<p>                    assessment in accordance with the Chapter XIV B<\/p>\n<p>                    of the Act.\n<\/p>\n<p>               (d)Payment of advance tax would be one such step<\/p>\n<p>                    which would warrant inference that the assessee<\/p>\n<p>                    had disclosed his income to the department.<\/p>\n<p> 15. Applying the aforesaid principles in these cases, we are of the<\/p>\n<p> opinion that it cannot be said that the assessee had made disclosure<\/p>\n<p> of the long term capital gain before the date of search and as the<\/p>\n<p> time for filing the return had expired by that time, the provisions of<\/p>\n<p> Section 158 BB (1 (c) of the Act were rightly applied by the<\/p>\n<p> Assessing Officer.\n<\/p>\n<\/p>\n<p> 16. Learned counsel for the respondent has sought to argue that<\/p>\n<p> during the search provisional balance sheet was found which<\/p>\n<p><span class=\"hidden_text\">ITA 811 OF 2007,ITA 818 OF 2007,ITA 378 OF 2008,                         Page 13 of 14<\/span><br \/>\nITA 742 OF 2007ITA 416 OF 2008<br \/>\n  contained profit shown on account of sale of the said shares and,<\/p>\n<p> therefore, it be treated as disclosure.                     Such provisional balance<\/p>\n<p> sheet which was within the possession of the assessee at the time of<\/p>\n<p> search would not meet the test of &#8220;disclosure\u201f. As mentioned above<\/p>\n<p> the overt act has to be of the nature from which it can be concluded<\/p>\n<p> that the assessee had disclosed the income to the department<\/p>\n<p> before the date of search in                      some form like payment of advance<\/p>\n<p> tax, etc.<\/p>\n<p> 17. We thus do not agree with the approach of the Tribunal and set<\/p>\n<p> aside the order of the Tribunal of by answering the question of law in<\/p>\n<p> favour of the Revenue and against the assessee.<\/p>\n<p>                                                                    (A.K.
