The issue is regarding the filling up of sanctioned<\/p>\n<p>strength of the post of Lecturer in the Economics Department.<\/p>\n<p>Exhibit P9 is the order passed by the Government wherein the<\/p>\n<p>view taken is that the request for one more post in Economics<\/p>\n<p>and Chemistry cannot be considered and the same is rejected.<\/p>\n<p>     2.    The petitioner&#8217;s case is that going by the work load<\/p>\n<p>assessment and fixation of staff strength of teaching staff for the<\/p>\n<p>year 2008-09 approved by the University as per Exhibit P2, three<\/p>\n<p>teachers have been permitted for the Economics Department and<\/p>\n<p>thereafter the petitioner moved the Government for concurrence<\/p>\n<p>for permanent appointment showing one retirement vacancy in<\/p>\n<p>Economics along with the vacancies in other Departments.<\/p>\n<p>Exhibit P4 is the order passed by the Government lifting the ban<\/p>\n<p>of appointment of teachers in aided Colleges and granting<\/p>\n<p>permission for filling up of vacancies. Therein, the petitioner&#8217;s<\/p>\n<p>College was not included. This led to the petitioner filing another<\/p>\n<p><span class=\"hidden_text\">W.P.(C)No.27451\/09                -2-<\/span><\/p>\n<p>representation pursuant to which the Government passed an<\/p>\n<p>order as per Exhibit P6. Therein the permission was only for<\/p>\n<p>filling up two vacancies in Physics, one vacancy in Zoology, one<\/p>\n<p>vacancy of Mechanic and one vacancy of Herbarium Keeper. The<\/p>\n<p>petitioner submitted Exhibit P7 representation claiming one more<\/p>\n<p>post in Economics Department by claiming 40 hours of work load<\/p>\n<p>in the Department.       This Court by Exhibit P8 directed the<\/p>\n<p>Government to take a fresh decision, pursuant to which Exhibit<\/p>\n<p>P9 decision was taken.\n<\/p>\n<p>       3.   In Exhibit P9, the view taken mainly is that in the staff<\/p>\n<p>fixation statement placed before the High Level Committee, work<\/p>\n<p>load of the Economics Department is shown as 34 hours due to<\/p>\n<p>the reason that six hours work load for Statistics Paper for<\/p>\n<p>B.A.Economics is allotted to Statistics Department.             The<\/p>\n<p>argument of the Principal-petitioner that the work load has to be<\/p>\n<p>calculated in terms of the provisions of the University Ordinance<\/p>\n<p>by reckoning the work load of Statistics along with Economics<\/p>\n<p>was not accepted.\n<\/p>\n<p>       4.   The petitioner contends that as far as the said six<\/p>\n<p>hours are concerned, the paper Quantitative Methods for<\/p>\n<p><span class=\"hidden_text\">W.P.(C)No.27451\/09               -3-<\/span><\/p>\n<p>Economic Analysis is taught by the teachers in Economics<\/p>\n<p>Department itself and it cannot therefore be reckoned for the<\/p>\n<p>purpose of Statistics Department.         As far as Statistics<\/p>\n<p>Department is concerned, one post of Lecturer has been<\/p>\n<p>sanctioned and there are nine hours of work load for that<\/p>\n<p>Department.      In this context, the petitioner relies upon the<\/p>\n<p>decision of the Board of Studies of the University taken on<\/p>\n<p>21.10.1995. Therein, the Board of Studies was of the view that<\/p>\n<p>at present there are no Statistics paper as such and therefore<\/p>\n<p>Statistics teachers have no claim and the Board requested the<\/p>\n<p>University    to give necessary direction to the Principals of<\/p>\n<p>Colleges that Quantitative Methods for Economic Analysis should<\/p>\n<p>be taught only by Economics Teachers.       Apart from that, the<\/p>\n<p>learned counsel for the petitioner Shri Santhosh Mathew<\/p>\n<p>submitted that it was for the University to finalise the work load<\/p>\n<p>assessment based on the requirement of the College and going<\/p>\n<p>by Exhibit P2, it can be seen that as far as Economics<\/p>\n<p>Department is concerned, considering the working hours as 40,<\/p>\n<p>three posts of Lecturers in Economics have been sanctioned by<\/p>\n<p>the University. Further it is pointed out that the Government is<\/p>\n<p><span class=\"hidden_text\">W.P.(C)No.27451\/09                 -4-<\/span><\/p>\n<p>bound by the said proceedings taken by the University especially<\/p>\n<p>in the light of the Division Bench decision of this Court in <a href=\"\/doc\/1466069\/\">State<\/p>\n<p>of Kerala v. Dr.Sina<\/a> (2007(3) KLT 96).\n<\/p>\n<p>      5.    There cannot be any dispute that it is upto the<\/p>\n<p>University to fix the work load while sanctioning the staff<\/p>\n<p>strength.    The legal position that is declared by the Division<\/p>\n<p>Bench in Dr.Sina&#8217;s case (supra) is available in paragraph 10,<\/p>\n<p>which shows the following:\n<\/p>\n<blockquote><p>      &#8220;10. Scope of S.57(2) of the Kerala University Act has to<\/p>\n<p>      be tested in the light of the above mentioned statutory<\/p>\n<p>      provisions. Power of the University in granting approval as<\/p>\n<p>      well as sanctioning posts after ascertaining the workload<\/p>\n<p>      and fixation of staff pattern as per the Statutes has not<\/p>\n<p>      been taken away by the University Amendment Act 2 of<\/p>\n<p>      2005.    Clear cut provisions have been made in the<\/p>\n<p>      University Statutes and Ordinances as to how the workload<\/p>\n<p>      has to be assessed and staff strength fixed so as to avoid<\/p>\n<p>      unnecessary appointments.     Further, the interest of the<\/p>\n<p>      students is also to be safeguarded by appointing sufficient<\/p>\n<p>      number of teachers without delay. Power is also conferred<\/p>\n<p>      on the Deputy Director of Collegiate Education to take up<\/p>\n<p>      the matter with the University in case there is any doubt<\/p>\n<p>      with the approval granted.         In appropriate cases<\/p>\n<p>      Government can also examine the action taken by the<\/p>\n<p>      Deputy Director and address the University through him.&#8221;<\/p><\/blockquote>\n<p><span class=\"hidden_text\">W.P.(C)No.27451\/09                -5-<\/span><\/p>\n<p>      6.    Herein, the stand of the University is also evident from<\/p>\n<p>the proceedings Exhibit P2. The method adopted herein by the<\/p>\n<p>High Level Committee appears to be not to reckon the six hours<\/p>\n<p>along with 34 hours of Economics and by reckoning them with<\/p>\n<p>the Statistics Department.      The said reason has resulted in<\/p>\n<p>passing Exhibit P9.\n<\/p>\n<p>      7.    Evidently, the proceedings of the University have not<\/p>\n<p>been considered by the Government. Therefore, Exhibit P9 is<\/p>\n<p>quashed.     There will be a direction to the Government to<\/p>\n<p>reconsider the matter in the light of Exhibit P2.
