Sharma for Assistant<br \/>\n\tLabour Commissioner and Additional Collector, Ahmedabad. Learned<br \/>\n\tAdvocate Mr. RA Mishra is appearing for respondent NO.4 Vajubhai M.<br \/>\n\tDhodia, Municipal Councilor.\n<\/p>\n<p>\tBrief<br \/>\n\tfacts of present petition are as under:\n<\/p>\n<p>\t\tPetitioner<br \/>\n\twas initially appointed on post of Clerk on daily wages with<br \/>\n\tRespondent No.1 Municipality with effect from 15.11.1990 and,<br \/>\n\tthereafter, his service was terminated by oral order dated 10th<br \/>\n\tAugust, 1992 against which he has approached Labour Court by way of<br \/>\n\tReference (LCA) NO.2540 of 1992 before Ahmedabad Labour Court.<br \/>\n\tDuring pendency of said reference, proposal was given by Viramgam<br \/>\n\tMunicipality and on that basis, it was agreed upon both parties to<br \/>\n\treinstate petitioner in service on original post with effect from<br \/>\n\t5.4.1995 and respondent Viramgam Municipality has also agreed to pay<br \/>\n\t50% back wages  for a period from 10.8.1992 to 4.4.1995. Award was<br \/>\n\tpassed by Labour Court in terms of aforesaid settlement on 4th<br \/>\n\tApril, 1995. Accordingly, workman was reinstated by Viramgam<br \/>\n\tMunicipality as daily wager with effect from 22nd May,<br \/>\n\t1995 and thereafter, complaint was made by petitioner to Labour<br \/>\n\tCommissioner that he was not reinstated on permanent post of clerk<br \/>\n\tand on that basis, notice was issued by respondent NO.2 to<br \/>\n\trespondent NO.1 Municipality and thereafter, petitioner was<br \/>\n\tappointed on permanent post of clerk with effect from 1st<br \/>\n\tDecember, 1998 and he is serving as permanent clerk. Respondent NO.4<br \/>\n\thas approached respondent NO.3 Collector with an application to set<br \/>\n\taside aforesaid settlement while exercising powers under section 258<br \/>\n\tof Gujarat Municipalities Act. Collector has set aside order qua<br \/>\n\tresolution by which petitioner was given appointment on permanent<br \/>\n\tbasis and therefore, present petition is filed by petitioner.\n<\/p>\n<p>\tWhen<br \/>\n\tmatter is taken up for hearing, learned Advocate Mr. Bukhari<br \/>\n\tappearing for petitioner has submitted that aforesaid settlement has<br \/>\n\tbeen already implemented by respondent Municipality and workman is<br \/>\n\tworking with respondent Municipality as a permanent clerk with<br \/>\n\teffect from 1st December, 1998 and also received 50 per<br \/>\n\tcent back wages as per terms of settlement. Learned Advocate Mr.<br \/>\n\tFarooqui appearing for respondent Municipality has submitted that<br \/>\n\tunanimous resolution was passed by Municipality on 14th<br \/>\n\tDecember, 1995. Additional Collector has passed order on 4th<br \/>\n\tApril, 1999 while exercising powers under section 258 of the Gujarat<br \/>\n\tMunicipalities Act.\n<\/p>\n<p>\tIn<br \/>\n\tthis matter, affidavit in reply is also filed by respondent<br \/>\n\tMamlatdar, Nagarpalika Ahmedabad, Mr. SG Gamit dated 17.3.2001.<br \/>\n\tFurther affidavit is also filed by petitioner page 51 wherein para 1<br \/>\n\tto 4 are quoted as under:\n<\/p>\n<p>\t 1.\tI say that<br \/>\n\tinitially, I was appointed, with effect from 15.01.1990, on the post<br \/>\n\tof Clerk on daily wages by Respondent NO.1. Thereafter, being<br \/>\n\tsettlement arrived at before the Labour Court, I have been made<br \/>\n\tpermanent on the post of Clerk with effect from 01.12.1998.\n<\/p>\n<p>\t2.\tI say that in past<br \/>\n\talso, the Respondent NO.1 Municipality made services of  various<br \/>\n\tdaily wagers viz. (1) Mahebubmiya Ahmedmiya Malek, (2) Vinod<br \/>\n\tMohanlal Loladiya, (3) Prakash Kanaiyalal Desai, (4) Manubhai<br \/>\n\tKalubhai Parmar, (5) Devalbhai K. Vantiya, (6) Dilip G. Panara, (7)<br \/>\n\tShankar M. Chavda and (8) Hanifsha Akbarsha Madar as per Resolution<br \/>\n\tNO. 6 dated 30.10.1996 passed by the Resolution No.1 Municipality on<br \/>\n\tthe basis of compromise arrived at in complaint (IT) NO. 55 of 1992<br \/>\n\tbefore the Industrial Tribunal, Ahmedabad. Annexed hereto and marked<br \/>\n\tas  ANNEXURE  L<br \/>\n\tis the copy of Award passed by the Tribunal and  ANNEXURE<br \/>\n\t&#8216;M&#8217; IS THE COPY OF<br \/>\n\tResolution dated 30.10.1996. Parikh<\/p>\n<p>13.11.1996<\/p>\n<p>\t3.\tI say that out of the<br \/>\n\taforesaid persons, so far as (1) Bhikhabhai M.Tho9riya, (2) Ashif<br \/>\n\tA.Gilani, (3) Ashok B.Makwana, (4) Minaxi H.Jani and (5) Shankar M.<br \/>\n\tChavda are concerned, their services have been made permanent after<br \/>\n\tI have been given permanent appointment with effect from 01.12.1998.\n<\/p>\n<p>\t4.\tI say that as<br \/>\n\taforesaid, daily wagers have been made permanent by the Respondent<br \/>\n\tNO.1 Municipality and as I have also been made permanent, with<br \/>\n\teffect from 01.12.1998 and the Respondent Municipality also started<br \/>\n\tdeducting Provident Fund as per Nagarpalika Provident Fund Rules as<br \/>\n\twell as Bombay Civil Services Rules, the status of permanent service<br \/>\n\tgiven to the petitioner does not require interference in the<br \/>\n\tinterest of justice. Annexed hereto and marked as  ANNEXURE &#8216; N&#8217;<br \/>\n\tis the copy of Application dated 8.5.2003 along with orders passed<br \/>\n\tby Respondent No.1 Municipality deducting my Provident Fund with<br \/>\n\teffect from 1.4.2003.\n<\/p>\n<p>\tIn<br \/>\n\tview of aforesaid affidavit in reply filed by petitioner and<br \/>\n\tconsidering averments made therein, settlement is fully implemented<br \/>\n\tin favour of petitioner by Viramgam Municipality and with effect<br \/>\n\tfrom 1st December, 1998, petitioner has been made<br \/>\n\tpermanent on the post of Clerk in Municipality. Therefore, according<br \/>\n\tto my opinion, by passage of time, present petition has become<br \/>\n\tinfructuous.  However, in case of any difficulty, either party is<br \/>\n\tgiven liberty. Accordingly, rule is discharged. Interim relief, if<br \/>\n\tany, shall stand vacated.
