{"id":239108,"date":"2011-08-24T00:00:00","date_gmt":"2011-08-23T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/ranjan-paswan-vs-the-state-of-bihar-on-24-august-2011-2"},"modified":"2018-01-08T00:52:14","modified_gmt":"2018-01-07T19:22:14","slug":"ranjan-paswan-vs-the-state-of-bihar-on-24-august-2011-2","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/ranjan-paswan-vs-the-state-of-bihar-on-24-august-2011-2","title":{"rendered":"Ranjan Paswan vs The State Of Bihar on 24 August, 2011"},"content":{"rendered":"<div class=\"docsource_main\">Patna High Court &#8211; Orders<\/div>\n<div class=\"doc_title\">Ranjan Paswan vs The State Of Bihar on 24 August, 2011<\/div>\n<pre>                     IN THE HIGH COURT OF JUDICATURE AT PATNA\n                          Criminal Miscellaneous No.10387 of 2011\n                                         Ranjan Paswan\n                                              Versus\n                                     The State Of Bihar\n                                  ----------------------------------\n<\/pre>\n<p>4   24-08-2011             Heard learned counsel for the petitioner as well as<\/p>\n<p>                 learned Additional Public Prosecutor for the state.<\/p>\n<p>                           Learned counsel for the petitioner points out that the<\/p>\n<p>                 case of the petitioner has already been committed to the court<\/p>\n<p>                 of sessions and so, he seeks permission to make necessary<\/p>\n<p>                 correction in the prayer portion of the bail petition.<\/p>\n<p>                           Permission is accorded.\n<\/p>\n<p>                           Let the prayer portion of the petition be corrected<\/p>\n<p>                 during course of the day.\n<\/p>\n<p>                           Petitioner is husband of the deceased whose marriage<\/p>\n<p>                 had taken place four years ago but allegedly, she was<\/p>\n<p>                 subjected to cruelty and harassment by the petitioner and his<\/p>\n<p>                 other family members on account of non-fulfillment of demand<\/p>\n<p>                 of dowry and subsequently, they killed the deceased and threw<\/p>\n<p>                 the dead body near the river.\n<\/p>\n<p>                           The contention of learned counsel for the petitioner is<\/p>\n<p>                 that as a matter of fact, the deceased committed suicide out of<\/p>\n<p>                 anger and frustration. It is pointed out by him that in the first<\/p>\n<p>                 information report, it has specifically been mentioned by the<\/p>\n<p>                 informant that on 27.04.2008, the deceased and petitioner had<\/p>\n<p>                 attended a marriage ceremony of son of the informant and after<\/p>\n<p>                 the marriage, the deceased was taken to her Sasural by the<br \/>\n<span class=\"hidden_text\">                               -2-<\/span><\/p>\n<p>        petitioner but the deceased was not ready to leave her Mayaka<\/p>\n<p>        and the above-said act of the petitioner annoyed the deceased<\/p>\n<p>        and out of anger, she committed suicide. It is further contended<\/p>\n<p>        by him that after suicide, the petitioner due to fear psychosis,<\/p>\n<p>        threw the dead body of the deceased near a river.<\/p>\n<p>                  Regard being had to the facts and circumstances of<\/p>\n<p>        the case as well as submission of the parties, particularly,<\/p>\n<p>        keeping in mind that sign of strangulation has been found on<\/p>\n<p>        the neck of the deceased, I do not feel it proper to release the<\/p>\n<p>        petitioner on bail.\n<\/p>\n<p>                  Accordingly, prayer for bail of the petitioner in<\/p>\n<p>        connection with Sessions Trial No. 45 of 2011 arising out of<\/p>\n<p>        Kinjar P.S.
