THAKKER, J.\n<\/p>\n<\/p>\n<p>1.       Leave granted.\n<\/p>\n<p><span class=\"hidden_text\">                                                                       2<\/span><\/p>\n<p>2.          The present appeal is directed against<\/p>\n<p>the    judgment       and     order       of     conviction      and<\/p>\n<p>sentence      recorded        by    the        First    Additional<\/p>\n<p>Sessions      Judge,        Ujjain,       Madhya       Pradesh   on<\/p>\n<p>December 2, 1994 in Sessions Trial No.258 of<\/p>\n<p>1993 and confirmed by the High Court of Madhya<\/p>\n<p>Pradesh (Indore Bench) on September 11, 2007 in<\/p>\n<p>Criminal Appeal No.817 of 1994.\n<\/p>\n<p>3.          The case of the prosecution was that<\/p>\n<p>on March 3, 1993 between 7.00 and 8.00 a.m., P-<\/p>\n<p>4    Devi   Singh     was    attacked       by    four    persons,<\/p>\n<p>Ishwar      Singh,    Laxman       Singh,       Dule    Singh    and<\/p>\n<p>Ganpat Singh, accused Nos.1 to 4 respectively.<\/p>\n<p>All the accused were, therefore, charged for<\/p>\n<p>commission of offences punishable under Section<\/p>\n<p>307 read with Section 34, Indian Penal Code,<\/p>\n<p>1860     (IPC).      After    usual       investigation,         the<\/p>\n<p>matter was committed to the Court of Session in<\/p>\n<p>view of charge under Section 307, IPC which was<\/p>\n<p>exclusively triable by a Court of Session.<\/p>\n<p>4.          The learned Judge, vide his Judgment<\/p>\n<p>and Order dated December 2, 1994, held that the<br \/>\n<span class=\"hidden_text\">                                                                 3<\/span><\/p>\n<p>prosecution       was        successful       in       partly<\/p>\n<p>establishing     the    case.         On    the    basis   of<\/p>\n<p>evidence of prosecution witnesses, the trial<\/p>\n<p>Court held that it would be appropriate to give<\/p>\n<p>benefit of doubt to accused Nos.2 to 4 and<\/p>\n<p>accordingly, the trial Court acquitted three<\/p>\n<p>accused. Regarding accused No.1 Ishwar Singh<\/p>\n<p>(appellant herein), the Court ruled that it was<\/p>\n<p>proved `beyond reasonable doubt&#8217; that he had<\/p>\n<p>attacked victim Devi Singh and had administered<\/p>\n<p>knife    blows   on    the   person    of    the    injured.<\/p>\n<p>Accordingly,     the    Court     convicted        appellant-<\/p>\n<p>accused No.1 for an offence punishable under<\/p>\n<p>Section 307, IPC.\n<\/p>\n<p>5.         Regarding     quantum      of    sentence,      the<\/p>\n<p>Court observed that at the time of incident,<\/p>\n<p>Ishwar Singh was aged about 20 years and it was<\/p>\n<p>his first offence. Considering those factors,<\/p>\n<p>the trial Court ordered him to suffer rigorous<\/p>\n<p>imprisonment for three years and to pay a fine<\/p>\n<p>of      Rs.1,000\/-,     in      default,      to      undergo<\/p>\n<p>imprisonment for six months more.<br \/>\n<span class=\"hidden_text\">                                                              4<\/span><\/p>\n<p>6.         The order of conviction and sentence<\/p>\n<p>was challenged by accused No.1-appellant herein<\/p>\n<p>by filing Criminal Appeal No.817 of 1994.               The<\/p>\n<p>High   Court     of   Madhya   Pradesh    (Indore   Bench)<\/p>\n<p>again considered the evidence on record and the<\/p>\n<p>findings recorded by the trial Court and held<\/p>\n<p>that no error either of fact or of law had been<\/p>\n<p>committed by the trial Court and the order of<\/p>\n<p>conviction recorded by the High Court was in<\/p>\n<p>consonance with law.           Regarding sentence also,<\/p>\n<p>the High Court held that it could not be said<\/p>\n<p>that the sentence awarded on the appellant was<\/p>\n<p>excessive or harsh. Accordingly, the appeal was<\/p>\n<p>dismissed. The appellant who was on bail was<\/p>\n<p>directed    to     surrender     and     to   undergo   the<\/p>\n<p>remainder part of the sentence.\n<\/p>\n<p>7.         The said order is challenged in the<\/p>\n<p>present appeal.         On January 15, 2008, notice<\/p>\n<p>was issued by this Court.          On August 13, 2008,<\/p>\n<p>at the oral prayer of learned counsel for the<\/p>\n<p>appellant, injured Devi Singh was ordered to be<\/p>\n<p>joined as party respondent No.2 and notice was<br \/>\n<span class=\"hidden_text\">                                                                    5<\/span><\/p>\n<p>issued to him by making it returnable within<\/p>\n<p>two   weeks.      The   notice       was    served     and    the<\/p>\n<p>injured appeared through a lawyer.<\/p>\n<p>8.         We have heard learned counsel for the<\/p>\n<p>parties.\n<\/p>\n<p>9.         The learned counsel for the appellant<\/p>\n<p>stated     that     during      the        pendency     of    the<\/p>\n<p>proceedings        before        this        Court,      mutual<\/p>\n<p>compromise        has   been     arrived           between    the<\/p>\n<p>parties, i.e. accused-Ishwar Singh on the one<\/p>\n<p>hand and the complainant-victim Devi Singh on<\/p>\n<p>the other hand.\n<\/p>\n<p>10.        An   affidavit       is    also     filed    by    the<\/p>\n<p>appellant-accused        No.1        in     this     Court.    In<\/p>\n<p>paragraph 3, it is sated;\n<\/p>\n<blockquote><p>            &#8220;The accused petitioner and the<br \/>\n      complainant Devi Singh are members of<br \/>\n      the    same   community    and    reside<br \/>\n      permanently in the same village and<br \/>\n      are also related to each other.      Now<br \/>\n      the relations between the accused and<br \/>\n      the complainant and their families are<br \/>\n      cordial and there is no surviving<br \/>\n      dispute   of  any   kind   between   the<br \/>\n      parties.     Father of the accused,<br \/>\n      Shankarlalji    is    uncle    of    the<br \/>\n      complainant. He is very old and due to<br \/>\n      old age he needs to be looked after by<br \/>\n<span class=\"hidden_text\">                                                                   6<\/span><\/p>\n<p>       his son i.e. accused Ishwar Singh. If<br \/>\n       Ishwar Singh is released from jail in<br \/>\n       view of the cordial relations between<br \/>\n       the parties, both the families would<br \/>\n       be able to live together peacefully<br \/>\n       without any ill will&#8221;.\n<\/p><\/blockquote>\n<p>11.          It was, therefore, jointly prayed on<\/p>\n<p>behalf of the parties that the appellant may be<\/p>\n<p>released      by    treating        the   sentence     already<\/p>\n<p>undergone          by    the        appellant-accused        as<\/p>\n<p>sufficient.\n<\/p>\n<p>12.          An affidavit is also filed by victim<\/p>\n<p>Devi Singh wherein he has stated that he is the<\/p>\n<p>complainant-injured.           It    is   stated     that    the<\/p>\n<p>contents in the affidavit filed by appellant<\/p>\n<p>accused      regarding    compromise       between     accused<\/p>\n<p>No.1 and the complainant are true. A prayer was<\/p>\n<p>made by the learned counsel for the parties to<\/p>\n<p>dispose of appeal on the basis of compromise<\/p>\n<p>between the parties.\n<\/p>\n<p>13.          Now,   it   cannot      be   gainsaid    that    an<\/p>\n<p>offence punishable under Section 307, IPC is<\/p>\n<p>not a compoundable offence. Section 320 of the<\/p>\n<p>Code    of    Criminal     Procedure,       1973     expressly<br \/>\n<span class=\"hidden_text\">                                                                 7<\/span><\/p>\n<p>states that no offence shall be compounded if<\/p>\n<p>it is not compoundable under the Code.                 At the<\/p>\n<p>same    time,    however,      while   dealing    with    such<\/p>\n<p>matters, this Court may take into account a<\/p>\n<p>relevant       and     important    consideration        about<\/p>\n<p>compromise between the parties for the purpose<\/p>\n<p>of reduction of sentence.\n<\/p>\n<p>14.        <a href=\"\/doc\/1737163\/\">In Jetha Ram v. State of Rajasthan,<\/a><\/p>\n<p>(2006)     9     SCC    255,    <a href=\"\/doc\/296276\/\">Murugesan     &amp;    Ors.    v.<\/p>\n<p>Ganapathy       Velar,<\/a>     (2001)      10   SCC    504    and<\/p>\n<p>Ishwarlal v. State of M.P., JT 1988 (3) SC 366<\/p>\n<p>(1), this Court, while taking into account the<\/p>\n<p>fact of compromise between the parties, reduced<\/p>\n<p>sentence imposed on the appellant-accused to<\/p>\n<p>already undergone, though the offences were not<\/p>\n<p>compoundable. But it was also stated that in<\/p>\n<p>Mahesh Chand v. State of Rajasthan, AIR 1988 SC<\/p>\n<p>2111,     such       offence     was    ordered     to      be<\/p>\n<p>compounded.\n<\/p>\n<p>15.        In    our    considered     opinion,   it     would<\/p>\n<p>not be appropriate to order compounding of an<br \/>\n<span class=\"hidden_text\">                                                                       8<\/span><\/p>\n<p>offence     not      compoundable           under      the      Code<\/p>\n<p>ignoring      and          keeping        aside         statutory<\/p>\n<p>provisions. In our judgment, however, limited<\/p>\n<p>submission     of     the    learned         counsel     for     the<\/p>\n<p>appellant     deserves       consideration            that     while<\/p>\n<p>imposing substantive sentence, the factum of<\/p>\n<p>compromise    between        the     parties      is    indeed     a<\/p>\n<p>relevant circumstance which, the Court may keep<\/p>\n<p>in mind.\n<\/p>\n<p>16.        In the instant case, the incident took<\/p>\n<p>place     before     more    than       fifteen       years;     the<\/p>\n<p>parties     are     residing       in   one     and     the     same<\/p>\n<p>village     and     they     are     also     relatives.         The<\/p>\n<p>appellant was about 20 years of age at the time<\/p>\n<p>of    commission      of    crime.      It     was     his     first<\/p>\n<p>offence.     After conviction, the petitioner was<\/p>\n<p>taken into custody.            During the pendency of<\/p>\n<p>appeal before the High Court, he was enlarged<\/p>\n<p>on bail but, after the decision of the High<\/p>\n<p>Court, he again surrendered and is in jail at<\/p>\n<p>present. Though he had applied for bail, the<\/p>\n<p>prayer was not granted and he is not released<br \/>\n<span class=\"hidden_text\">                                                                                                  9<\/span><\/p>\n<p>on bail.     Considering the totality of facts and<\/p>\n<p>circumstances, in our opinion, ends of justice<\/p>\n<p>would be met if the sentence of imprisonment<\/p>\n<p>awarded     to   the    appellant                 (Accused                   No.1)           is<\/p>\n<p>reduced to the period already undergone.<\/p>\n<p>17.         For the foregoing reasons, the appeal<\/p>\n<p>deserves to be partly allowed and accordingly<\/p>\n<p>allowed by maintaining the conviction recorded<\/p>\n<p>by    the   trial      court        and            confirmed                      by        the<\/p>\n<p>Appellate Court but by reducing the sentence<\/p>\n<p>already      undergone     by             the             appellant.                        The<\/p>\n<p>sentence of payment of fine is not disturbed.<\/p>\n<p>If the appellant has not paid the amount of<\/p>\n<p>fine, he will pay such amount within four weeks<\/p>\n<p>from today.\n<\/p>\n<p>18.
