Justice M.L.JOSEPH FRANCIS\n\n Dated :23\/09\/2009\n\n O R D E R\n          K.M.JOSEPH &amp; M.L.JOSEPH FRANCIS, JJ.\n        ------------------------------------------------------\n                   W.P.(Crl.)No.376 of 2009\n            ----------------------------------------------\n        Dated, this the 23rd day of September, 2009\n\n                         J U D G M E N T\n<\/pre>\n<p>K.M.Joseph, J.\n<\/p>\n<p>             The writ petition is filed seeking a writ of habeas<\/p>\n<p>corpus or any other writ or direction directing the respondents<\/p>\n<p>2 and 3 to have the body of the detenue Silja Mol before this<\/p>\n<p>Court and to release her from the illegal custody.           The Ist<\/p>\n<p>petitioner is the husband of the alleged detenue and the<\/p>\n<p>second petitioner is the father of the alleged detenue.        Their<\/p>\n<p>case is that the alleged detenue is in the custody of<\/p>\n<p>respondents 4 and 5.\n<\/p>\n<p>            2. Today when the matter came up, we heard the<\/p>\n<p>learned counsel for the petitioner, learned Government<\/p>\n<p>Pleader and learned counsel for respondents 4 and 5 and<\/p>\n<p>also the alleged detenue.\n<\/p>\n<p>            3. The alleged detenue would tell us that she is<\/p>\n<p>not under illegal detention by respondents 4 and 5. According<\/p>\n<p>to her she is a free agent and that she is staying in Banglore<\/p>\n<p>as a paying guest. In fact, the alleged detenue also says that<\/p>\n<p><span class=\"hidden_text\">WPCR 376\/2009                -2-<\/span><\/p>\n<p>she is desirous of having the marriage between the Ist<\/p>\n<p>petitioner and herself dissolved. In view of the fact that there<\/p>\n<p>is no illegal detention by respondents 4 and 5 we are inclined<\/p>\n<p>to close the writ petition.    It is submitted by the learned<\/p>\n<p>Government Pleader that       Crime No.1354\/2009 has been<\/p>\n<p>registered in Narakkal police station. In view of the categoric<\/p>\n<p>statement given by the alleged detenue that she is a free<\/p>\n<p>agent and there is no illegal detention by respondents 4 and 5<\/p>\n<p>we think that it is not necessary to proceed further with the<\/p>\n<p>criminal complaint and we order so.
