Petitioner no.1 herein is<br \/>\nthe Chairman, whereas, petitioner no.2 is the Managing Director.<br \/>\nPetitioner no.3 is the Director of respondent no.1-Bank.\n<\/p>\n<p>3.\tOn<br \/>\n06.10.2001 the Registrar, Co-operative Societies, Gujarat State<br \/>\nremoved the Board of Directors of respondent no.1-Bank and appointed<br \/>\na custodian. However, the same was, subsequently, stayed by the<br \/>\ncompetent authority. Thereafter, respondent no.4 filed a writ<br \/>\npetition before this Court against respondent no.1-bank for taking<br \/>\nover charge back from the custodian. The said petition was disposed<br \/>\nof by this Court with a direction to the Board of Directors to hand<br \/>\nover charge to the custodian back. Thereafter, a Resolution was<br \/>\npassed in the custodian committee to file a suit to recover<br \/>\nRs.20,000\/- from the petitioners in pursuance of which Lavad Case<br \/>\nNo.1194\/2003 came to be filed before the Board of Nominees, Vadodars.<br \/>\nThe said Lavad Case was decreed against the petitioners vide award<br \/>\ndated 18.10.2004.\n<\/p>\n<p>4.\tBeing<br \/>\naggrieved by the said award, the petitioners filed appeal before the<br \/>\nTribunal, which came to be rejected vide impugned order. Hence, this<br \/>\npetition.\n<\/p>\n<p>5.\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record. It appears that the payments in question were made by the<br \/>\npetitioners under a bona fide belief and in the interest of the<br \/>\nSociety. There does not appear to be any mala fide intention on the<br \/>\npart of the petitioners to misappropriate the funds. Hence, in my<br \/>\nopinion, the petitioner could not be punished with &#8216;disqualification&#8217;<br \/>\nunder the Act since it appears to be a bona fide mistake on the part<br \/>\nof the petitioners. Therefore, the petitioners cannot be penalized by<br \/>\ndisqualifying them as the act appears to have been done in good faith<br \/>\nand in the interest of the petitioners.\n<\/p>\n<p>6.\tIn<br \/>\nview of the above, the petition is partly allowed. The impugned<br \/>\norders passed by the Tribunal as also the Board of Nominees, Vadodara<br \/>\nare quashed and set aside. The petitioners will not be considered as<br \/>\n&#8216;disqualified&#8217; under the Act. The Society concerned is permitted to<br \/>\nwithdraw the amount lying before the Tribunal or the authority<br \/>\nconcerned, as the case may be and the payment shall be made by way of<br \/>\na cheque. With the above observation and direction, the petition<br \/>\nstands disposed of. Rule is made absolute to the above extent with no<br \/>\norder as to costs.\n<\/p>\n<p>[K.\n<\/p>\n<p>S.
